Res 2008-19 Appoving Wetlands/CUP @ 949 MH RdCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 08 -19 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT AND WETLANDS PERMIT AT 949 MENDOTA HEIGHTS ROAD WHEREAS, Paul Solmon on behalf of St. Thomas Academy has applied for a Conditional Use Permit and Wetlands Permit for work relating to installing synthetic turf at the stadium at 949 Mendota Heights Road [PIN: 27- 03500 - 010 -51; Section 35 Twn 28 Range 23 NE 1/ of SW 1/ Ex N 198Ft of E 636 Ft 036992 35 2823 and 27- 66100- 010 -01; St Thomas Academy Additional Lot 1 Block 1 and 27- 66100 - 020 -01; St Thomas Academy Addition Lot 2, Block 1] as proposed in Planning Case #08 -08; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on March 25, 2008; and WHEREAS, The Planning Commission voted to recommend that the Council approve the Conditional Use Permit and Wetlands Permit as presented to the Planning Commission on the evening of March 25, 2008 and as shown in Planning Case #08 -08. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Conditional Use Permit and Wetlands Permit as proposed in Planning Case #08 -08 is hereby approved with the following conditions: 1. The final site grading plan shall be subject to the review and approval of the City Engineer 2. All issues relating to grading and drainage of the site shall be subject to the review and approval of the City Engineer 3. A copy of the NPDES Permit shall be submitted to the City Engineer BE IT FURTHER RESOLVED that in support of the above approval, the Council hereby makes the following Findings of Fact: 1. The proposed expansion of the existing stormwater pond is consistent with the character and use of the site and neighborhood, and will not negatively impact public health, safety and welfare. 2. The proposed application is consistent with the intent of the Wetlands Ordinance, which is to provide for the protection, preservation and maintenance of water resource related areas and to minimize the disturbance which may result from land alterations.
