Res 2006-118 Denying Variance @ 613 Pond View DriveCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 06 -118 A RESOLUTION DENYING AN 11' VARIANCE TO THE FRONT YARD SETBACK FOR A GARAGE ADDITION AT 613 POND VIEW DRIVE WHEREAS, John Morgan has applied for a 7' Variance to the Front Yard Setback for a Garage Addition at 631 Pond View Drive [PIN: 27- 18301- 090 -01 Plat: Lot 9, Block 1, Copperfield 2nd Addition] as proposed in Planning Case #06 -32; and WHEREAS, city staff measured the setback variance required to be 11'; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on September 26, 2006; and WHEREAS, The Planning Commission voted to recommend that the Council deny the 7' Variance to the Front Yard Setback for a Garage Addition at 631 Pond View Drive as presented to the Planning Commission on the evening of September 26, 2006 and as shown in Planning Case #06 -32. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a 11' Variance to the Front Yard Setback for a Garage Addition at 631 Pond View Drive as proposed in Planning Case #06 -32 is hereby denied. BE IT FURTHER RESOLVED that in support of the above denial, the Council hereby makes the following Findings of Fact: 1. The applicant has not shown a hardship in complying with the zoning regulations in that since the property is currently being put to a use that is in conformance with current zoning regulations. 2. The applicant can seek other alternatives to storage of personal equipment, such as a detached storage building in the rear yard of the property.
