Res 2008-35 Approving Variance @ 790 Wentworth AveCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 08 -355 A RESOLUTION APPROVING A SIX FOOT VARIANCE TO THE FRONT YARD SETBACK AT 790 WENTWORTH AVE WHEREAS, Russell Rider has applied for a six foot variance to the front yard setback to construct a roof over the front entrance of the house at 790 Wentworth Ave [PIN: 27- 03800 - 051 -36; Auditors Subdivision #3 east 1 acre of W 2 acres of L -36 ex pt of SW quarter of Sec. 24 Twn 28 Range 23 lying W of Wentworth Meadows E of W 118.37 ft N of Evergreen Knolls lst Add and S of N 280ft] as proposed in Planning Case #08 -14; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on May 27, 2008; and WHEREAS, The Planning Commission voted to recommend that the Council approve the Variance as presented to the Planning Commission on the evening of May 27, 2008 and as shown in Planning Case #08 -14. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a six foot variance to the front yard setback at 790 Wentworth Ave as proposed in Planning Case #08 -14 is hereby approved with the following Findings of Fact: 1. The hardship is due to circumstances unique to the property and not created by the landowner; 2. The proposed construction project will not alter the essential character of the neighborhood 3.
