Res 2009- 40 Approving Critical Area Permit @ 1032 Sibley Memorial HwyCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 09 -40 A RESOLUTION APPROVING A CRITICAL AREA PERMIT FOR A HOME ADDITION AND NEW DRIVEWAY AT 1032 SIBLEY MEMORIAL HIGHWAY WHEREAS, Ron Furchner has applied for a critical area permit for a home addition and new driveway at 1032 Sibley Memorial Highway [Section 23 Twn 28 Range 23 pt of NW Quarter of SW Quarter coin SE cor N 844 ft W 161.9 ft to beg N 295 ft to cen Sibley Highway SW 125 ft SE at right angle 256.5 ft E 50.9 ft to beg; PID 27- 02300 -030 -51] as proposed in Planning Case #09 -13; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on May 26, 2009; and WHEREAS, The Planning Commission recommended that the Council approve the critical area permit for a home addition and new driveway as presented to the Planning Commission on the evening of May 26, 2009 and as shown in Planning Case #09 -13; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a critical area permit for a home addition and new driveway as proposed in planning Case #09 -13 is hereby approved with the following conditions: 1. the development activities shall be conducted and staged to minimize soil erosion and change in topography 2. The project shall be reviewed by the City Engineer and approval is subject to any added conditions by the Engineer 3. The applicant shall obtain proper building permit approval prior to the commencement of the home addition construction 4. The applicant shall obtain a driveway permit from the City and MnDOT prior to the new driveway access work being conducted. A copy of the MnDOT permit shall be provided to the City for their records. 5. The applicant removes the existing driveway and restores the area with landscaped ground cover. BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights that a critical area permit for a home addition and new driveway as proposed in planning Case #09 -13 is hereby approved with the following findings of fact: 1. The proposed addition and driveway work will not jeopardize the aesthetic integrity and natural environment of the Mississippi River corridor critical area.
