Res 2006- 96 Comprehensive Plan Amendment for Lemay ShoresCITY OF ME, NDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 06 -96 A RESOLUTION APPROVING A COMPREHENSIVE PLAN AMENDMENT FROM INSTITUTIONAL (CEM) TO LOW DENSITY RESIDENTIAL (LR) AT LEMAY SHORES WHEREAS, Mr. Pat Hoffman, on behalf of Hoffman- Mendota Shores, LLC, has applied for a Comprehensive Plan Amendment from CEM to LR at Lemay [see attached legal description] as proposed in Planning Case #06 -30; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on September 26, 2006; and WHEREAS, the City Planner recommended approval of this application; and WHEREAS, The Planning Commmission recommended that the Council approve Comprehensive Plan Amendment from CEM to LR a Residential Development as presented to the Planning Commission on the evening of September 26, 2006 and as shown in Planning Case #06 -30; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Comprehensive Plan Amendment from CEM to LR Residential Redevelopment for Lemay Shores as proposed in Planning Case #06 -30 is hereby approved -- subject to Metropolitan- Council - approval. -- BE IT FURTHER RESOLVED that in support of the above approval, the Council hereby finds that the Comprehensive Plan Amendment is not likely to create significant burden on regional systems, and is consistent with metropolitan planning objectives. BE IT FURTHER RESOLVED that the Comprehensive Plan Amendment from CEM to LR for a Residential Redevelopment for Lemay Shores as proposed in Planning Case #06 -30 under the above conditions would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
