RESOLUTION 06-63
A RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR A FENCE
AND DRIVEWAY GATE AT 1423 KNOLLWOOD LANE
WHEREAS, Sherwin Sieden has applied for a Conditional Use Pen-nit for a
Fence and Driveway Gate at 1423 Knollwood Lane [PIN: 27-37660-180-01 Plat: Ivy
Falls South Addition, Lot 18, Block 1] as proposed in Planning Case #06-23; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on July 25, 2006; and
WHEREAS, The Planning Commission voted to recommend that the Council
approve the Conditional Use Permit for a Fence and Driveway Gate as presented to the
Planning Commission on the evening of July 25, 2006 and as shown in Planning Case
#06-23;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Conditional Use Permit for a Fence and Driveway Gate at
1423 Knollwood Lane as proposed in Planning Case #06-23 is hereby approved.
BE IT FURTHER RESOLVED that in support of the above approval, the
Council hereby makes the following Findings of Fact:

2. There is an existing swimming pool on the subject site and the Ordinance
requires the installation of at least a five-foot tall fence surrounding swimming
pools.
3. The proposed gate is consistent with the Conditional Use Permit criteria for
such gates provided that the gate is no taller than five feet.
4. Approval of the Conditional Use Permit for the proposed fence and the
Conditional Use Permit for the proposed gate is not anticipated to have a
negative effect on the public's health safety or welfare.
