Res 2008-20 Approving Variance/Lot Line Adj @ 760 Upper Colonial DrCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 08-20 A RESOLUTION APPROVING A LOT LINE ADJUSTMENT AND VARIANCES TO LOT WIDTH AND AREA AT 760 UPPER COLONIAL DRIVE WHEREAS, Walter Awada and Tad and Susan Anzion have applied for a Lot Line Adjustment to resolve an existing property encroachment [PIN: 27-17150-080-07; Lot 8, Block 7, Cherry Hill and 27-17150-070-07; Lot 7, Block 7 Cherry Hill] as proposed in Planning Case #08-09; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on March 25, 2008; and WHEREAS, The Planning Commission voted to recommend that the Council approve Lot Line Adjustment and Variances to lot width and lot area as presented to the Planning Commission on the evening of March 25, 2008 and as shown in Planning Case #08-09. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that Lot Split at 1900 Wachtler Ave as proposed in Planning Case #08-09 is hereby approved with the following conditions: 1. A copy of the casement between the property owners of Parcel B and Lot 9, Block 7 Cherry Hill shall be submitted to the City 2. The strip of land conveyed to the property owners of Parcel A shall be combined with the reminder of the property (Lot 7, Block 7 Cherry Hill). 3. An updated survey shall be submitted to the City for its records, indicating the correct lot widths — the maximum horizontal distance between the side setbacks and lot areas for Parcel B without the lot line adjustment on the east property line; indicating the proposed easement between Parcel B and Lot 9, Block 7 Cherry Hill. BE IT FURTHER RESOLVED that in support of the above approval, the Council hereby makes the f6llowing Findings of Fact: 1. The proposed lot line adjustment shall improve the current encroachment situation. 2. The proposed variances to the lot width and lot area of Parcel B, are special circumstances unique to the subject property, not created by the landowner, and the variances, if granted, will not alter the essential character of the neighborhood, and that removal of the structures would not be a reasonable solution to this problem.
