Res 2013- 60 Deny Variance at Commerce Dr & LeMay AveCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 2013 - 60 A RESOLUTION DENYING A BUILDING SETBACK VARIANCE AT THE UNADDRESSED PROPERTY LOCATED AT THE SOUTHWEST QUADRANT OF COMMERCE DRIVE AND LEMAY AVENUE IN THE MENDOTA HEIGHTS BUSINESS PARK WHEREAS, Scannell Properties 162, LLC has applied for a variance to the building setback requirement for the unaddressed property located at the southwest quadrant of Commerce Drive and Lemay Avenue in the Mendota Heights Business Park (PID 27- 48273 -02- 010, Lot 1, Block 2 Mendota Heights Business Park 4t" Addition) as proposed in planning case 2013-13; and WHEREAS, the Planning Commission held a public hearing on this matter at their regular meeting August 27, 2013. NOW THEREFORE BE IT RESOLVED, by the Mendota Heights City Council that a variance to the building setbacks as proposed in planning case 2013-13 is hereby denied with the following findings of fact: 1. The parcel on which the building is proposed is a ftilly conforming parcel under the zoning regulations, with no unique conditions related to building placement such as topography or restrictions that limit its use. 2. The site in question is larger in all dimensions than the minimum requirements of the Code, and can accommodate many design and site planning options. 3. Reasonable use can be made of the property without variance with building architecture that reflects the site. 4. Any difficulties in utilizing the site are the result of actions of the applicants through design and use of the building.
