Res 2006- 97 Approving Variance @ 731 Woodridge DrCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 06 -97 A RESOLUTION APPROVING A 10' VARIANCE TO BLUFF LINE SETBACK AND CRITICAL AREA PERMIT FOR A PORCH ADDITION AT 731 WOODRIDGE DRIVE WHEREAS, Jon Bergh has applied for a 10' Variance to the Bluff Line Setback and a Critical Area Permit for Construction of a Porch Addition at 731 Woodridge Drive [PIN: 27- 90070- 010 -00, Legal Description: Tract A, Registered Land Survey No. 7 Torrens Property (Certificate #130809)] as proposed in Planning Case #06 -31; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on September 26, 2006; and WHEREAS, The Planning Commission voted to recommend that the Council approve the 10' Variance to the Bluff Line Setback and a Critical Area Permit for Construction of a Porch Addition at 731 Woodridge Drive as presented to the Planning Commission on the evening of September 26, 2006 and as shown in Planning Case #06 -31; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a 10' Variance to the Bluff Line Setback and a Critical Area Permit for Construction of a Porch Addition at 731 Woodridge Drive as proposed in Planning Case #06- 31 is hereby approved. BE IT FURTHER RESOLVED that in support of the above approval, the Council _. hereby makes the following Findings of Fact: 1. Denial of the variance would restrict the reasonable use of the property. 2. The 10' encroachment into the bluff setback is less than the encroachment of the existing patio.
