Res 2008-34 Approving Critical Area Permit @ 1205 Culligan AveCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 08 -.34 A RESOLUTION APPROVING A CRITICAL AREA PERMIT AT 1205 CULLIGAN LANE WHEREAS, Brian Krisko has applied for a Critical Area Permit to construct a fence at 1205 Culligan Lane [PIN: 27- 44900- 050 -00, Lot 5 Leone- Re -arr. and that part of the adjoining Culligan Lane cul -de -sac, abandoned, lying north of a line extending from the southeast corner of said lot to the southwest corner of said lot. The west boundary line of lot 5 is marked by the Judicial Landmarks set pursuant to case no. CX- 98 -7128] as proposed in Planning Case #08 -13; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on May 27, 2008; and WHEREAS, The Planning Commission voted to recommend that the Council approve the Critical Area Permit as presented to the Planning Commission on the evening of May 27, 2008 and as shown in Planning Case #08 -13. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Critical Area Permit at 1205 Culligan Lane as proposed in Planning Case #08 -13 is hereby approved with the following condition: 1. The fence shall be constructed in a manner which is compliant with section 12- 1 D -6.A of the Mendota Heights City Code. BE IT FURTHER RESOLVED that in support of the above approval, the Council hereby makes the following Findings of Fact: 1. The proposed fence will not jeopardize the aesthetic integrity and natural environment of the Mississippi River corridor critical area.
