A RESOLUTION APPROVING A CRITICAL AREA PERMIT AT 1680
LEXINGTON AVE
WHEREAS, Keith Ostrosky has applied for a critical area permit — modified site
plan review for several landscaping projects at 1680 Lexington Avenue [PIN: 27- 02300-
010-50; Section 23 TWN 28 Range 23 Pt of Govt Lot 5 Com SW Cor Sec N on W line

Case #08 -24; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on August 26, 2008; and
WHEREAS, The Planning Commission voted to recommend that the Council
approve the Variance and the critical area modified site plan as presented to the Planning
Commission on the evening of August 26, 2008 and as shown in Planning Case #08 -24.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a critical area permit at 1680 Lexington Avenue East as
proposed in Planning Case #08 -24 are hereby approved with the following conditions:
1. The grading and moving of dirt shall be minimal in order to accomplish the
installation of the water feature;
2. The grading and moving of dirt shall be minimal in order to install the stone
posts;
3. The building permit for the shed shall not be issued until Council has approved;
4. The brick pavers will be installed to direct drainage away from the home.
BE IT FURTHER RESOLVED that in support of the above approval, the
Council hereby makes the following findings of fact:
1. The proposed drainage and erosion work will not jeopardize the aesthetic integrity
and natural environment of the Mississippi River corridor critical area.
