Res 2006- 79 Approving CUP @ 871 Cherri LaneCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 06-79 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR THE CONSTRUCTION OF A DETACHED GARAGE AT 871 CHERI LANE WHEREAS, Jacqueline Peterson has applied for a Conditional Use Permit for the Construction of a Detached Garage at 871 Cheri Lane [PIN: 27-45300-250-00 Plat: Linden Addition, Lot 25] as proposed in Planning Case #06-26; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on August 22, 2006; and WHEREAS, The Planning Commission voted to recommend that the Council approve the Conditional Use Permit for the Construction of a Detached Garage as presented to the Planning Commission on the evening of August 22, 2006 and as shown in Planning Case #06-26; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Conditional Use Permit for the Construction of a Detached Garage at 871 Cheri Lane as proposed in Planning Case #06-26 is hereby approved. BE IT FURTHER RESOLVED that in support of the above approval, the Council hereby makes the following Findings of Fact: The proposed garage meets all zoning requirements for setback and size. 2. The proposed detached garage is consistent with other single family properties in the 3. The proposed garage will be able to be designed and constructed to be consistent with the architecture and materials of the principal building. 4. The new structure will replace an existing structure that is deteriorating in condition due to structural problems. BE IT FURTHER RESOLVED that the Conditional Use Pen-nit for the Construction of a Detached Garage at 871 Cheri Lane as proposed in Planning Case #06-23 would not have an adverse impact on the health, safety and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose of the Zoning Ordinance.
