BUILDING CODE
AN ORDINANCE REGULATING THE ERECTION, CONSTRUC-
TION, ENLARGEMENT, ALTERATION., REPAIR, MOVING,
REMOVAL, CONVERSION, DEMOLITION, OCCUPANCY, AND
MAINTENANCE OF BUILDINGS OR.STRUCTURES IN THE
VILLAGE OF MENDOTA HEIGHTS: PROVIDING FOR THE
ISSUANCE OF PERMITS, COLLECTION OF FEES THERE-
FORE: AND PROVIDING PENALTIES FOR.THE VIOLATION
THEREOF, AND REPEALING ALL ORDINANCES AND PARTS
OF ORDINANCES IN CONFLICT THEREWITH.
The Village Council of Mendota Heights ordains as follows:
Section 1. Specifications. The Uniform Building Code, Short
Form, 1961 Edition, as published by the International Conference
of Building Officials, is hereby adopted as the official Building
Code of the Village of Mendota Heights and is hereby made a part
of this ordinance as authorized under the State of Minnesota
Statutes, 1961, Section 471.62. Before publication of this ordi-
nance, the Village Clerk shall mark three copies of this Code as
official copies and file them for public use and examination.
All construction in the Village of Mendota Heights shall be
according to the provisions of said Building Code subject to the
amendments in Section 2 of this ordinance. Except where speci-
fically excepted or modified, all portions of Sections of the
Uniform Building Code shall be adopted by reference except those
portions of Sections in conflict with amendments contained here-
inafter.
Section 2. Amendments. The Building Code adopted by reference
in Section I of this ordinance shall be amended to read as follows:
2.1 Section 303(a) Building Permit Fees.
A fee for each building permit for repair, remodeling
or alteration of an existing structure, shall be paid
at the time application is made for a building permit
as set forth in Table 3-A, Building Permit Fees, except
as hereinafter amended. The determination of value or
valuation under any of the provisions of this code shall
be made by the Building Official-.
The fee for a building permit for the construction of
a new building or the erection of an addition to an
k existing structure shall be as follows:
Houses - first 1,000 cu. ft.
Houses - each additional 1,000 cu. ft.

For the purpose of computing fees for building permits
as above provided, the cubical contents of any proposed
structure or addition to an existing structure shall. be
computed in the following manner to determine the cost
of the building permit:
(1) If the proposed structure or addition consists
of one story without basement, the cubic feet
shall be determined by multiplying the actual
gross square footage by fifteen (15).
(2) If the proposed structure or addition consists
of one story and basement, the cubic feet shall
be determined by multiplying the actual gross
square footage by twenty (20).
(3) If the proposed structure or addition consists
of one story, a basement, and expansion area,
the cubic feet shall be determined by multiplying
the actual gross square footage by twenty-four
(24) .
(4) If the proposed structure or addition consists
of two stories and basement, the cubic feet
shall be determined by multiplying the actual
gross square footage by twenty-eight (28).
(5) The cubic feet in porches, garages, and breeze-
ways shall be determined by multiplying the
actual gross square footage therein by ten (10).
(6) If the proposed structure or addition does not
fit in the categories set out in (1) through
(5) above, the cubic feet shall be determined
in.accordance with generally accepted engineering
methods.

2.2 Section 2202. Sheathing
Sheathing shall be one or more of the following materials:
Wood not less than 25/32" thick.
Fiberboard not less than,25/32" thick complying
with U.B.C. Standard No. 22-1-61.
Plywood not less than 5/8" thick complying with
U.B.C. Standard
Insulated Strongboard
brand Name) or equivalent

not less than 1/2' thick.
2.3 Section 2802 (b). Protection of Adjoining Property
Any person making or causing an excavation to be made
a depth of twelve feet (1211 or less, below grade, shall
protect the excavation so that the soil of adjoining
property will not cave in or settle and may be liable
for the expense of underpinning or extending the founda-
tion of buildings on adjoining property where his excava-
tion necessitates such work.
2.4 Section 2515 (e). Plywood Subflooring
Shall be amended so as to require all plywood, where
used as structural subflooring, to be a minimum thick-
ness of 5/8" or greater if required in Table No. 25-n.
2.5 Section 2515 (f). Plywood Roof Sheathing
Shall be amended so as to require all plywood, where
used as structural roof sheathing, to be a minimum
thickness of 1/2" or greater if required in Table No. 25-0.
2.6 Section 2507 (f). 2. Weatherboarding
Building paper may be required when prefabricated wall
panels are utilized.
2.7 Section 2507 M 3. Plywood
Itkien plywood is used for covering the exterior of outside
walls, it shall be of the exterior type weatherboarding
not less than one-half inch (1/2") thick.
2.8 Section 2806 (a). Footings - General
Shall be amended so as to require frost wall footings
to be at least four feet (4 ft.) below the finished
grade adjacent to the wall at all points.

2.9 Section 205. Violations and Penalties
Section 205 of the code adopted by reference
shall be amended so as to provide a penalty
of not more than One Hundred Dollars 0100.00)
or imprisonment for not more than ninety (�O)
days.
2.10 Section 1405 (b) . Room Sizes and Ceiling Heights
Rooms used for living, dining, sleeping, or
kitchen purposes shall have an area. of not
less than the following:
a Living Room 165 Sq. ft.
b Dining Room 85 Sq. ft.
c Kitchen 100 Sq. ft.
di Bedroom 100 Sq. ft.
"In every dwelling unit except apartments here-
after constructed there shall be at least four
(4) habitable rooms. Kitchens and one bedroom
of,.three (3) and four (4) bedroom houses may be
ninety (go)-square feet... The minimum ground
floor area-of any dwelling unit as determined by
the overall exterior dimensions, excluding porches,
garages, stoops, breezeways and terraces, shall
be as follows:
One story dwelling units of three (3)
bedrooms or more - - 1050 sq. ft.
One story dwelling units of two (2)
bedrooms or less 850 sq. ft.
One and one-half (1-ffl) or two (2)
story dwelling units- 720 sq. ft.
Section 3. Repeal of Existing Ordinance. Ordinance No. 4, as
amended, being an ordinance to regulate the construction of
buildings enacted April 16, 1956 and published May 17, 1956,
is hereby repealed except for the following:
Section 1.1 as amended the 27th day of August,
1956, and as further amended under Section 1 (A)
of Ordinance No. 17 enacted and ordained July..15,
1957
Section 1.5 as amended the 27th day of August,
1956
Section 1.6 as amended the 27th day of August,
1956

Section 3.62 as enacted and ordained the 27th
day of August, 1956
Article V, WATER SUPPLY SYSTEMS, as provided
in Section 1 (E) of Ordinance No. 17 enacted
and ordained the 15th day of July, 1957.
Section 4. Completion Time. Any residence for which a building
permit ha,s been issued shall be completed and ready for occupancy
according to the approved plans and specifications within three
(3) years following issuance of said permit.
Section 5. Fire Zones. The following shall be and are hereby
declared to be the fire limits:
Zone 2. All property zoned or used for purposes
other than residential. Residential,
except when classed as an institutional
building, means a building in which
sleeping accommodations are provided.
Section 6. ' Approval .of Plans - . All building construction plans
submitted with an application for a. building permit shall be
signed as being approved by a registered architect or engineer.
Single and two-family structures are excepted from this require-
ment.
Section 7. License Required. Before any person shall engage
in the business of doing any of the work listed in the Uniform
Building Code, he shall first obtain a license to do so as pro-
vided for by the licensing regulations of the Village of Mendota
Heights except as hereinafter amended:
7.1 A license shall not be required when the
owner occupant of any property repairs,
alters, converts, or erects a structure
without remuneration and such work is done
solely upon the premises owned and occu-
pied by said person or persons. All such
work shall require a, building permit and
shall conform to all applicable provisions of the
Uniform Building Code.
7.2 Unlicensed work authorized in Section
7.1 of this ordinance may include general
construction, cement work, cement block
or brick work, plastering, lathing, stucco
work, and roofing but shall not include
plumbing, heating, electrical, or gas
installation work.

Section 8. Validity and Date Effective. All ordinances or parts of
ordinances of the Village of Mendota Heights in conflict with the
provisions of this ordinance are hereby repealed.
If-any section, subsection, sentence, clause, or phrase of
this ordinance is for any reason held to be invalid, such decision shall
not affect the validity of the remaining portion of this ordinance.
This ordinance shall become effective upon its adoption and
and publication according to law.
