VILLAGE OF MENDOTA HEIGHTS

AN ORDINANCE PROVIDING FOR THE LICENSING OF
CERTAIN BUSINESSES AND OCCUPATIONS AND PRO-
VIDING FOR THE REGULATION THEREOF.
The Village Council of Mendota Heights ordains as follows:
Section 1. Licenses Required. Before any person shall engage
in the business of doing or performing any of the various types
of work hereinafter listed in this Section within the Village
of Mendota Heights he shall first obtain a license to do so as
hereinafter provided:
(1) Cement work, cement block work, cement
- .. block laying or brick work.
(2) General construction including erection,
. . alteration or repair of building.
(3) The moving or wrecking of buildings.
(4) Plastering, outside stucco work or lathing.
(5) Electric wiring.
(6) Plumbing including installation of outside
- - sewage disposal plants and connection to
the municipal sewer and water systems.
(7) Heating.
Gas installation including heating, appli-
ances, devices or machinery, etc.
(9) Well drilling.
(10) Roofing.
(Itl) Sign and billboard erecting.
(12) Excavators (for basements, foundations,
- - grading of lots, etc.)
Section 2. Application. Application for such licenses shall
be filed with the Village Clerk on forms furnished by the Village.
Sectiala 3. Fee. The fee for each such license shall be $25.00
an-.iu,q.2Liy.
Section 4. Issuance of License. All licenses shall be issued
by the Village Clerk.
Section 5. Expiration. All licenses shall expire on July 1
following the date of issuance unless sooner revoked or for-
- felted. If a license granted hereunder is not renewed previous
to its expiration, then all rights granted by such license shall
cease, and any work performed after the expiration of the license
shall be in violation of this Ordinance.
Section 6. Renewal of License. Persons renewing their licenses
after the expiration date shall be charged the full annual license
fee. No prorated license fee shall be allowed for renewals.
Section 7. General Contractors. A license granted to a general
contractor shall include the right to perform all of the work
included in his general contract. Such license shall include
any or all of the persons performing the work which is classified
and listed, providing that each person performing such work is in
the regular employ of such general contractor and qualified under
State Law and the provisions of this Ordinance to perform such
work. In these cases, the general contractor shall be responsible
for all of the work so performed. Sub-contractors on any work
shall be required to comply with the sections of this Ordinance
pertaining to license, bond, qualifications, etc. for his particu-
lar type of work.
Section 8. Qualifications. Each applicant for a license shall
satisfy the 'Council that he is competent by reason of education,
special training, experience and that he is equipped to perform
the work for which a license is requested, in accordance with all
State of Minnesota laws. Where a State of Minnesota license is
required, no license shall be issued hereunder unless the appli-
cant has the required State license.
Section 9. Revocation or Suspension. The Council may suspend
or revoke the license of any person licensed under this Ordinance,
whose work is found to be improper or defective or so unsafe as
to jeopardize life or property. The person holding such license
shall be given 20 days' notice and granted the opportunity to be
heard before such action is taken. If and when such notice is
sent to the legal address of the licensee and he fails or refuses
to appear at the said hearing, his license will be automatically
suspended or revoked 5 days after date of hearing.
Section 10. Period of Suspension. When a license is suspended,
the period of suspension shall be not less than 30 days nor more
than one year, such period being determined by the Council.
Section 11. Revocation upon Violations. When any person holding
a license has been convicted for the second time by a court of

competent jurisdiction for violation of any of the provisions
of this Ordinance, the Council shall revoke the license of the
person so-convicted. Such person may not make application for
a new license for a period of one year.
Section 12. Surety Bonds. No license granted under the terms
stated herein shall become effective until the licensee shall have
filed with the Clerk a surety bond in the penal sum as listed
below, operating in favor of the Village and conditioned that the
Village will be saved harmless from any loss or damage by reason
of improper or inadequate work performed by the holder of said
license under the provisions of this Ordinance. Such bonds shall
be subject to approval as to form, execution and surety.

Section 13. Bond of Building Mover. Any person applying for
a. permit to move a building may be required by the Council to
furnish the Village with a surety bond, the amount of which
may be established by the Council prior to the issuance of
such permit in an amount in excess of $2,000.00. The bond
shall guarantee that any damage of any kind to public property,
right-of-way, streets or utilities shall be promptly and com-
pletely repaired or replaced in a manner satisfactory to the
Village at the expense of said applicant.
Section 14. Insurance of Building Mover. Each applicant for
a permit to move a building over any street or public right-of-
way must satisfy the building inspector that he is provided with
sufficient and adequate insurance to protect the Village and
the public from any and all damages which may result, either
directly or indirectly, from the moving of said building.
Section 15. Liability Insurance. Any person holding a license
hereunder shall file with the Village Clerk policies of public
liability and property damage which shall remain and be in force
and effect during the entire term of said license and which
shall contain a. provision that they shall not be cancelled without
10 days' written notice to the Village. Public liability insurance
shall not be less than $25,000 for injuries, including accidental
death to any one person, and, subject to the same limit for each
person, in an amount of not less than $50,000 on account of any
one accident, and property damage insurance in the amount of not
less than $5,000 for each accident or mishap. Said policies of
insurance shall further provide for indemnity and security to
the Village of Mendota Heights against any liability and/or
responsibility for the acts, actions, or omissions of the licensee
or of any of the agents or servants of such licensee subject, how-
ever, to the limitations as to amount herein stated. No work
shall be done under any license hereunder until said insurance
policies shall have been filed and approved by the Village Clerk.
Section 16. Penalties. Any person who shall violate any of the
provisions of this ordinance shall be guilty of a misdemeanor and
shall be punished by a fine of not to exceed $100.00, or by im-
prisonment in the county jail for a period of not to exceed 90 days.
Section 17. Effective Date. This Ordinance shall be in force
and effect from and after its publication according to law.
Enacted and ordained into an ordinance this day of November,
1962.
