RESOLUTION 09 -30
A RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR A DETACHED
ACCESSORY BUILDING AT 1754 JAMES ROAD
WHEREAS, Matt and Julie Brooks have applied for a Conditional Use Permit for a detached
accessory structure of 520 square feet at 1754 James Road [Lot 11, Block 1, Tilsen's Highland Heights
Plat 3; PID 27- 76402 - 110 -01] as proposed in Planning Case #09 -09; and
WHEREAS, The Planning Commission held a public hearing on this application at their regular
meeting on April 28, 2009; and
WHEREAS, The Planning Commission recommended that the Council approve the Conditional
Use Permit for a detached accessory structure as presented to the Planning Commission on the evening
of April 28, 2009 and as shown in Planning Case #09 -09;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of
Mendota Heights that a Conditional Use Permit for a detached accessory structure at 1754 James Road
as proposed in Planning Case #09 -09 is hereby approved with the following conditions:
1. The proposed storage building is redesigned to meet the maximum building height standard
i of 15 feet.
2. The existing shed is removed from the property as proposed.
3. The building is used solely for accessory storage and workshop space — no residential living
quarters or business use are permitted.
4. The building will not be used as a garage or for other vehicle storage.
BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights that a
Conditional Use Permit for a detached accessory structure at 1754 James Road as proposed in planning
Case #09 -09 is hereby approved with the following Findings of Fact:
The proposed structure is consistent with the intent of the Conditional Use Permit clause
allowing detached accessory buildings
Adopted by the City Council of the City of Mendota Heights this 7t" day of April, 2009.
