Pursuant to due call and notice thereof, the regular meeting of the City Council, City of Mendota
Heights, Minnesota was held at 7:00 p.m. at City Hall, 1101 Victoria Curve, Mendota Heights,
Minnesota.
CALL TO ORDER
Mayor Krebsbach called the meeting to order at 7:00 p.m. The following members were present:

L) APPROVE RESOLUTION 2013 -65 PROVIDING FOR THE SALE OF
GENERAL OBLIGATION BONDS FOR 2013 STREET PROJECTS
Councilmember Norton noted that Ehlers & Associates were contacted to assist with the issuance of
these bonds. He asked if this should be reviewed since the City Attorney's firm also offers bond
services.
City Administrator Justin Miller replied that the current bond counsel is Briggs and Morgan and he
believes that the bond attorney is listed in the City's schedule of RFP's to be reviewed.
Councilmember Duggan forwarded a question on to staff that was raised by a resident in regards to what
happens if more than one -half of residents defer their street reconstruction payment. Staff will answer
this at a future meeting.
Councilmember Duggan moved to adopt Resolution 2013 -65 "RESOLUTION PROVIDING FOR THE
SALE OF $1,745,000 G.O. IMPROVEMENT BONDS, SERIES 2013A"

PRESENTATONS
A) VICKI STUTE PRESIDENT, DAKOTA REGIONAL CHAMBER OF COMMERCE
Ms. Vicki Stute, President of the Dakota Regional Chamber of Commerce introduced herself and gave a
brief background on her experiences. She expressed her appreciation to the City of Mendota Heights for
their commitment, leadership, and investment in and to the community.
Councilmembers asked questions and made comments in regards to the Dakota County Fair; time and
place of the joint meeting of Mendota Heights and West St. Paul Business Council; putting to rest some
urban legends in regards to the City of Mendota Heights not being in favor of cell towers and not
business friendly, and involvement with the Greater MSP Economic Development Agency.

UNFINISHED AND NEW BUSINESS
A) RESOLUTIONS 2013 -66, 2013 -67, 2013 -68, ADOPTION OF
PRELIMINARY 2014 TAX LEVY AND BUDGET
Finance Director Kristen Schabacker explained the resolutions for approval of the 2014 Preliminary
Budget and Levy; and the resolution for the special taxing district, which is for maintaining the street
lights in the industrial park. In August, Council held a budget workshop to go over the 2014 preliminary
budget and at that time there were no capital purchases included. In working to keep the levy increase
below 3.00 %, the following capital purchases have been included in the preliminary budget:
• Network Switch — IT — $14,000
• LOGIS Public Safety Assessment — Police — $17,170 (remaining $25,600 is proposed to be taken
from refunds received from the previous LOGIS assessment)
• DTF Car — Police — $6,000
• 3/4 Ton Pickup — Parks — $37,500
• Wentworth Park Hockey Boards — Parks — $17,000
Schabacker then listed the capital purchases that were not included in the preliminary budget:
• Explorer vehicle ($29,000) for the police department
• Fire marshal van ($29,000)
• One -ton pickup truck ($60,000) for the street department
The budget includes a 1.00% wage increase and no increase for the City contribution for health
insurance. The general fund budget is proposed at a 1.93% increase over last year and the preliminary
levy for 2014 is approximately $187,000 greater than 2013; a 2.92% increase.
On average, the residential taxable market value rose approximately 3.80% for 2014. A home that is
valued at $290,000 in 2013 will appreciate to approximately $301,000 in 2014; and that property would
see an approximate increase of $40.00 in the City's portion of their property taxes.
Councilmember Duggan moved to adopt RESOLUTION 2013- 66 RESOLUTION APPROVING
PROPOSED 2013 LEVY COLLECTIBLE IN 2014; adopt RESOLUTION 2013- 67 RESOLUTION
APPROVING FINAL 2013 TAX LEVY FOR SPECIAL TAXING DISTRICT NO. 1 COLLECTIBLE
IN 2014; and adopt RESOLUTION 2013- 68 RESOLUTION ADOPTING 2014 PROPOSED
BUDGET.

B) RESOLUTION 2013- 58, REQUEST TO DISSOLVE EXISTING JOINT POWERS AGREEMENT
WITH GUN CLUB LAKE WATERSHED MANAGEMENT ORGANIZATION
City Engineer John Mazzitello explained that the City of Mendota Heights is currently a member of two
watershed management organizations (WMO); Gun Club Lake WMO and Lower Mississippi River
WMO, at a 25/75 ratio respectfully. A WMO is an oversight body established by the state that is
responsible for insuring compliance of member cities with stormwater management regulations, as well
as helping to regulate inter jurisdictional drainage flows from one city into another. The oversight board
that handles regulations of WMOs is the Board of Soil & Water Resources (BWSR).

The Gun Club Lake WMO is currently revising their watershed management plan, which has brought up
the idea of potentially reorganizing the member cities between Gun Club Lake and Lower Mississippi
River WMOs. Staff is proposing that the portion of the city currently included in the Gun Club Lake
WMO be moved to the Lower Mississippi River WMO. This would create one watershed management
organization for the city, one set of rules, and one plan for the city to follow. It would also provide
efficiency for city staff.
City staff has spoken with staff from Inver Grove Heights and from Eagan, as well as both WMO
boards, and to the board of BW SR — all of which support this reorganization.
Mayor Krebsbach asked for confirmation that the City of Mendota Heights is really in the Lower
Mississippi River WMO. Mazzitello replied that all of the water flows to the west into the Gun Club
Lake and the Mississippi River. The Gun Club Lake itself is located in the Lower Mississippi River
WMO and is not located in the Gun Club Lake WMO.
Councilmember Petschel moved to approve RESOLUTION 2013 -58, A RESOLUTION REQUESTING
A JOINT POWERS AGREEMENT FOR THE GUN CLUB LAKE WATERSHED MANAGEMENT
ORGANIZATION BE DISSOLVED.
Councilmember Duggan seconded the motion.
A short discussion followed in regards to the representatives from the City of Mendota Heights to the
WMOs.

C) RESOLUTIONS 2013-60,2013-61,2013-62, PLANNING CASE 2013 -13, BUILDING AND
PARKING SETBACK VARIANCES, SCANNELL PROPERTIES 162, LLC, SOUTHWEST
CORNER OF COMMERCE DRIVE AND LEMAY AVENUE
Planner Nolan Wall stated that Scannell Properties 162, LLC has submitted an application for variances
to building and parking setbacks at the unaddressed property located at the southwest corner of
Commerce Drive and Lemay Avenue in the Mendota Heights Business Park. The property is zoned I-
Industrial and is currently vacant.
Planner Wall shared the proposed site plan. The applicant proposed construction of a 71,933 square foot
office warehouse building, to include three separate office spaces (14,400 square feet) located on the
south and west sides of the building. The remaining portion of the building would be warehouse space
(57,600 square feet). The docks would be located on the eastern boundary of the site and they are
proposed to include 104 parking stalls.
Planner Wall then explained the three variance requests and the recommendations by the Planning
Commission. Additional information and the Findings of Facts for approval and denial in all three cases
were provided to the Councilmembers.
Mr. Tim Elam of Scannell Properties was in attendance to address questions and concerns.

Council members asked questions pertaining to the reasons for the building and parking variance
requests, the number of bays on the loading dock side of the building, location of the other buildings
owned and built by Scannell Properties, signage, the number of dock spaces, circulation paths for the
trucks, the reasons for the Planning Commission's denial of the building setback variance, solutions to
possible drainage issues, and the retaining wall proposed.
Councilmember Norton moved to adopt RESOLUTION 2013 -60 DENYING A BUILDING SETBACK
VARIANCE AT THE UNADDRESSED PROPERTY LOCATED AT THE SOUTHWEST
QUADRANT OF COMMERCE DRIVE AND LEMAY AVENUE IN THE MENDOTA HEIGHTS
BUSINESS PARK; to adopt RESOLUTION 2013 -61 APPROVING A PARKING SETBACK
VARIANCE OF TEN FEET ALONG COMMERCE DRIVE AND THE WESTERN BOUNDARY OF

Administrator Justin Miller gave an update on the service arrangements.

COUNCIL, COMMENTS
Councilmember Petschel recognized and thanked Recreation Program Coordinator Sloan Wallgren for
putting on an incredible golf event for City staff and commissioners. She encouraged him to host a
tennis event for people who are golf challenged.
Councilmember Petschel also noted that the city's Gun Club Lake WMO representative, Mr. Molinaro,
welcomed identical twin girls last week.
Councilmember Duggan noted the passing of the father of Dan Tilsen, former Planning Commissioner;
the passing of a former poet laureate in Ireland by the reading of a poem; Leroy Buster Brown will be
100 this week; Lily Daze is this weekend; Holy Family Church, 1960 Lexington Avenue is having their
celebration and fall festival this weekend; and the music in the Village two weeks ago was a wonderful
success.
Councilmember Norton and Mayor Krebsbach welcomed Planner Nolan Wall.
Mayor Krebsbach wished the best to Mike Albers and to the children starting the school year, and noted
that Rosh Hashanah (Jewish New Year) is on Thursday this week.

PARKS AND RECREATION MEETING
September 10, 2013
The September meeting of the Mendota Heights Parks and Recreation Commission was held on Tuesday,
September 10, 2013 at Mendota Heights City Hall, 1101 Victoria Curve.
Co -Vice Chair Miller called to order the parks and recreation commission meeting at 6:30 p.m. The
following commissioners were present: Co -Vice Chair Miller, Commissioners Mary McGrory- Ussett, Ira
Kipp, Joel Paper, Pat Hinderscheid and Michael Toth. Staff present: Recreation Program Coordinator
Sloan Wallgren.
Approval of Agenda
Commissioner Paper requested that Park Signs and MHAA Soccer be added to the agenda.
Commissioner Toth requested that Off -Leash Dog Ares be added to the agenda.
Approval of Minutes of August 13, 2013
Commissioner McGrory -Ussett made a motion to approve minutes of the August 13, 2013 meeting;
Commissioner Hinderscheid seconded the motion.

Ivy Hills Park Tennis Courts
Recreation Program Coordinator Sloan Wallgren informed the commission that at their June meeting they
talked about holding an open house in October to discuss the future of the tennis courts at Ivy Hills Park.
Mr. Wallgren asked that the commission hold an open house at 5:45P.M. on October 8, 2013. Letters will
be sent to neighbors around the Ivy Hills Park, and flyers will be placed at tennis courts at other parks in
the city. The open house will also be posted in the next issue of Heights Highlights. Commissioner
Miller asked if the open house time and date could be placed in the city website.
Mendakota Playground
Mr. Wallgren updated the commission on the progress of the Mendakota Playground refurbishing. The
project is in progress and should be finished by October 1, 2013. The entire project is $83,000, which
will leave a balance of $135,000 in the Special Parks Fund.
Recreation Programming Report
Mr. Wallgren informed the commission that in the month of August the city sponsored one field trip and
Safety Camp. Currently city staff is reviewing summer programs and planning fall and winter field trips.
Staff is also in the process of hiring winter recreation staff for the ice rinks and warming houses. Revenue
and expenses from summer programs will be provided at the October meeting.

Par 3 Report
Mr. Wallgren informed the commission that the Par 3 has finished all of the Golf Camps and Golf
Leagues. The Par 3 saw an increase in the number of registrations for Golf Camps and Golf Leagues.
Mr. Wallgren also stated that we had success with our Groupon and Daily Deal promotional offers.
Mr. Wallgren informed the commission that insurance would cover about 90% of the cost that was
associated with pressure tank explosion in July. He also stated that the course is in great condition and
that we have several events taking place in September.
The course has taken in $124,659 in revenues; expenditures year to date are $95,083. The net result in
revenue over expenditures is $29,576 year to date.
Historical Signs
Commission Paper told the commission that he has contacted the school about doing research on the
history of the parks in Mendota Heights. The school wanted more direction, but would be willing to help.
The commission asked that the research be limited to few paragraphs (roughly 250 words) for each park.
Mr. Wallgren will research the cost of signs, and commissioner Paper will continue to be in contact with
the schools.
MHAA Soccer
Commissioner Paper informed the commission that MHAA has seen then number of participants in the
soccer program double over the last couple of years. He told us that a maj ority of the participants were
from Mendota Heights. He also thanked Mr. and Mrs. Macke for the great job running the MHAA soccer
program.
Off -Leash Dog Area
Commissioner Miller inquired about the status of the Off -Leash Dog Area. Mr. Wallgren told the
commission that it would be on the City Council agenda in late October or early November. Mr. Wallgren
made it clear that resident's feedback would be sought before any decisions were made.
Commission Comments
Commissioner Hinderscheid commented that the meeting was productive and thanked Commissioner
Paper for the work he had done on the historical signs. Commissioner Paper thanked staff for doing a
great job at the Par 3 this year. Commissioner McGrory -Ussett liked the historical sign idea and looked
forward to the city working the schools to complete the project. Commissioner Kipp thought we had a
good meeting and would like to see pictures included on the historical signs.

AIRPORT RELATIONS COMMISSION MINUTES
September 11, 2013
The regular meeting of the Mendota Heights Airport Relations Commission was held on Wednesday.
September 11, 2013 at 7:00 p.m. at 1101 Victoria Curve, Mendota Heights, Minnesota.
The following commissioners were present: David Sloan, Jim Neuharth, Sally Lorberbaum, William Dunn,
Gina Norling, Kevin Byrnes and Paul Portz

Lorberbaum made a motion, seconded by Dunn, to approve the August 14th minutes as submitted - all voted in
favor.
Guest Speaker John Nelson
After commissioners introduced themselves, Mr. John Nelson began his presentation. Nelson is the new
Manager of Noise, Environment and Planning at the Metropolitan Airports Commission. He went over his
background, which included working at various cities and in other capacities at the MAC.
Nelson presented information on runway use trends, complaints received and the reports that evaluate them,
FlightTracker, and the status of Area Navigation (RNAV) at MSP International Airport. The commission
shared with Nelson some of the reports that the commission produces, with special emphasis on the recent trend
of excessive noise events (over 80dB) at nearby remote monitoring towers. Nelson appreciated the information
and indicated that he would look into the causes. He also said that he appreciates the work of the ARC and is
always willing to work together to solve problems.
Acknowledge Receipt of Various Reports /Correspondence
The monthly reports for July 2013 were acknowledged and commissioners updated their respective areas of
focus. Sloan noted that he would like to discuss at the next meeting the possibility of holding a televised
meeting of the commission. The discussion next month would be to identify a good topic for the televised
meeting,

SUBJECT: Monthly Fire Synopsis — August 2013
Fires Cnllc
The department responded to 20 calls for the month. The majority of calls were classified as
false alarms or good intent calls. Nine of these calls were residential in nature, and two were
commercial alarms. There were two EMS calls, two utility checks (gas leaks or power lines), one
elevator rescue call, and two car fires. The department also responded to a dryer fire in an
apartment building and assisted with the recovery of a body in the Mississippi River.
Monthly and Squad and Department Training
The monthly department and squad trainings were held at the vacant home. All of the trainings
incorporated basic fire ground skills such as interior fire attack, ventilation, and search and
rescue. The home continues to provide excellent hands on opportunities for the firefighters.
Additional trainings at the vacant house are scheduled through the month of September.

BACKGROUND
In August of 2006 the City Council adopted an alcohol "Best Practices" program creating a
uniform set of standards for alcohol licensee's in the city to create for themselves a path to
preferential treatment in the event they would fail a compliance check or be cited for a liquor law
violation.
The program has been met with mixed results. The number of licensees who choose to
participate continues to drop but the number of violations since 2006 has also dropped. Some of
the business have chosen to use some of the services offered.
City Clerk Smith along with Officer Shepard will be going out to meet individually with license
holders in the near future to ensure that all are aware of the program and how it works.

DISCUSSION:
In May of 2006, the Police Department completed alcohol compliance checks.
Three licensees's failed this round of compliance checks. These license holders were
notified in writing that they would be notified of the civil penalties that would be coming
from the violations. These violations highlighted the need for the City to have a uniform
procedure for dealing with licensee's who do not follow the Minnesota State Statutes
(MSS) and Mendota Heights City Ordinances.
Research was done including the gathering of policies and ordinances from other
cities, the League of Minnesota Cities LMC research attorney, Tami Diehm City
Attorney, Hospitality Minnesota, Minnesota State Statutes and the City Code. After
reviewing the information gathered a determination was made to recommend that the
City Council adopt policy governing liquor license violations. There were examples
provided by the LMC for having a policy and for placing the penalty matrix in ordinance.
It was determined that the Mendota Heights City ordinance was structured in such a
way that a policy could be used without requiring ordinance changes. A policy would
allow for some flexibility in dispute resolution and streamline the process for Council.
The policy and penalties are attached.
RECOMMENDATION:
recommend that the City Council pass a resolution adopting the proposed liquor
violations policy and notify the licensees who fail the May of 2006 Compliance Checks.
ACTION REQUIRED:
If the Council desires to approve the recommendation approve a resolution "Adopting a
City Policy covering Liquor License Violation Penalties."

Policy for Liquor License Violations
"BEST PRACTICES" PROGRAM
PURPOSE OF "BEST PRACTICES"
In 2006, the cities of Mendota Heights, Mendota and Lilydale adopted uniform policies governing
sanctions on alcohol license holders. (Reference city Policy for Liquor License Violations, Adopted by City
Resolution, MSS 340A.415, and 14.57 - 14.69) The goal of adopting the policy was to promote 100%
compliance with MN state laws and city ordinances on behalf of businesses and license holders within
our jurisdiction. The policy also established a standard for the city to determine the length of a license
suspension, revocation and /or civil penalty.
BENEFITS:
BEST PRACTICES is an optional partnership program serving as a cooperative and uniform venture
between licensees and the city toward a mutual goal of 100% compliance. The benefits of being a
member are opportunities for annual training and reduced penalties, developing a relationship with the
City /Police Department /Prosecutor and most importantly, being knowledgeable about how the system
works before any violations occur. The benefits for the Cities include fewer problems, uniform
enforcement and a guideline to ensure each licensee knows the City takes the issuance of a license
seriously.
VIOLATIONS
The State of Minnesota, per MSS 340A.415, establishes the maximum penalty the city and /or state can
administer to licensee when there is a violation of laws or ordinances pertaining to the sale of alcoholic
beverages. A BEST PRACTICES member's violation maximums are set by the following matrix which

Violation Details:
• This Policy only applies to License Sanctions for violations and will only impact license activity; it
does not apply to the criminal charges against the person who actually violates the law.
• BEST PRACTICES PROGRAM only applies to license holders who are enrolled in the program at the time
of the violations; however, participation can start at any time and is completely voluntary.
• Violations are tracked from the date of violation for a 2 year rolling time period.
• The cities are not restricted from imposing the maximum penalty for violations.
PROGRAM REQUIREMENTS:
To participate in BEST PRACTICES the business must agree to the following required practices and to at
least four of the listed optional practices:
Required Activities:
• Maintain records of BEST PRACTICES activities and to have them available for inspection,
• Ensure 75% of all alcohol - selling staff trained by the Mendota Heights Police Department, Dakota
County Safe Communities Coalition, the Minnesota Department of Alcohol and Gambling
Enforcement or Minnesota Hospitality on an annual basis,
• Provide documented /written internal training program for new employees, and
• Provide written policy requiring identification on anyone appearing to be 40 years old or younger.
Optional Activities: (Licensees will do select at least 4; will select 3 if using integrated ID scanner on the
cash register) of the following:
• Continuously ensure and document that 75% of all employees who sell alcohol are trained,
• Provide internal employee reward /recognition program for employees who catch underage
customers,
• Possess an approved, internal compliance check system (business can run their own checks to
ensure that policy is being followed),
• Possess an automated identification card scanner integrated into cash register,
• Once per year, meet with city staff and prosecuting attorney to discuss both civil and criminal
penalties that would apply in the event of a violation,
• Have written policy to require ID on all alcohol purchases,
• Have written policy showing plan to work with police to prevent secondary resale of alcohol,
• Have minimum age of 21 for selling alcohol products.
PROGRAM PARTICIPATION:
To participate in BEST PRACTICES, the liquor licensee will complete the following on an annual basis:
• Provide documentation to the Compliance Officer of fulfilled requirements involving training and
policy
• Complete any and all related and signed paperwork, and
• Maintain all records on -site for viewing upon request or demand.
To verify the business's participation in BEST PRACTICES, the Compliance Officer will do the following on an
annual basis:
• Review and sign off on the completed and documented requirements provided by the licensee.

Statement of Purpose:
It is the goal of the City of Mendota Heights to have liquor licensees comply with the law
100% of the time in relation to the ordinance regulating liquor. The City of Mendota
Heights will maintain staff to complete annual compliance checks, periodically check
establishments for compliance with hours and license conditions. The City will act as a
resource to provide server training or to direct businesses to approved training on an
annual basis. The City wishes to have all businesses chose to be a best practices
liquor licensee.

Best Practices:

Best Practices Licensees will fill out an application at Mendota Heights City Hall
committing their establishment to working towards 100% compliance with the applicable
ordinances and MSS.

Best Practices Licensee will agree to keep records of Best Practices activities
and to have them available for inspection. The Best Practices Licensee will have
75% of all alcohol selling staff trained by the Mendota Heights Police
Department, Dakota County Safe Communities Coalition, the Minnesota
Department of Alcohol and Gambling Enforcement or Minnesota Hospitality on
an annual basis. Best Practices Licensees will have a written internal training
program for new employees and a written policy requiring identification on
anyone appearing to be 40 years old or younger.
Optional Activities:
Best Practice Licensees will do 4 (3 if they do integrated ID scanner on register)
of the following; continuously certify 75% of all employees who sell alcohol are
trained, internal employee reward /recognition program for employees who catch
underage customers, an approved internal compliance check system, automated
identification card scanner integrated into cash register, pre- arrange to meet with
staff and prosecuting attorney on violations, have a policy to require ID on all
alcohol purchases, have policy prearranged to work with Police to prevent
secondary resale of alcohol and have minimum age of 21 for selling alcohol
products.

Uniform Penalties:
The purpose of this section is to establish a standard by which the City
determines the length of a license suspension, revocation and or civil penalty. This
policy shall apply to all on and off sale license holders. These penalties are deemed to
be appropriate for all violations. The City Council may choose to deviate from the
prescribed penalty if there are extenuating circumstances. Should the Council deviate
from the adopted policy they must take official action and document the reasons for the
deviation.
The Council may only consider the penalty portion of the action. Should the
licensee wish to appeal the facts of a violation they must request a due process hearing.
Licensee informed:
• All licensees shall be informed of the adoption of this policy at the time of
adoption and again at time of license renewal.
• Licensees shall have all fines paid or have requested a hearing before 30
days have elapsed from the violation.
• Licensees shall be informed that this policy applies only to the LICENSE
SANCTIONS it does not apply to the CRIMINAL CHARGES against the
person who actually violates the law.
• Licensees may join the best practices group at any time. Best Practices
group participation is completely voluntary.
• The policy and application shall be posted on the Cities web site and shall
be given to the licensee at the time of application.
• Hearing will be conducted in accordance with MSS and Minnesota Rules.

SUBJECT: Purchase of Ballistic Shields
BACKGROUND
The City of Mendota Heights currently has two ballistic shields that are carried in two of the six
marked police cars. The goal is to have a ballistic shield in every marked police squad as part of
the necessary equipment required to equip officers to safely handle active shooters, suicidal
person(s) and any other potential weapons call our officers may encounter during the course of
duty.
Historically patrol vehicles were not equipped with ballistic shields. This equipment would be
brought to the scene by our MAAG (SWAT) team. With the increase in school shootings and
active shooter incidents around the country it is realized that patrol officers need to react to these
deadly situations immediately in order to stop the threat and preserve human life. With this
change in police response it is necessary to make sure every on duty officer has access to a
ballistic shield. With the current compliment of two shields it is not uncommon for the squads
carrying the shields to be tied up at jail or on another call that they cannot clear leaving other on
duty officers without the necessary safety equipment they may immediately need in a potential
deadly situation. The Police Department budgeted for the purchase of four additional ballistic
shields not to exceed $6820 in the 2013 budget. Officer Bobby Lambert who has extensive
MAAG team experience was consulted on the best product for use in our patrol vehicles and he
recommended the Strategos HMLP Ballistic Shield. Strategos sells only direct and does not
utilize a dealer network. A bid from Strategos was obtained and totaled $6784.76 for four
shields, four protective cases and shipping. A second bid was obtained for a similar product from
a local vendor, Streichers Police Supply. The total cost before tax for four comparable shields,
four protective cases and shipping and handling from Streicher's totaled $7114.99.
RECOMMENDATIONS:
I recommend that the City Council authorize the purchase of four Strategos HMLP Ballistic
Shields, four protective cases and shipping totaling $6784.76 directly from Strategos
International L.L.0 which is the low bid.
ACTION REQUIRED:
If the Council so desires, authorize staff to sign a purchase order for four Strategos Ballistic
Shields along with the ballistic covers from Strategos International LLC and shipping for
$6784.76 which is under the 2013 budgeted amount of $6820.

Item 1: Adopt Resolution 2013 — 69 Appointing A HIPAA Privacy Official
The city of Mendota Heights is a covered entity under the Health Insurance Portability and
Accountability Act of 1996 ( HIPAA). As part of its employee benefits package, the city offers a
Medical, Dental, Health Reimbursement Account, and an Employee Assistance Program. As a
covered entity under HIPAA, the city is required to have policies and procedures in place as well
as appoint a privacy official. The privacy official is responsible for the following:
• Developing, implementing, updating and coordinating policies and procedures for
protected health information under HIPAA's privacy rules.
• Monitoring and deciding any issues that occur under the rules.
• Receiving complaints about any failure to comply with either the policies and procedures
or the privacy rules in general.
In 2004 the City Council adopted HIPAA policies and procedures as well as appointed the
Human Resources /Communications Coordinator position as the HIPAA Privacy Officer. There
have been several staff and title changes since the City Council designated the HIPAA Privacy
Officer in 2004. Attached is Resolution 2013 -69 appointing the Assistant to the City
Administrator/Human Resources Coordinator as the HIPAA Privacy Officer.
Staff is recommending the City Council adopt Resolution 2013 — 69 appoint the Assistant to the

Item 2: Approval to begin the re -hire and recruitment process for winter 2013 -2014
Parks & Recreational and Public Works part -time Seasonal Employees.
Staff is requesting council approval to begin the re -hire and recruitment process for the Mendota
Heights winter 2013 -2014 parks & recreation and public works staff.
Parks & Recreation: The city hires approximately 22 warming house /ice rink attendants to staff
the three outdoor rinks each winter season. Staff is requesting approval to send out re -hire

packets, post and recruit for the positions of Warming House /Ice Rink Attendants. Pay range is
$8.25 to $9.00 per hour.
Staff is also requesting approval to send out re -hire packets for the Ice Skating Instructor
position. Pay range is $22.00 to $22.75 per hour.
Public Works: The city hires approximately 6 ice rink flooders to flood the three outdoor rinks
each winter season. Staff is requesting approval to send out re -hire packets for the Rink Flooder
positions for Public Works. Pay range is $9.75 to $10.50 per hour.

Staff recommends that the Mendota Heights City Council approve the actions requested above

WHEREAS, The City of Mendota Heights recognizes that it offers the following health
plans: Health Reimbursement Account, Medical, Dental, and Employee Assistance and is a

45 CFR 164.530 (a), for purposes of HIPAA's privacy mandates, and
WHEREAS, the City of Mendota Heights recognizes that as a covered entity under
HIPAA that it is required to appoint a privacy official:
• to develop, implement, update and coordinate policies and procedures for protected
health information under HIPAA's privacy rules,
• to monitor and decide any issues that occur under the rules
• to receive complaints about any failure to comply with either the policies and procedures
or the privacy rules in general, and
WHEREAS, the Mendota Heights City Council shares concerns over privacy of health
data protected by the Act and wishes to comply with the requirements of the law, and

SUBJECT: Joint Powers Agreement for Emergency Management Services
BACKGROUND
In 2012 the City of Mendota Heights adopted a new Emergency Management Operations plan.
As soon as the document was adopted work was begun on the next plan. For the past eight
months work has been ongoing with West St. Paul, Liver Grove Heights and South St. Paul to
come up with a manual that would be consistent in layout and similar in shared content. For the
newest Incident Support Functions (ISF's) around hazardous material responses the assistance of
the Dakota County Emergency Preparedness Coordinator was sought.
This JPA will provide all of the background work necessary for your annually appointed
Emergency Manager to ensure state and federal compliance.
As each community has similar requirements placed upon them annually for compliance, the
four northern Dakota County communities began exploring the possibility of hiring someone to
do the majority of the compliance work. After the initial round of discussions the Sheriff offered
to provide the services under a Joint Powers Agreement (JPA).
The JPA was drafted by the Dakota County Attorney's Office and the work plan covering 2013
and 2014 has been agreed to by all members. It is the vision of this group to work towards a
similar plan county wide to ease the ability to work together in times of disaster.
The agreement covers a partial year for 2013 and then is an annual arrangement. The JPA has
been reviewed by the attorney Lehmann.
BUDGET IMPACT
The City of Mendota Heights will pay $1680.00 for the remainder of 2013 and $5005.00 in

JOINT POWERS AGREEMENT BETWEEN
DAKOTA COUNTY AND THE CITY OF MENDOTA HEIGHTS
FOR EMERGENCY MANAGEMENT SERVICES
This Agreement is made and entered into by and between the County of Dakota, by and
through the Dakota County Sheriff's Office, ( "County ") and the City of Mendota Heights, ( "City "); and
WHEREAS, the County and City are governmental units as that term is defined in Minn. Stat.
§ 471.59; and
WHEREAS, Minn. Stat. § 471.59 authorizes local governmental units to jointly or cooperatively
exercise any power common to the contracting parties; and
WHEREAS, the City desires to retain and compensate a qualified party to provide Emergency
Management Services as more fully described herein; and
WHEREAS, the County desires and is qualified to provide Emergency Management Services
as more fully described herein; and
WHEREAS, the County understands and agrees that:
1. The County is not an agent, servant, or employee of the City and shall not make any such
representations nor hold itself out as such; and
2. The County shall have no authority to bind the City for the performance of any services or
to otherwise obligate the City, authority being specifically limited to the duties assigned
under this Agreement; and
3. The County employees performing under this Agreement shall not accrue any continuing
contract rights for the services performed pursuant to this Agreement, including but not
limited to those afforded by Minn. Stat. § 122A.40, and the County specifically waives any
and all rights thereto; and
WHEREAS, the Dakota County Board of Commissioners by Resolution No. 13-
authorized the County to enter into an agreement with the City for the provision of Emergency
Management Services; and
WHEREAS, the City is willing to retain the County to provide Emergency Management
Services.
NOW, THEREFORE, in consideration of the mutual promises and benefits that the County
and City derive from this Agreement and other good and valuable consideration, the County and City
hereby enters into this Agreement for the purposes stated herein.
1. PURPOSE. The purpose of this Agreement is to set out the respective duties and
responsibilities of the County and the City for the provision of Emergency Management
Services.
2. TERM. This Agreement is effective September 1, 2013 and shall remain in effect through
December 31, 2014, or until completion by the parties of their respective obligations under this

Agreement, whichever occurs first, unless earlier terminated by law or according to the
provisions of this Agreement. This Agreement may be terminated with or without cause, by
either party upon thirty (30) days written notice.
3. RENEWAL TERM(S). This Agreement may be renewed on an annual basis hereinafter upon
written agreement of the parties at least 60 days prior to the expiration of the Agreement. Such
Renewal Terms shall be under the same terms and conditions stated in this Agreement unless
mutually agreed upon in writing by the parties.
4. DISPUTE RESOLUTION. The County and the City agree to cooperate and use their reasonable
efforts to ensure prompt implementation of the various provisions of this Agreement and to, in
good faith, undertake resolution of any dispute in an equitable and timely manner.
5. PROVISION OF SERVICES. Prior to the beginning of any Renewal Term, the parties will agree
upon a written project plan ( "Work Plan "), attached hereto and incorporated herein as
Addendum #1. The Work Plan will articulate the type of work desired, the estimated time frame
needed to perform the work, the estimated cost, and the desired outcome or deliverable. The
County agrees to provide the Emergency Management Services referenced in the Work Plan for
the Term of the Agreement.
6. COMPENSATON.
6.1 Total Compensation. The City agrees to pay the County for the Emergency Management
Services, including expenses and sales tax in an amount not to exceed Six Thousand Six
Hundred Eighty -Five and 00 /100s ($6,685.00) ( "Contract Amount "). In the event that the
Agreement is renewed under Section 3, the Contract Amount for Renewal Terms will be
agreed to by the parties.
During the Term of the Agreement, if the County or the City receives a grant or other
funding to offset the costs of providing Emergency Management Services covered by this
Agreement, the amount invoiced to the City will be adjusted downward accordingly.
6.2 Time of Payment. The City shall pay the County One Thousand Six Hundred Eighty
Dollars and 00/100 ($1,680.00) upon execution of the Agreement by the City. Thereafter,
the County shall invoice the City on a quarterly basis for hours of Emergency Management
Services rendered during the previous quarter up to the Contract Amount. Such invoicing
shall continue until one of the following occurs:
a. The completion of the Work Plan; or
b. Expiration of the Term of the Agreement; or
c. Early termination of the Agreement pursuant to Section 2 of this Agreement; or
d. The City completes payment of the full Contract Amount.
The City shall pay such invoices within thirty (30) days after their receipt.
6.3 Payment Upon Early Termination. If the Agreement is terminated prior to completion of the
Work Plan, the City shall pay for satisfactory services performed by the County through the
effective date of termination.
7. LIABLE FOR OWN ACTS. Each party to this Agreement shall be liable for the acts of their own
agents, volunteers or employees and results thereof to the extent authorized by law and shall
not be responsible for the acts of the other party, its officers, agents, volunteers or employees.

It is understood and agreed that the provisions of the Minn. Stat. § 471.59, the Municipal Tort
Claims Act, Minn. Ch. 466 and other applicable laws govern liability arising from the parties' acts
or omissions. Each party warrants that they are able to comply with the aforementioned
indemnity requirements through an insurance or self- insurance program and that each has
minimum coverage consistent with the liability limits contained in Minn. Stat. Ch. 466.
The provisions of Article 7 shall survive the expiration or termination of this Agreement.
8. INDEPENDENT CONTRACTOR. The County is and shall remain an independent contractor
with respect to any and all work performed under this Agreement. The County on behalf of its
employees and agents shall at all times be free to exercise initiative, judgment and discretion as
to how to best perform or provide services identified herein.
The County acknowledges and agrees that the County on behalf of its employees and agents is
not entitled to receive any of the benefits received by City employees and is not eligible for
workers' or unemployment compensation benefits under the City. The County also
acknowledges and agrees that no withholding or deduction for state or federal income taxes,
FICA, FUTA, or otherwise, will be made from the payments due the County and that it is the
County's sole obligation to comply with the applicable provisions of all federal and state tax laws.
9. GENERAL.
9.1. Notices. The City or County may, by giving written notice to the other party, designate any
address or addresses to which notices or other communications to them shall be sent when
required by or related to this Agreement. Until otherwise provided by the respective parties, all
notices or communications shall be addressed as follows:

9.2. Amendments. No amendments or variations of the terms and conditions of this Agreement
shall be valid unless in writing and signed by the parties.
9.3. Severability. All terms and covenants contained in this Agreement are severable. In the
event any provision of this Agreement shall be held invalid by any court of competent
jurisdiction, this Agreement shall be interpreted as if such invalid terms or covenants were
not contained in the Agreement and that such holding shall not invalidate or render
unenforceable any other provision.

9.4. Choice of Law. The laws of the state of Minnesota shall govern as to the interpretation,
validity, and effect of this Agreement. The captions and headings of the provisions under
this Agreement are for convenience only and shall not be considered or referred to
concerning questions of interpretation or construction.
9.5. Data Privacy. The parties agree that any information and data received from the other
party during the term of this Agreement shall be treated and maintained in accordance with
all applicable federal, state, and local laws, rules and regulations governing same,
including but not limited to the provisions of the Minnesota Government Data Practices Act,
Minnesota Statutes, Chapter 13 and the Minnesota rules implementing the Act now in
force or hereafter adopted. The County and the City agree to provide to each other data
which is reasonably necessary to fulfill the purpose of this Agreement, provided such
sharing of data is done in accordance with the Minnesota Government Data Practices Act
and other state and federal law regulating the dissemination of data.
9.6. Waiver. If either party fails to enforce any provision of this Agreement, that failure does not
waive the provision or that party's right to enforce it.
9.7. Non - Appropriation. Notwithstanding any provision of this Agreement to the contrary, this
Agreement may be terminated by either party in the event sufficient funds from the County,
City, State, Federal or other sources are not appropriated, obtained and continued at least
at the level relied on for the performance of this Agreement and the non - appropriation of
funds did not result from any act of bad faith on the part of the terminating party.
9.8. Entire Agreement. This Agreement is the entire agreement for the provision of the
Emergency Management Services between the City and the County and it supersedes all
prior written or oral agreements on this program. There are no covenants, promises,
undertakings, or understandings outside of this Agreement other than those as specifically
set forth. Any term, condition, prior course of dealing, course of performance, usage of
trade, understanding, or agreement purporting to modify, vary, supplement, or explain any
provision of this Agreement is null and void and of no effect unless in writing and signed by
representatives of both parties authorized to amend this Agreement.
IN WITNESS WHEREOF, this Agreement was entered into on the date(s) set forth below and
the undersigned, by execution hereof, represent that they are authorized to enter into this Agreement
on behalf of the respective parties and state that this Agreement has been read by them and that the
undersigned understand and fully agree to every provision, and hereby acknowledge receipt of a

Development Agency (CDA) in May 2013. The grant award is for $10,000 and must be spent by
December 31, 2014. Drake Bank, the owner of the developed property included in the redevelopment
site, has agreed to contribute an additional $5,000 to the project.
The attached DRAFT request for proposals (RFP) is provided for Council review and comment and
includes the following scope of work:
Concept Plans and Design. The project shall include concept drawings showing potential reuse
of the existing building (with the exception of the garage) and how the vacant city properties
might be incorporated into such a design. Design submittals should include the following:
a. Concept site plans including buildings, parking, landscaping.
b. Concept building drawings, including floor plans and elevations.
Value Added Components. The respondent can propose value -added tasks not included in this
RFP in order to complete the project.
If the RFP is approved for distribution, it will be sent out to consulting design and land development firms
and posted on the City's website. It is anticipated that staff will provide a recommendation for approval
of a professional services contract at the October 15, 2013 City Council meeting. The respondents will be
providing proposed delivery dates for the items included in the scope of work, with the requirement that
the project will be completed before the grant deadline.
BUDGETIMPACT
The RFP includes an estimated budget of $15,000. It is anticipated that the City will not have to
contribute any funds to complete the project.

REDEVELOPMENT GOALS
The redevelopment goals for this RFP include:
1. Mixed use.
2. Commercial.
3. Removal /mitigation of underground storage tanks.
4. Compatibility with surrounding land uses that enhances the neighborhood.

REDEVELOPMENT CONSIDERATIONS
The following issues with the redevelopment site should be considered by respondents when

BACKGROUND
Each year delinquent sewer accounts are certified to the property taxes. There has been a group
of delinquent accounts that has been overlooked and not certified. When a property is sold, the
sewer account is split into two separate bills. One is for the new owner and the second is for the
previous owner. The group for the previous owners is called the 00 group. This 00 group
contains final sewer bills that were never paid. This group has not been certified for the period
of 2005 -2011. We did send out letters in an attempt to collect the delinquent balances and did
receive payments on some of the accounts. Given the amount of time that has passed and
considering the difficulty in collecting unpaid amounts from people who haven't lived there for
up to eight years, we are recommending to write off the remaining delinquent balances. We
currently have processes in place so that this does not happen in the future. Going forward
delinquent 00 accounts will be certified to the property regardless of whether or not is for the
previous owner.
The total amount to be written off as an uncollectible receivable is $13,249.08. This amount is
made up of delinquent sewer charges and late fees. The amount of sewer charges is $5,111.08
and the late fees that have been accruing on this amount is $8,138.00.
BUDGET IMPACT
The sewer receivable account will be adjusted by $13,249.08 to reflect the amount to be
classified as an uncollectible receivable.
RECOMMENDATION
Staff recommends that the Mendota Heights City Council direct staff to write off the
uncollectible sewer receivable amount of $13,249.08. This action requires a majority vote of the
city council.

the Mendota Heights Road Force Main Replacement
BACKGROUND
City Council, at their July 16, 2013 meeting, authorized a contract with Bolton & Menk, Inc. for
the assessment of replacement options of the Mendota Heights Road Force Main. The force main
has been experiencing a break frequency within the last few years which has city staff concerned
with the useful life remaining in the pipe. Bolton & Menk, Inc. has completed their assessment
and development of the plans and specifications.
Bolton & Menk, Inc. has recommended bidding the project as two alternate replacement
methods. The first is directionally drilling a new line adjacent to the existing force main. The
second alternate is to pull a smaller diameter pipe through the existing pipe. Due to industry
costs increasing for this type of work recently, we are proposing to bid the project with a Fall of
2013 construction as well as a Spring of 2014 construction to see where prices come in at.
BUDGET IMPACT
Bolton & Menk, Inc. has submitted an opinion of probable costs for Alternate 1 to be
$564,900.00 which is directionally drilling a new main and $526,900.00 for Alternate 2 to sleeve
the existing main. The Sanitary Utility Fund has sufficient balance to cover this improvement.
RECOMMENDATION
Staff recommends Council approve the final plans and specifications and authorize staff to
advertise for bids. If Council wishes to implement the staff recommendation, pass a motion
adopting the attached Resolution, A RESOLUTION APPROVING FINAL PLANS AND
SPECIFICATIONS, AND AUTHORIZING ADVERTISEMENT FOR BIDS FOR THE
MENDOTA HEIGHTS ROAD FORCE MAIN REPLACEMENT. This action requires a
simple majority vote.

RESOLUTION 2013 -70
A RESOLUTION APPROVING FINAL PLANS AND SPECIFICATIONS, AND
AUTHORIZING ADVERTISEMENT FOR BIDS FOR THE MENDOTA HEIGHTS
ROAD FORCE MAIN REPLACEMENT PROJECT
WHEREAS, the City Engineer reported that the proposed improvements and
construction thereof were feasible, desirable, necessary, and cost effective, and further reported
on the proposed costs of said improvements and construction thereof, and
WHEREAS, the City Council has heretofore directed the City Engineer to proceed with
the preparation of plans and specifications thereof, and
WHEREAS, the City Engineer has prepared plans and specifications for said
improvements and have presented such plans and specifications to the City Council for approval.
NOW THEREFORE BE IT RESOLVED; by the Mendota Heights City Council as
follows:
1. That the plans and specifications for said improvements be and they are hereby in all
respects approved by the City.
2. That the Clerk with the aid and assistance of the City Engineer be and is hereby,
authorized and directed to advertise for bids for said improvements all in accordance with
the applicable Minnesota Statutes.
Adopted by the City Council of the City of Mendota Heights this seventeenth day of September
2013.

BACKGROUND
The month of August was the busiest month of the year. All of our Golf Camps and all but one
of our Golf Leagues are now done for the season. We saw a small increase in revenue from our
Golf Programs, even though we lowered the fees from previous years. I have attached a list of
all our programs from 2012 & 2013.
We had two exciting promotional opportunities take place August. We are featured on Groupon,
had have sold 409 deals, resulting in $6,550 in revenue. We were also feature on the cover of the
Pioneer Press on August 2nd & 3rd as the Daily Deal. We sold 75 deals worth $1,207 in revenue.
We have several golf outings in September at the Par 3. On September 21s' we have the 3rd
Annual Mendota Heights /Thompson Oaks Golf Tournament. The cost of the event is $35 and
included breakfast, lunch, prizes, and 9 holes at each course. If interested in participating please
call the clubhouse for more details at 651- 454 -9822.
MAINTENANCE UPDATE
• Insurance will be covering a major portion of the costs associated with the pressure tank
explosion in July.
• The current condition of the course is great, we have had many complements.
• We have started maintenance on the greens and tees, and will do this again in the middle of
October.
BUDGET IMPACT
The attached monthly expenditure report shows revenues and expenditures through the end of
August. The course has taken in $124,659 in revenues; expenditures for this period total
$95,083. This results in net revenue over expenditure of $29,576 year to date.

SUBJECT: Acquire easements for the Sibley Memorial Highway Bituminous Trail
Improvement Project
BACKGROUND
Design of the bituminous trail connection along the Sibley Memorial Highway (Highway 13)
between Riverside Lane and the Lilydale Road Bridge began in late 2005. WSB & Associates
was contracted by the City as a consultant engineer to design and administer the contract. The
construction of the project can now be adequately funded and constructed. The Summit of
Mendota Heights development at Highway 13 and Wachtler Avenue constructed a portion of a
trail along Highway 13 from Wachtler Avenue to the west. This project would connect this trail
with the Lilydale Road Bridge providing a bicycle and pedestrian access from the The Summit
development and neighborhoods east of Wachtler Avenue to both the North Urban Regional
Trail (Interstate Valley Creek Trail), and the Big Rivers Regional Trail.
Council awarded the project to Urban Companies at their September 3, 2013 meeting.
A portion of the trail is proposed to be placed on private property due to the Minnesota
Department of Transportation requirements. For this reason the city needs to acquire easements
from the privately held properties. There are three properties total the city requires an easement
from. Staff has made agreements with two of the three properties, the third is Xcel Energy
which requires many departments to review the documents. Below is a summary of the other
two acquisitions:

temporary easements which will expire after project completion.

BUDGET IMPACT
The total easement costs are $27,488.57 which have been anticipated. This project is eligible for
use of Municipal State Aid (MSA) funds, and the City's MSA account has sufficient funds to
cover the cost of the easements.
RECOMMENDATION
Staff recommends that the council approve the easement documents and authorize staff to
execute the agreements.

SUBJECT: Probationary Firefighter Appointments
BACKGROUND
Since May the Fire Department Officers and Tammy Schutta, Assistant to the City
Administrator/HR Coordinator, have been involved in screening new applicants for the
firefighter position to restore our ranks to an authorized strength of 36. The process was started
with 13 applicants who expressed interest in the position and 12 candidates who completed the
process. Through the process the interview board selected five candidates to make conditional
offers of employment to fill four open positions and one position opening expected at the end of
the year. The offers were conditioned upon passing a criminal history, background check,
physical, drug test and council approval to a one year probationary period.
On behalf of the committee we are pleased to recommend the five candidates below for city
council approval to a one year probationary period. All candidates have satisfactorily passed all
of the other conditions the appointment was premised on.
The five candidates recommended for probationary appointment are:
Cory Lane: Cory lives on Lemay Lake Road and is employed as a diagnostic ultrasound
technician at the Minneapolis VA Medical Center.
Peter Madland: Peter lives on Crown Point Drive and is a sheet metal worker.
George O'Gara: George lives on Crown Court and is employed Northern Tier Retail as a
customer service representative. He is also a member of the National Guard with the 434th
Chemical Company as a CBRNE Specialist.
Robert Petrasek: Robert lives on Pueblo Drive and is employed at the University of St. Thomas
as a public safety officer. Robert also follows in the footsteps of his grandfather William
Redding and his uncle's William Redding, Jr. and Ron Redding as Mendota Heights Firefighters.

David Winge: David lives on Fox Place and is employed at Local 110 11BEW as a journeyman
technician.
BUDGET IMPACT
The probationary firefighter pay is $8.04 for fire calls and training. These candidates will be
filling recent retirements so adequate budget is available.
RECOMMENDATION
As mentioned above the interview board recommends that council appoints the five candidates
as probationary firefighters. If the Council agrees with the hiring of the five firefighters, they
should pass a motion appointing Cory Lane, Peter Madland, George O'Gara, Robert Petrasek,
and David Winge as probationary firefighters with an effective start date of September 18, 2013.

Improvement Project — Xcel Energy
BACKGROUND
This memo is in addition to item 5n on the September 17th City Council Agenda.
In 2009, Mendota Heights rehabilitated the Park Place neighborhood. Xcel Energy owns
property along Farmdale Road which was eligible to be assessed as part of the rehabilitation
project. At the assessment hearing for the Park Place project, City Council waived the
assessments for Xcel Energy with the understanding that the city would be reimbursed through
the granting of an easement along Sibley Memorial Highway for the construction of a
bituminous trail.
Xcel Energy has informally acknowledged and accepted the easement agreement as drafted
pending review of the final construction documents to identify any potential conflicts. Staff is
requesting authorization from Council to execute the easement agreement once submitted as to
not delay the construction of the trail. The Minnesota Department of Transportation will not
grant a notice to proceed without the required easements being secured. Staff is proposing to
reimburse Xcel Energy ONE DOLLAR for this easement.
BUDGET IMPACT
The easement costs associated with this project have been anticipated and budgeted for. This
project is eligible for use of Municipal State Aid (MSA) funds, and the City's MSA account has
sufficient funds to cover the cost of the easements.
RECOMMENDATION
Staff recommends that the council approve the easement and authorize staff to execute the
agreements.

Improvements
BACKGROUND
The purpose of this memo is to request that the Council approve the feasibility report and
schedule a public hearing for the Victoria Road & Rolling Green Neighborhood Improvements.
Staff identified the Victoria Road Neighborhood Improvements as a 2014 street reconstruction
project in the 2013 -2017 Street Improvement Plan (SIP). The Rolling Green Neighborhood
Rehabilitation was identified as a 2014 street rehabilitation project in the 2013 -2017 SIP. Due to
the close proximity of these projects to each other, staff combined these two neighborhood
improvements into one project to reduce redundancies and staff time. The combined project will
be called the Victoria Road & Rolling Green Neighborhood Improvements.
The preparation of a feasibility report for the Victoria Road & rolling Green Neighborhood
Improvements was authorized by the Mendota Heights City Council by adopting Resolution
2013 -37 at the City Council meeting held on June 4, 2013. This project includes reconstructing
the rural section of Victoria Road from Lexington Avenue to Caren Road. This project also
includes rehabilitating the urban sections of Walsh Lane (from Marie Avenue to 150' south of
Stratford Road), Stratford Road, Oxford Court, Windwood Court, Rolling Green Curve, and
Coventry Court.
This item was pulled from the August 6th Council meeting for discussion at the August 13th
Budget Workshop meeting. Background material was provided in the Council packets for
the August 6th meeting. Please bring this information with you to the September 17th
meeting if you so desire.
BUDGET IMPACT
The feasibility report indicates the estimated costs for the project, along with preliminary
assessment estimates. At the end of the feasibility report, a project financing summary is
included to show project cost splits and funding sources. The total estimated cost of the project is
$3,960,665.40.

Street improvement projects are proposed to be assessed to the benefiting property owners.
Pursuant to the City's Street Rehabilitation and Reconstruction Policy, the benefiting properties
should be assessed 50% of the street reconstruction and rehabilitation costs. The following tables
show the estimated unit assessments based on the City policy and proposed unit assessments that
are being recommended by staff.

Accepting this° feasibility study does not obligate the city to complete the project as proposed. At
the time of the public hearing, staff will provide the city council with construction and timeline
alternatives, which may include constructing the project as proposed, delaying the project,
chyqce g the scope of the project, or phasing the construction of the project into multiple years.
Construction options will be discussed with the public at the neighborhood meeting. At the time
of the public hearing is when the council can direct staff on how to proceed.
RECOMMENDATION
Staff recommends that council accept the feasibility report and schedule the public hearing for
November 5, 2013. A neighborhood informational meeting will be scheduled in the middle of
October.

WHEREAS, pursuant to Resolution 2013 -37, the City Council, on June 4, 2013, ordered a
feasibility report to be prepared by the City Engineer with reference to the improvement of Victoria
Road from Lexington Avenue to Caren Road, Walsh Lane (from Marie Avenue to 150' south of
Stratford Road), Stratford Road, Oxford Court, Windwood Court, Rolling Green Curve, and

WHEREAS, the City Engineer has submitted a report to the City Council with respect to the
Victoria Road from Lexington Avenue to Caren Road, Walsh Lane (from Marie Avenue to 150'
south of Stratford Road), Stratford Road, Oxford Court, Windwood Court, Rolling Green Curve, and
Coventry Court improvements which include: storm sewer, water main replacement, aggregate base,
concrete curb and gutter, bituminous surfacing and appurtenant work; and
WHEREAS, in said report the City Engineer reported that the proposed improvements and
construction thereof are desirable and necessary, technically and economically feasible, cost
effective, and further reported on the estimated cost of the proposed improvements; and
NOW THEREFORE IT IS HEREBY RESOLVED, by the Mendota Heights City Council
as follows:
1. The City Council hereby accepts the Feasibility Report as submitted.
2. The Council will consider the improvement of such streets and areas in accordance with
the report and the assessment of property as described in the report for all or a portion of
the cost of the improvements pursuant to Minnesota Statutes Chapter 429 at an estimated
total cost of the improvements of $3,960,665.40.
3. A Public Hearing shall be held on such proposed improvements on the 5th day of
November, 2013 at City Hall, 1101 Victoria Curve, City of Mendota Heights, Minnesota
at 7:00 p.m. Statutory notice and publication requirements shall be followed.
Adopted by the City Council of the City of Mendota Heights this seventeenth day of September,

SUBJECT: Ordinance Permitting Electric Boat Motors on Rogers Lake
BACKGROUND
Representatives from the Roger's Lake Homeowner's Association made a request to the city
council in the fall of 2012 to allow boat motors on Roger's Lake, south of Wagon Wheel Trail.
The request sought approval for boat motors on a trial basis, with conditions. The association
presented their request to the Parks and Recreation Commission at their April 2013 meeting. The
request limited the type and size of motors allowed, as well as boat size and hours the activity.
The Parks and Recreation Commission recommended approval of the ordinance.
At the May 12, 2013 City Council Meeting Council adopted City Ordinance 451 allowing for the
temporary use of motorboats on Rogers Lake south of Wagon Wheel Trail. Shortly after the
adoption, City staff was notified that before the ordinance could be enacted, an approval form the
Department of Natural Resources (DNR) would be required. Staff drafted a new ordinance in
the format desired by the DNR and sent it in for DNR approval. The attached letter from the
DNR is their approval of the Ordinance.
The ordinance as drafted would not change City Code, but would serve as a stand -alone
ordinance, which will expire one year after adoption and publication. If city council chooses to
allow motorboats on a permanent basis, an ordinance amending City Code could be considered
at a future date. This provides opportunity to monitor lake use and any impacts on a trial basis.
If not acted upon, the proposed ordinance would expire at the end of September, 2014.
The Roger's Lake Homeowner's Association has committed to installing a sign at Rogers Lake
Park, with the cost shared by the City 50% each, stating the restrictions for motorboat use.
BUDGET IMPACT
Other than the cost of sign production, City staff does not anticipate any additional cost for
allowing motorboats on Rogers Lake, with the listed restrictions, on a temporary basis.
RECOMMENDATION
City staff recommends allowing electric boat motors on Rogers Lake, south of Wagon Wheel
Trail. If city council wishes to implement this recommendation, pass a motion adopting
ORDINANCE 456, AN ORDINANCE REGULATING THE SURFACE USE OF ROGERS
LAKE. This action requires a simple majority vote.

ORDINANCE NO. 456
AN ORDINANCE REGULATING THE SURFACE USE OF ROGERS LAKE
Be it ordained and enacted by the City Council of the City of Mendota Heights, State of
Minnesota, that these amendments following, by this act, are newly enacted section(s) which,
upon their enactment, become temporarily lawful through the date indicated in the Ordinance.
Section 1. PURPOSE, INTENT, AND APPLICATION: As authorized by Minnesota
Statutes 86B.201, 86B.205, and 459.20, AND Minnesota Rules 6110.3000 — 6110.3800 as now
in effect and as hereafter amended, this Ordinance is enacted for the purpose and with the intent
to control and regulate the use of the waters of Rogers Lake in the City of Mendota Heights,
Minnesota, said body of water being located entirely within the boundaries of the City of
Mendota Heights, Minnesota, to promote its fullest use and enjoyment by the public in general
and the citizens of the City of Mendota Heights, Minnesota, in particular, to insure safety for
persons and property in connection with the use of said waters; to harmonize and integrate the
varying uses of said waters; and to promote the general health, safety, and welfare of the citizens
of the City of Mendota Heights, Minnesota.
Section 2. DEFINITIONS: Terms used in this Ordinance related to boating are defined
in Minnesota Statute 86B.005.
Section 3. SURFACE ZONING OF ROGERS LAKE BY ALLOWING THE USE OF
MOTORBOATS UNDER CERTAIN CONDITIONS:
(a) Use of Motorboats as defined in Title 6, Chapter 6, Section IA of City Code for the
City of Mendota Heights shall be allowed on Rogers Lake, south of Wagon Wheel
Trail only, provided:
a. The motorboat must be 14 feet or less in length
b. The motor strength must be 48 pounds of thrust or less (equivalent to 5
horsepower)
c. The motorboat must be operated at "no wake" speed.
d. Operation of motorboats is restricted to between sunrise and sunset.
(b) If not renewed by an act of the City Council of the City of Mendota Heights,
Minnesota, this Ordinance shall automatically sunset one year after passage and
publication.
Section 4. ENFORCEMENT: The primary responsibility for enforcement of this
Ordinance shall rest with the City of Mendota Heights, Minnesota. This, however, shall not
preclude enforcement by other licensed peace officers.
Section 5. EXEMPTIONS: All authorized Resource Management, Emergency, and
Enforcement Personnel, while acting in the performance of their assigned duties are exempt from
the foregoing restrictions.

Heights, Minnesota to provide for adequate notification of the public, which shall include
placement of a sign as public watercraft access point(s) outlining essential elements of the
Ordinance, as well as the placement of necessary buoys and signs.
Section 7. PENALTIES: Any person violating any provision of this section shall be
guilty of a misdemeanor and shall, upon conviction thereof, be punishable as provided in
section 1 -4 -1 of the City of Mendota Heights, Minnesota Code of Ordinances (1981 Code 1201
§ 11; amd. 2003 Code).
Section S. EFFECTIVE DATE: This Ordinance shall be in effect from and after the date
of its passage and publication.
