Ord 318 Recreational Fire PermitsCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA ORDINANCE NO. 318 The City Council of the City of Mendota Heights does hereby ordain as follows: SECTION 1 Section 4 of Ordinance No. 270 known and referred to as "AN ORDINANCE ADOPTING THE 1988 MINNESOTA UNIFORM FIRE CODE AND THE NATIONAL FIRE CODE BY REFERENCE" is hereby amended to read: SECTION 4. RECREATIONAL FIRE PERMITS A property owner or lessee of the property may now have a recreational fire without obtaining a permit from the City of Mendota Heights by complying with the following regulations: 4.1 Fires shall be extinguished within three hours after start, but not later than 11:00 P.M. Clean and dry wood only (no refuse, grass, leaves, logs over 3" in diameter, paper, garbage, or other combustibles). Size shall not be more than three (3) feet in diameter, nor shall the flames reach a height in excess of three (3) feet. No fire shall be within twenty (20) feet of any building or structure. A means of extinguishment must be in the immediate area of the fire. No fire shall be started or maintained in dry conditions or winds over 15 MPH. Prior notice shall be given to the dispatcher one hour before the fire is ignited. Recreational fires must be constantly attended by a competent person until the fire has been completely extinguished. The Fire Chief or his representative have the authority to prohibit suspend, or further restrict all fires should atmospheric, drought, wind, state, focal circumstance or conditions warrant or dictate such action. SECTION 2 This Ordinance shall be in full force and effect from after publication according to law. Enacted and ordained into an Ordinance this 20th day of January, 1998.
