Res 2006- 66 Approving Variance @ 610 Watersedge TerraceCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 06-66 A RESOLUTION APPROVING A TWO-FOOT SIDE YARD SETBACK VARIANCE FOR AN ATTACHED GARAGE AT 610 WATERSEDGE TERRACE WHEREAS, Linda Byrne has applied for a Two-Foot Side Yard Setback Variance for an Attached Garage at 610 Watersedge Terrace [Lot 12 Block 6 Copperfield 3'd Addition, PED#27-18302-120-06] as proposed in Planning Case #06-22; and WHEREAS, The City Council considered this application at their regular meeting on August 1, 2006; and WHEREAS, The City Council voted to approve the Two-Foot Side Yard Setback Variance for an Attached Garage as presented to the City Council on the evening of August 1, 2006 and as shown in Planning Case #06-22; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Two-Foot Side Yard Setback Variance for an Attached Garage for 610 Watersedge Terrace as proposed in Planning Case #06-22 is hereby approved. BE IT FURTHER RESOLVED that in support of the above approval, the act: 1 The City's Zoning Ordinance prefers attached garages for residential structures over detached garages. 2. An addition to the attached garage in the proposed location will not impair traffic safety. 3. There are unique circumstances pertaining to the applicant's property not caused by the owner that create a sufficient hardship to justify the requested de minimis variance. 4. Approval of the requested variance will not alter the essential character of the neighborhood BE IT FURTHER RESOLVED that the Two-Foot Side Yard Setback Variance for an Attached Garage for 610 Watersedge Terrace as proposed in Planning Case #06-22 under the above conditions would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
