Ord 66 Regulating Offenses Against Public PlacesVillage of Mendota Heights Dakota County, Minnesota ORDINANCE NO. 66 AN ORDINANCE RELATING TO OFFENSES AGAINST PUBLIC PLACES, BY PROHIBITING INTERFERENCE WITH. PUBLIC GROUNDS, INCLUDING STREET AND UTILITY EASEMENTS, AND PROVIDING A PENALTY. The Village council of the Village of Mendota Heights, Minnesota, ordains as follows: Section 1. Encumbrance or Obstruction of Streets and Other Public Grounds. a) Except as provided in sub-section (b) hereof, no person shall obstruct, encroach upon, encumber or otherwise interfere with any public grounds, or streets, or ease- ments held by the Village for street or utility purposes, by putting thereon any curbing, paving, fences, buildings, markers, posts, rocks, stones, or other structures, or depositing thereon snow, debris, or any other matter. The prohibition herein stated shall apply as to any easement to the entire width or extent thereof, and not just to the portion which may from time to time be in public use for travel or other purposes. The Village may cause any encumbrances or obstructions which now exist or hereafter may exist in violation of the provisions hereof to be removed and the cost thereof to be specially assessed against the property owned by the person who caused such encumbrance or obstruction to be created. When so assessed, the cost shall be certified to the county auditor for collection, and shall be included in the next tax rolls to be prepared by the county auditor. The Village may also, notwithstanding such assessment of the cost of removing an encumbrance or obstruction, cause the person who caused or created it to be punished for a misdemeanor hereunder. (B) The following exceptions are hereby established to subsection a) : 1) Accumulations of snow and ice may be deposited upon those portions of such grounds, streets or easements not used for travel or for access by the public or the Village. 2) Vehicles may be parked in the manner and to the extent permitted by the applicable ordinances of the Village. 3) Driveways may be cut and surfaced, provided they do not exceed a width of 25 feet and their location does not violate any ordinance of the Village. Section 2. Penalties. Any person, or persons, firm association, partnership or corporation violating any of the provisions of this ordinance shall be guilty of a misdemeanor, and upon conviction thereof shall be punished by a fine of not to exceed $100.00 or by im- prisonment for not to exceed ninety (90) days for each offense. Section 3. Effective Date. This ordinance shall be in full force.and effect from and after its publication according to law. Enacted and ordained into an ordinance this 5— day of December, 1967.
