RESOLUTION 2013 - 59
A RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR
A FENCE GREATER THAN THIRTY -SIX INCHES WITHIN THIRTY FEET
OF A PUBLIC RIGHT -OF -WAY AT 1533 DODD ROAD
WHEREAS, Karla Gotham has applied for a conditional use permit for a fence greater than
thirty-six inches in height within the 30 -foot setback at 1533 Dodd Road (PID 27- 71200 -00 -020, Lot
2, Somerset West Replat) as proposed in planning case 2013 -12; and
WHEREAS, the Planning Commission held a public hearing on this matter at their
regular meeting August 27, 2013.
NOW THEREFORE BE IT RESOLVED, by the Mendota Heights City Council that
a conditional use permit as outlined in planning case 2013 -12 is hereby approved with the
following findings of fact:
1. The proposed project will not further impact traffic visibility at the Dodd Road/4 ti' Avenue
intersection.
2. The proposed fence type and height are consistent with City Code requirements, with the
recommendation that the chain link fence is painted to avoid a galvanized finish.
3. The fence is compatible with the established character in the area and will not negatively
impact any neighboring properties.
Adopted by the City Council of the City of Mendota Heights this third day of September, 2013.
