AN ORDINANCE ESTABLISHING WEIGHT RESTRICTIONS
FOR MOTOR VEHICLES ON VILLAGE STREETS:, PRO-
VIDING,FOR TIM ESTABLISHMENT OF,STJCH WEIGHT
RESTRICTIONS.: PROVIDING FOR THE, ESTABLISH..-
MENT OF.TRUCK ROUTES-AND PROVIDING PENALTIES
FOR. VIOLATION THEREOF
The Village Council of the Village of Mendota
Heights ordains as follows:
Section 1. Seasonal.and Weight Restrictions on
Streets & Highways.
Subdivision 1. The Councilman designated by the
Mayor to be in charge of streets and roads in
the Village or the Village Engineer may pro-
hibit the operation of vehicles upon any
street or highway or impose restrictions
as to the weight of vehicles to be operated
thereon whenever any such street or highway,
by reason of deterioration, rain, snow or
other climatic conditions, will be seriously
damaged or destroyed unless the use of such
vehicles thereon is prohibited or the per-
missible weights thereof reduced. The Council-
man designated by the Mayor to be in charge
of streets and roads in the Village or the
Village Engineer shall erect or cause to be
erected and maintained, signs plainly indica-
ting the prohibition or restriction at each
end of that portion of any street or high-
way affected thereby. Said prohibition or
restriction shall not be effective unless
and until such signs are erected and shall
continue thereafter until such Councilman or
the Village Engineer cause such signs to be
removed.
Subdivision 2. Except where other restric-
tions are imposed as provided in Subdivision
1 above, no person shall operate any vehicle
or combination of vehicles upon any street,
road or highway under the jurisdiction of
the Village of Mendota Heights during the
( D — period between March 20 and May 15 of each
year, where the gross weight on any single
axle exceeds 8.,000 pounds; provided, that
there shall be excepted and exempt from the
provisions of this section emergency vehicles
of public utilities used incidental to making
repairs to its plant or equipment.
Subdivision 3. The provisions of Subdivision
2 shall not apply to routes, streets or high-
ways designated by Resolution of the Village
Council as Truck Routes and which are.identi-
fied as such by signs and markings to that
effect.
Subdivision 4. For reasons of hardship or
other good cause shown, a special permit
may be issued by the Village Councilman
designated by the Mayor to be in charge of
streets and roads or by the Village Engineer
authorizing vehicles which would otherwise
be prohibited under the provisions of Sub-
division 2 from traveling over certain streets,
roads or highways to travel over such streets,
roads or highways on a prescribed route for the
purpose of making deliveries to a home, com-
mercial or industrial establishment. Such
permit may be conditioned upon the giving of
security in sufficient amount to compensate the Village
for any injury or damage to any street, road
or highway caused by the operation of such
vehicle or combination of vehicles thereon.
Section 2. Definitions. A "Vehicle" as used in
this cha-5ter is defined as including all motor
vehicles, trucks, commercial vehicles, horse trailers
and trailers of all kinds or any object or contri--
vances being moved on wheels of any kind.
A "single axle" as used in this chapter is
defined as including all wheels whose centers may
be included within two parallel transverse vertical
planes 40 inches apart.
Section 3. Penalties. Any person who shall violate
any of the provisions of this Ordinance shall be guilty
of a misdemeanor and shall be punished by a fine of not
to exceed $100.00, or by imprisonment in the county jail
for a period of not to exceed 90 days.
Section 4. Effective Date. This Ordinance shall be in
force and effect from and after its publication according
to law.
Enacted and ordained into an ordinance this �day
