AN ORDINANCE REGULATING THE PARKING AND STORING
OF JUNK CARS WITHIN THE VILLAGE OFMENDOTA HEIGHTS
AND.PROVIDINGTENALTIES FOR VIOLATIONS..THEREOF ..
The Village Council of the Village of Mendota Heights
ordains as follows:
Section 1. Definitions.
1.1 "Junk Car" as used in this ordinance shall
be deemed..to mean any motor vehicle which:
(a) for a period of thirty (30) days or
more is not in operable condition, or (b)
for a period of thirty (30) dar or more
is partially dismantled, or (c is used for
sale of parts or as a source of repair or
re lacement parts for other vehicles, or
(d is kept for scrapping, dismantling,
or salvage of any kind, or (e) for a period
(
of thirty 30) days or more is not properly
licensed for operation within the State of
Minnesota.
1.2 "Person" as used in this ordinance shall be
deemed to mean a natural person, firm, as-
sociation, partnership or corporation, and
any agent of any of the aforesaid.
1.3 "Motor Vehicle" for the purpose of this
ordinance shall have the meaning ascribed
in Minnesota Statutes 1965, Section 168.011,
Subdivision 4.
1.4 Motor Vehicle "Parts" for the purpose of
this ordinance, shall include any part, ac-
cessory, attachment, or piece of equipment
commonly used on or in connection with a
motor vehicle.
Section 2. Parking and Storage. No person shall park,
keep, place, or store or permit the parking or storage
of a junk car on a public street or alley, or on any
private lands or premises which he owns, occupies, or
controls unless it shall be within a building on such
private premises.
Section 3. Repair, Service, or Maintaining. No person
shall service, repair, replace parts or do maintenance
work on a junk car on a public street nor on any private
lands or premises unless it shall be within a building
on such private premises.
Section 4. Provisions of Other Ordinances. Nothing
herein contained shall in any way be deemed to permit
the keeping, storing or parking of junk cars or the
servicing, repairing, replacing of parts on, or main-
tenance of junk cars in violation of the provisions
of the Village Zoning Ordinance, as amended, or of
any other ordinances of the Village of Mendota Heights.
Section 5. Severability. Every provision of this
ordinance shall be severable from every other part or
provision thereof, and if one provision is held invalid,
such invalidity shall not affect any other part or
provision thereof.
Section 6. Penalties. Any person, or persons, firm
association, partnership or corporation violating any
of the provisions of this ordinance shall be guilty of
a misdemeanor, and upon conviction thereof shall be
punished by a fine of not to exceed $100.00 or by im-
prisonment for not to exceed ninety (90) days for each
offense. Each successive ten (10) day period that the
violation is permitted to exist after the first day of
violation hereunder shall constitute a separate offense
hereunder.
Section 7. Effective Date. This ordinance shall be
in full force and effecT-Yrom and after its publication
according to law.
Enacted and ordained into an ordinance this day
of June, 1966.
