Res 2008-80 Denying Variance @ 694 Ocala Ln1 I 1 1 • :1 1 yn 1 i 1 1 RESOLUTION 08-20 A RESOLUTION DENYING A VARIANCE TO THE SIDE YARD SETBACK AT 694 OCALA LANE WHEREAS, Mark Goblisch has applied for nine (9) foot variance to the side yard setback for a pergola roof addition to the garage at 694 Ocala Lane [PIN: 27- 19850- 020-04; Delaware Crossing Block 4, Lot 2.] as proposed in Planning Case #08 -27; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on September 23, 2008; and WHEREAS, The Planning Commission voted to recommend that the Council deny the variance to the side yard setback as presented to the Planning Commission on the evening of September 23, 2008 and as shown in Planning Case #08 -27. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a nine (9) foot variance to the side yard setback for a pergola roof addition to the garage at 694 Ocala Lane as proposed in Planning Case #08- 27 is hereby denied with the following condition: 1. The applicant shall remove the pergola roof structure that was built without a permit within two weeks of the final decision by City Council. 2. The applicant shall consult the City Building Official prior to demolition and ' receive proper building permit approval if constructed in a new location. BE IT FURTHER RESOLVED that in support of the above denial, the Council hereby makes the following findings of fact: 1. There is no unique condition which creates a hardship. 2. The requested project is not consistent with the character of the neighborhood, and would alter the essential character of the neighborhood.
