RESOLUTION 08 -09
A RESOLUTION APPROVING A NINE AND ONE -HALF FOOT VARIANCE
AND A SEVEN FOOT VARIANCE TO THE FRONT YARD SETBACK AT 790
RIDGE PLACE
WHEREAS, Sean Doyle on behalf of Maureen Haggerty has applied a nine and
one -half foot variance and a seven foot variance to the front yard setback for construction
projects at 790 ridge place [PIN: 27- 71050- 251 -00; Somerset Hills Lot 25 ex Beg NW
Cor E on N line 130 Ft SW to Pt on N Line of S 100 Ft which is 120 Ft E of W Line W
on N Line of S 100 Ft to W Line Lot 25 N on W Line to Beg.] as proposed in Planning
Case #08 -01; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on January 22, 2008; and
WHEREAS, The Planning Commission voted to recommend that the Council
approve the Variance as presented to the Planning Commission on the evening of January
22, 2008 and as shown in Planning Case #08 -01.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a nine and one -half foot variance and a seven foot variance
to the front yard setback at 790 Ridge Place as proposed in Planning Case #08 -01 is
hereby approved with the following Findings of Fact:
1. The proposed roof over the front porch will not infringe any further into the
existing front setback of the porch
2. The proposed addition will be in line with the front elevation of the home;
3. The proposed construction projects will not alter the essential character of the
neighborhood
4. The hardship is due to circumstances unique to the property and not created by the
landowner;
5. The application is consistent with the comprehensive plan.
Adopted by the City Council of the City of Mendota Heights This 4th day of December,
2007.
