Ord 324 Dissemination of Criminal History DataORDINANCE NO. 324
AN ORDINANCE ALLOWING FOR THE DISSEMINATION OF CERTAIN
MINNESOTA CRIMINAL HISTORY DATA ON PROSPECTIVE CITY EMPLOYEES
AND CHILDREN'S SERVICE PROVIDER EMPLOYEES AND VOLUNTEERS.
SECTION 1. FINALISTS FOR CITY EMPLOYMENT
1.1 . Upon request of the City Administrator or his designee, the Mendota Heights
Police Department shall provide certain criminal history data contained in the
Minnesota Criminal Justice Information System to the City Administrator or his
designee. The data to be provided must only be about finalists for City
positions of employment. The City Administrator or designee must obtain the
written consent of the finalists before requesting the data. An applicant's
failure to provide consent may disqualify the applicant from the perspective
position.
SECTION 2. CHILDREN'S SERVICE PROVIDERS
2.1 Pursuant to an authorized consent form as determined by the City of Mendota
Heights, the City Administrator or designee may obtain criminal history data on
a person who has, may have, or seeks to have access to a child under
Minnesota Statutes 299C.61 and who is employed by, volunteers with, or
seeks to be employed or volunteer with the City or with a Children's Service
Provider utilizing City parks, buildings, or facilities. The City Administrator or
designee may disseminate such criminal history data to the Children's Service
Provider with which the person is employed or volunteers or seeks to be
employed or volunteer. The Children's Service Provider may be responsible
to the City for reimbursment of any costs incurred by the City in obtaining this
data.
SECTION 3. This Ordinance shall be in full force and effect from and after its
adoption and publication according to law.
