VILLAGE OF MENDOTA HEIGHTS
DAKOTA COUNTY, MINNESOTA
AN ORDINANCE REGULATING THE DISPOSAL OF GARBAGE
AND RUBBISH, PROVIDING FOR THE COLLECTION THERE-
OF AND LICENSING THE BUSINESS OF GARBAGE AND
- RUBBISH COLLECTION.
The Village Council of the Village of Mendota Heights
ordains as follows:
Section 1. License Required. Hereafter it shall be un-
lawful for any person to collect, haul, solicit or buy any garbage
from or to any place within the corporate limits of the Village
of Mendota. Heights, other than his own ,residence or place of
business, unless employed by the Village for that purpose, with-
out first having obtained a license so to do as hereinafter pro-
vided.
Section 2. Definitions. For the purpose of this ordinance,
garbage shall be defined to include all waste matter or material
of every kind, and shall be classified as either wet garbage or
dry garbage. Wet garbage shall include every waste accumulation
of animal, fruit, or vegetable matter that attends the preparation,
use, cooking, keeping, storing, buying, selling, or transporting
of meats, fish, fowl, birds, fruits,(Vegetables, and other pro-
visions together with table refuse of any kind. Dry garbage shall
include all refuse which is not wet garbage, including but not
limited to such articles as dust, ashes, cans, broken glass, paper,
and sweepings.
As used in this ordinance, the term "Person" shall mean
and include a natural person of either sex, persons, co-partner -
ships, corporations, or associations of persons and shall include
the agent or manager of any of the aforesaid. The singular shall
include the plural and the masculine pronoun shall include the
feminine and neuter.
Section 3. Application. Application for such licenses
shall be filed with the Village Clerk on forms furnished by the
Village.
Section 4. Fee. The fee for each such license shall be
$25.00 annually. When a license is issued, the Village shall fur-
nish to the licensee for a charge of $3.00 a metal license plate
for each vehicle to be used by such licensee within the Village
of Mendota Heights, which license plate shall be affixed to each
such vehicle in a conspicuous place.
Section 5. Issuance of License. All licenses shall be
issued by the Village Clerk.
Section 6. Expiration. All licenses shall expire on
� z 1 following the date of issuance unless sooner revoked or
forfeited. If a license granted hereunder is not renewed previous
to its expiration, then all rights granted by such license shall
cease, and any work performed after the expiration of the license
shall be in violation of this Ordinance.
Section 7. Renewal of License. Persons renewing their
licenses after the expiration date shall be charged the full
annual license fee. No prorated license fee shall be allowed
for -renewals.
Section 8. Revocation or Suspension. The Village Council
may suspend or- revoke the license of any person licensed under
this Ordinance whose conduct is found to be in violation of the
provisions of this Ordinance or whose work hereunder or vehicle
or vehicles used in connection therewith is found to be improper
or defective or so unsafe as to jeopardize life or property. The
person holding such license shall be given ten (10) days notice
in writing of such complaint and shall be granted the opportunity
to be heard before such action is taken. Notice hereunder shall
be deemed sufficient if it is sent to the address of the licensee
as shown on his most recent application for a license hereunder.
Section 9. Revocation upon Violations. When any person
holding a license has been convicted for the second time by a
court of competent jurisdiction for violation of any of the pro-
visions of this Ordinance, the Council shall revoke the license
of the person so convicted. Such person may not make application
for a new license for a period of one near.
Section 10. Storing of Garbage. All garbage shall be
kept in receptacles provided for that purpose and wet garba e
shall be kept or allowed to remain not longer than three (3
hours at any place in the Village of Mendota Heights unless placed
or deposited in a covered, water tight receptacle provided for that
pur ose, and then in said receptacle for not more than forty -eight
(z(8_� hours. Wet garbage and dry garbage as herein defined shall
not be in any way mixed or placed in the same receptacle. Dry
garbage shall not be accumulated or maintained within the Village
for any period in excess of fourteen (14) days.
Section 11. Classification, Districts. The Village
Council shall have the power to establish districts for the col-
lection and handling of garbage and may classify the same and
may, when ordering the issuance of a license hereunder, specify
the kind of garbage to be collected and the places from which
the same is to be solicited, collected or bought; provided, that
garbage shall in no case be.exchanged, or reloaded from one ve-
hicle to another within the corporate limits of the Village of
Mendota Heights. Every- person operating under this Ordinance
shall display upon his vehicle of collection a conspicuous tag
showing the bind of license and the year thereof.
Section 12. Vehicles, Covering. The operators of all
vehicles transporting garbage within the Village of Mendota Heights
shall cover such loads. A tarpaulin or similar type covering shall
be deemed to comply with the requirements of this section.
Section 13. Liability Insurance Any person holding a
license hereunder shall file with he Village Clerk policies of
public liability and property damage which shall remain and be
in force and effect during the entire term of said license and
which shall contain a provision that they shall not be cancelled
without 10 days' written notice to the Village. Public liability
insurance shall not be less than $25,000 for injuries, including
accidental death to any one person, and, subject to the same limit
for each person, in an amount of not less than $50,000 on account
of any one accident, and property damage insurance in the amount
of not less than $5,000 for each accident or mishap. Said poli-
cies of insurance shall further provide for indemnity and security
to the Village of Mendota Heights against any liability and /or

responsibility for the acts, actions, or omissions of the li-
censee or of any of the agents or servants of such licensee
subject, however, to the limitations as to amount herein stated.
No work shall be done under any license hereunder until said
insurance policies shall have been filed and approved by the
Village Clerk.
Section 14. Penalties. Any person who shall violate
any of the provisions of this Ordinance shall be guilty of a mis-
demeanor and shall be punished by a fine of not to exceed $100.00,
or by imprisonment in the county jail for a period of not to ex-
ceed 90 days.
Section 15. Effective Date. This Ordinance shall be in
force and effect from and after its publication according to law.
