Res 2009- 24 Approving Lot Line Adjustment1 1 1 1 :I so II • / • 1 II RESOLUTION 09 -24 A RESOLUTION APPROVING A LOT LINE ADJUSTMENT BETWEEN 1830 FARO LANE AND 1831 SUMMIT LANE WHEREAS, Ms. Lisa Silverberg, has applied for a lot line adjustment to the common property line between 1830 Faro Lane and 1831 Summit Lane [Lot 9 Block 2, Lexington Highland East; PID 27- 44950- 090 -02 and PT LOT 15 BLK 2 BEG NE COR N 82D39M25S W ON NLY LINE 135.71 FT TO NW COR S ON WILY LINE 11.25 FT S 871324M 22S E 133.46 FT TO BEG & LOT 16 BLK 2 EX BEG SW COR LOT 17 BLK 2 S ON WLY LINE SAID LOT 16 18.22 FT S 79D 33M56S E 114.30 FT TO SILY LINE LOT 17 N 70D23M42S W ON SAID SLY LINE 113.20 FT TO BEG & PT OF LOT 17 BLK 2 BEG SE COR W ON SLY LINE 10.88 FT S 79D33M56S E 11.02 FT TO E LINE SAID LOT 17 SLY 1.76 FT TO BEG 16 2, Lexinton Highland East; PID 27- 44950- 161 -02] as proposed in Planning Case #09 -07; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on March 24, 2009; and WHEREAS, The Planning Commission recommended that the Council approve the lot line adjustment as presented to the Planning Commission on the evening of March 24, 2009 and as shown in Planning Case #09 -07; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a lot line adjustment for 1830 Faro Lane and 1831 Summit Lane as proposed in Planning Case #09 -07 is hereby approved with the following conditions: 1. A copy of the documents recorded with Dakota County shall be submitted to the City. 2. An updated survey shall be submitted to the City for its records, meeting zoning requirements. 3. A building permit shall be obtained from the City prior to construction of the new fence. BE IT FURTHER RESOLVED that in support of the above approval, the Council hereby makes the following findings of fact: 1. The proposed lot line adjustment shall improve the current lot line situation. 2. The adjustment is consistent with the Zoning Ordinance and Comprehensive Plan.
