Res 2008-76 CUP, Prel. & Final Plat for ComplexCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION NO. 08-76 A RESOLUTION FOR A CONDITIONAL USE PERMIT, PRELIMINARY AND FINAL PLAT FOR A HOTEL AND RETAIL SALES AND SERVICE COMPLEX AT THE SOUTHEAST CORNER OF PILOT KNOB ROAD AND NORTHLAND DRIVE WHEREAS, Mendota Heights Lodging Investors has applied for a conditional use permit, preliminary and final plat to construct a hotel and retail service center on the parcel located on the southeast corner of Pilot Knob Road and Northland Drive [PID 27- 48300 - 010 -06, L1 136 Mendota Heights Industrial Park] as presented in planning case 08 -25, and WHEREAS, the Planning Commission held a public hearing on this request at their August 26, 2008 meeting, and WHEREAS, the Planning commission recommended approval of the conditional use permit, preliminary and final plat as presented in planning case 08 -25 NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Mendota Heights to approve a conditional use permit, preliminary and final plat with the following conditions: 1. Conditional Use Permit is only effective after the publication of Ordinance 419, amending title 12, chapter 1 of the City Code. 2. A cross- parking facilities agreement shall be established between the property owners of Lot 1 and Lot 2, with a copy provided to the City. 3. The following minimum sizes shall be required at the time of planting: • Coniferous trees — 6 feet tall • Major Shrub Plantings — 5 gallons 4. All site areas not covered by buildings, sidewalks, parking lots, driveways, patios or similar hard surface materials shall be sodded, except those areas to be preserved in a natural state; provided, however, that areas reserved for future building expansions may be seeded. Sodded and seeded area shall be noted on the Landscaping Plan. 5. A sprinkler system shall be provided for all landscaped areas except areas to be preserved in the natural state. Location and details of the irrigation system(s) shall be provided. 6. Connection charges for street, sanitary sewer, and water main shall be paid prior to issuance of a building permit. 7. Any changes to the grading and drainage shall be subject to the review and approval of the City Engineer. 8. The park and trail dedication requirement shall be met through cash fee in lieu of land, which shall be paid prior to the City signing off on final plat. BE IT FURTHER RESOLVED that in support of the above approval, the Council hereby makes the following Findings of Fact: 1. The proposed uses are in harmony with the Zoning Ordinance conditional use permit standards, 2. The proposed plat meets the requirements of the Subdivision Ordinance, the Zoning Ordinance and the Comprehensive Plan.
