Ord 235 Rezoning from B-1A to ICITY OF MENDOTA HEIGHTS

AN ORDINANCE AMENDING ORDINANCE NO. 401
The City Council of the City of Mendota Heights, Minnesota ordains as follows:
Section I Ordinance tb,� 401 known and referred to as the "Mendota Heights
Zoning Ordinance" is hereby amended in the following respects:
A. The following described property situated in the City of Mendota Heights
in Dakota County, Minnesota, is hereby rezoned from an "B-IA" Business Park,
as the case may be to an "I" Industrial, to-wit:
Tract A. That part of the Southeast Quarter of the Southeast Quarter of Section
34, Township 28 North, Range 23 West, Dakota County, Minnesota, de-
scribed as follows: Commencing at the northeast corner of said South-
east Quarter of the Southeast Quarter, which is shown as Right of Way
Boundary Corner B752 on Minnesota Department of Transportation Right of
Way Plat Numbered 19-42 as said plat is on file and of record in the
office of the County Recorder in and for said County; thence run south
on the east line of said Section 34 on an azimuth of 179 degrees 27
minutes 28 seconds (azimuth oriented to Minnesota State Plane Coor-
dinate System South Zone) for 107.14 feet; thence on an azimuth of 222
degrees 28 minutes 59 seconds, 48.37 feet to Right of Way Boundary
Corner B3 as shown on said Plat No. 19-42; thence on an azimuth of 222
degrees 28 minutes 59 seconds along the boundary of said plat, 384.09,
feet to Right of Way Boundary Corner BI as shown on said plat; thence
on an azimuth of 267 degrees 12 minutes 29 seconds along the northerly
right of way line of Trunk Highway 494 for 104.57 feet; thence on an
azimuth of 252 degrees 16 minutes 36 seconds along the northerly right
of way line of Trunk Highway No. 494 for 155.24 feet to the point of
beginning of Tract A to be described; thence on an azimuth 267 degrees
12 minutes 29 seconds along the northerly right of way line of Trunk
Highway No. 494 for 487.76 feet; thence on an azimuth of 178 degrees 42
minutes 23 seconds, 110.35 feet; thence on an azimuth of 238 degrees 42
minutes 23 seconds, 117 feet; thence on an azimuth of 148 degrees 37
minutes 03 seconds, 439.70 feet; thence run northeasterly for 423.35
feet along a non-tangential curve concave to the northwest, having a
delta angle of 25 degrees 24 minutes 04 seconds, a radius of 954.93
feet and a chord azimuth of 52 degrees 11 minutes 58 seconds; thence on
an azimuth of 21 degrees 01 minute 04 seconds, 258.37 feet; thence on
an azimuth of 316 degrees 11 minutes 56 seconds, 99.33 feet to the
point of beginning;
containing 5.37 acres, more or less;
B. The following described property situated in the City of Mendota
heights in Dakota County, Minnesota, is hereby rezoned from an "I"
Industrial, as the case may be to an "B -3" General Business, to -wit:
The southwesterly 200 feet, more or less, of the
following described parcel: That part of the
Northwest Quarter of the Southeast Quarter of
Section 34, Township 28, Range 23, lying East of
the Chicago, Milwaukee, St. Paul & Pacific Railway
and southerly of the Mendota Heights Road and its
extension westerly to said highway, subject to
S.T.H. No. 55, more specifically described as:
Begining at the southeast corner of said Northwest
Quarter of the Southeast Quarter; thence west along
the south line of said Northwest Quarter of the
Southeast Quarter a distance of 216.90 feet to the
Easterly right of way of thesnew S.T.H. No. 55;
thence northwesterly along said right of way line
133.9 feet; thence northwesterly along the right of
way line of'the same highway which forms a sight
corner to said highway from the Mendota Heights
Road a distance of 124.1 feet to its intersection
with the southerly line of said Mendota Heights
Road; thence easterly along the southerly line of
said Mendota Heights Road 262.56 feet to the east
line of said Northwest Quarter of the Southeast
Quarter; thence southerly along said east line
270.9 feet to the point of beginning. Together
with all the rights and privileges in said highways
adjacent thereto except that access to said S.T.H.
No.55 is limited to the said Mendota Heights Road,
according to the Government Survey thereof.
And
That part of the South Half of the Southeast
Quarter of Section 34, Township 28, Range 23, lying
easterly of the easterly right of way line of State
Trunk Highway No. 55 and northerly and westerly of
the following described line: Commencing at the
northeast corner of said South Half of the
Southeast Quarter; thence South 89 degrees 22
minutes 26 seconds West (assumed bearing) along the
north line thereof a distance of 991.87 feet to the
point of beginning of line to be described; thence
South 43 degrees 48 minutes 04 seconds East a
distance of 38.29 feet to the northwesterly corner
of M.D.O.T. property; thence continuing South 43
degrees 48 minutes 04 seconds East along the
M.D.O.T. property line a distance of 609.59 feet;
thence South 87 degrees 12 minutes 30 seconds West
along said-M.D.O.T. property line a distance of
500.39 feet to the beginning of a tangential curve
to the left, thence southerly along said curve
which is concave to the south, radius of 629.45
feet, central angle of 15 degrees 44 minutes 23
seconds, a distance of 172.92 feet to the easterly
right of way line of said State Highway No. 55 and
there terminating.
Section 2. The Zoning Map of the City of Mendota Heights referred to and
described in said Ordinance No. 401 as that certain map entitled "Zoning Map of
Mendota Heights" shall not be published to show the aforesaid rezoning, but the
City Clerk shall appropriately mark the said Zoning Map on file in the Clerk's
office for the purpose of indicating the rezoning hereinabove provided for in
this Ordinance, and all of the notations, references and other information shown
thereon are hereby incorporated by reference and made a part of this Ordinance.
Section 3. This Ordinance shall be in full force and effect from and
after its publication according to law.
