WHEREAS, Alltech Engineering has applied for an eighteen (18) foot variance
to the side yard setback to construct an addition at 2515 Pilot Knob Road [PIN: 27-
03300- 020 -79; The N 330 feet of the S 1320 feet of the E 660 feet of Government Lots 1
and 2 except the N 40 feet thereof used for Village Street purposes in Section 33,
Township 28, Range 23] as proposed in Planning Case #08 -12; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on May 27, 2008; and
WHEREAS, The Planning Commission voted to recommend that the Council
deny the Variance as presented to the Planning Commission on the evening of May 27,
2008 and as shown in Planning Case #08 -12 for a lack of demonstrated hardship.
WHEREAS, the applicant has provided staff additional material defining the
hardship and identifying alternative options which were considered,
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that an eighteen foot variance to the side yard setback at 2515
Pilot Knob Road as proposed in Planning Case #08 -12 is hereby approved with the
following Findings of Fact:
1. The improvements to Mendota Heights Road created a unique circumstance upon
the property and not created by the landowner
2. The applicant has considered alternatives to the proposed addition
3. The proposed construction project will not alter the essential character of the
neighborhood
4. The application is consistent with the comprehensive plan
