RESOLUTION 09 -48
A RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR OUTDOOR STORAGE AT
LOT 2, BLOCK 1, MENDOTA HEIGHTS BUSINESS PARK 4TH ADDITION
WHEREAS, United Properties, LLC on behalf of Bituminous Roadways has applied for a
conditional use permit for outdoor storage at Lot 2, Block 1, Mendota Heights Business Park 4th Addition
[Lot 2, Block 1, Mendota Heights Business Park 4th Addition; PID 27- 48273 - 020 -01] as proposed in
Planning Case #09 -18; and
WHEREAS, The Planning Commission held a public hearing on this application at their regular
meeting on May 26, 2009; and
WHEREAS, The Planning Commission recommended that the Council approve the conditional use
permit for outdoor storage as presented to the Planning Commission on the evening of May 26, 2009 and as
shown in Planning Case #09 -18;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota
Heights that a conditional use permit for outdoor storage as proposed in planning Case #09 -18 is hereby
approved with the following conditions:
1. The acceptability of the proposed access points should be subject to comment and
recommendation by the City Engineer.
2. Additional landscaping along the exterior of the proposed fence shall be provided subject to
review and approval of City staff.
3. Issues related to grading, drainage and utilities are subject to review and approval of the City
Engineer.
4. All vehicles and equipment stored on site are licensed and operable, as applicable.
5. Material storage is not allowed on site.
BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights that a
conditional use permit for outdoor storage as proposed in planning Case #09 -18 is hereby approved with the
following findings of fact:
1. Contractors Yards are allowed in the zoning district by conditional use permit.
2. The neighboring property to the north owned and operated as a MnDOT maintenance facility
utilizes outdoor storage.
3. The utilization of a fence and landscaping permits for screening the contents of the storage yard.
4. All other performance standards of the Zoning Ordinance would be met.
5. The property is isolated and has limited exposure to public street traffic.
