Ord 38 Regulating Water & SewerD � ORDINANCE NO. D VILLAGE OF MENDOTA HEIGHTS Dakota County, Minnesota AN ORDINANCE RELATING TO AND REGULATING THE USE OF WATER AND SEWER IN THE VILLAGE OF MENDOTA HEIGHTS ESTABLISHING RULES AND REGULATIONS FOR THE ADMINISTRATION OF THE WATER AND SEWER SYSTEMS IN THE VILLAGE AND MATTERS RELATING THERETO. The Village Council of Mendota Heights ordains as follows: Section 1. Establishment of Department. There is hereby estab- lished a Water and Sewer Department for the Village of Mendota Heights. The water and sewer systems as they are now constituted or shall hereafter be enlarged or extended shall be operated and maintained under the provisions of this ordinance subject to the authority of the Village Council at any time to amend, alter, change or repeal the same. Section 2. Applications, permits and fees. No person, firm or corporation shall proceed with the construction, enlargement, alteration, repair or make any type of connection to the water system, sanitary sewer system, or storm sewer system except upon making an application therefore on a form provided by the Village and receiving a permit issued by the Village for such purposes. The applicant shall pay to the Village Clerk a per- mit fee in the amount of $5.00 for any water connection and $5.00 for any sanitary sewer connection. In addition to the foregoing where application is made for connection to the sanitary sewer or water systems, a connection fee of $75.00 shall be collected for each connection where said connection is on a street with a permanent type base. The connection fee shall be $50.00 where the connection is on an unimproved street without a permanent type base. Fees for the connection of non-residential uses shall be based upon schedules as determined by the Village Council with the assistance of the Village Engineer. Section 3. Inspection. The Building Inspector shall examine all applications before construction is begun, and after the construction, enlargement, alteration, repair, or connection is complete, the Building Inspector shall be notified. It shall be unlawful to cover any connecting line until an inspection has been made and such connection and the work incident thereto has been approved by the Village as a proper and suitable con- nection. Section 4. Water Meter Regulations. No person, firm or corpo- ration other than the Village of Mendota Heights or its designee, shall install, maintain, or repair any water meter within the Village limits. Every water meter connected to the water system shall be sealed and no person, firm or corporation shall break or remove such seal except as authorized by the Village. It shall be unlawful for any person to tamper with, alter, bypass, or in any manner whatsoever interfere with the proper use and functioning of any water meter within the Village. Section 5. Implied Consent to Rules, Regulations and Rates and Holding Village Harmless. Every person applying for water or sewer service, every owner of property for which any such applica- tion is made, every person accepting water or sewer service, and every owner of property where such service is accepted subsequent to the passage of this ordinance shall be deemed upon making such application or accepting such service to consent to all rules, regulations, and rates as established by this ordinance and as may hereafter be set forth and adopted by the Village Council by resolution or ordinance, and further shall be deemed to agree to hold the Village harmless from any claim, damage, injury or loss caused by or in any way arising by reason of or related to their connection to or repair of their connection to the Village water or sewer system, including but not limited to excavation work in connection therewith. Section 6. Excavating Work and Testing and Reading of Meters. All connections or installation work or repair of connections to the water and sewer systems including grades, bends and back- filling shall be performed under the direction and supervision of the Building Inspector only by persons duly licensed by the Village of Mendota Heights to perform such work. No such work shall be covered or back-filled until directed by said inspector. All such work and excavations shall be protected by barricades and warning markers and lights reasonable and suitable to the purpose. All street excavations shall be filled and compacted as directed by the building inspector. The Village of Mendota Heights by any authorized employee or agent shall have the right to enter and be admitted to any lands and property in the Village for the purpose of making inspection of materials, making meter readings, and making inspections of plumbing work and fixtures of all kinds used by or in connection with the water and sewer systems. Section 7. Private Water Not Permitted in Village System. Nhenever any premises are connected to the Village Water system, there shall be maintained a complete physcal separation between the Village water supply system and the private water supply system so that it is impossible to intentionally or unintentionally allow any water produced by a private system to be introduced in the supply line from the Village system. - 2 - Section 8. Delayed Connection Charge. Any owner of a building to which sewer service is or becomes 'available shall connect to such service within the calendar year following the availability of said service unless a time extension is granted by the Village Council. Section 9. Cesspools and Septic Tanks. 14hen connection is made to the community sewer system, all cesspools and septic tanks must be pumped and filled; if the sewer connection goes over, cast iron must be used to bridge the span. Section 10. Penalties. Any person who shall violate any of the provisions of this ordinance shall be guilty of a misdemeanor and shall be punished by a fine of not to exceed $100.00, or by imprisonment in the county jail for a period of not to exceed 90 days. Section 11. Effective Date. This Ordinance shall be in force and effect from and after its publication according to law. Enacted and ordained into an ordinance this [4 _day of November, 1962.
