Res 2012- 43 CAP 1008 James CourtCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 2012 -43 A RESOLUTION APPROVING A CRITICAL AREA PERMIT TO CONSTRUCT AN ACCESSORY STRUCTURE AT 1008 JAMES COURT. WHEREAS, Tim and Angela Gallant have applied for a critical area permit to construct an accessory structure at 1008 James Court (PID 27- 76402 - 030 -170, Lot 17, Block 3 Tilsens Highland Heights Plat 3) as proposed in planning case 2012 -17; and WHEREAS, the Mendota Heights City Code Title 12, Chapter 3 allows minor developments for single- family dwellings to be forwarded to city council without planning commission review; and WHEREAS, the city staff recognizes the planning application to be a minor development and /or change to a single family dwelling; and WHEREAS, staff recommends approval of the critical area permit as outlined in the planning application. NOW THEREFORE BE IT RESOLVED, by the Mendota Heights City Council that a critical area permit as proposed in planning case 2012 -17 is hereby approved with the following findings of fact: 1. The proposed accessory structure creates no new no visual impact on the river. 2. The project includes no changes site grading and erosion control. 3. The property is not in proximity to any bluff line. Adopted by the City Council of the City of Mendota Heights this fifth day of June 2012.
