Ord 193 Operation of BicyclesCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA ORDINANCE NO. 193 AN ORDINANCE AMENDING ORDINANCE No. 1202 The City Council of the City of Mendota Heights, Minnesota, ordains a I s follows: Ordinance No. 1202 entitled "An Ordinance Providing for the Registration and Operation of Bicycles in the City of Mendota Heights and Providing Penalty for Violation Thereof" is hereby amended in its entirety so that as so amended said Ordinance No. 1202 shall read as follows: A. An Ordinance Providing for the Regulation of Operation of Bicycles in the City of Mendota Heights and Providing Penalty for Violation Thereof. SECTION 1. TRAFFIC LAWS APPLY TO PERSONS RIDING BICYCLES Every person riding a bicycle upon a street, alley or public highway situated in the City of Mendota Heights shall be granted all of the rights and shall be subject to all of the duties applicable to the driver of a vehicle under the laws of this State declaring rules of the road applicable to vehicles or by the traffic ordinances of Mendota Heights applicable to the driver of a vehicle, except as to special regulations in this section and except as to those provisions of laws and ordinances which by their nature can have no application. Riding on Bicycles 1.1(1) A person propelling a bicycle shall not ride other than astride a permanent and regular seat attached thereto. 1.1(2) No bicycle shall be used to carry more persons at one time than the number for which it is designed and equipped. 1.2 Riding on Roadways and Bicycle Paths 1.2(1) Every person operating a bicycle upon a street, alley, or roadway shall ride as near to the righthand side thereof as practicable, exercising due care when passing a standing vehicle or one proceeding in the same direction. 1.2(2) Persons riding bicycles upon a street, alley or roadway shall not ride more than two abreast except on paths or parts of streets, alleys, or roadways set aside for the exclusive use of bicycles. 1.2(3) Whenever a usable path for bicycles has been provided adjacent to a street, alley or roadway, bicycle riders shall use such paths and shall not use such street, alley or roadway. 1.2(4) No person shall ride a bicycle upon a sidewalk within a business district. 1.2(5) Whenever a person is riding a bicycle upon a sidewalk, such person shall yield the right of way to any pedestrian and shall give audible signal before overtaking and passing such pedestrian. 1.3 Speed 1.3(1) No person shall operate a bicycle at a speed greater than is reasonable and prudent under the conditions then existing. 1.4 Emerging from Alley or Driveway 1.4(1) The operator of a bicycle entering a street, alley, or roadway shall yield the right of way to all vehicles approaching on said street, alley or roadway. 1.5 Clinging to vehicles 1.5(1) No person riding upon any bicycle shall attach the same or himself to any other vehicle upon a street, alley or roadway. 1.6 Carrying Articles 1.6(1) No person operating a bicycle shall carry any package, bundle or article which prevents the driver from keeping at least one hand upon the handle bars. 1.7 Parking 1.7(1) No person shall park a bicycle upon a street other than against the curb, or upon a sidewalk in any manner that might obstruct pedestrian traffic. SECTION 2. REQUIRED EQUIPMENT 2.1 Every bicycle when in use at nighttime shall be equipped with a lamp on the front which shall emit a white light visible from a distance of at least 500 feet to the front and with a red reflector on the rear of a type which shall be visible from all distances from 50 feet to 300 feet to the rear when directly in front of lawful upper beams of head lamps on a motor vehicle. A lamp emitting a red light visible from a distance of 500 feet to the rear may be used in addition to the red reflector. Every bicycle shall be equipped with a brake which will enable the operator to make the braked wheel skid on dry, level, clean payment. SECTION 3. It shall be unlawful for any parent or guardian to authorize or knowingly permit any minor child or ward to violate any provisions of this Ordinance. SECTION 4. Every adult person, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon a conviction, shall be punishable by a fine of not more than Five Hundred Dollars ($500-00) or by imprisonment in the County Jail for a period of not more than ninety (90) days. B. This ordinance shall be in full force and effect from and after its publication according to law. Enacted and ordained into an ordinance this Third day of November, 1981.
