Res 2009- 57 CUP @ 1960 Lexington AveCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 09-57 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR A 988 SQUARE FOOT ACCESSORY STRUCTURE AT 1960 LEXINGTON AVE WHEREAS, Edward Joseph on behalf of Holy Family Catholic Church has applied for a conditional use permit for a 988 square foot accessory structure at 1960 Lexington Ave [Section 26 Twn 28 Range 23, N 275.58 Ft of S 693 Ft of W 378 Ft of SW 1/4 of NW 1/4 & W 417.42 Ft of S 417.42 Ft of SW 1/4 of NW 1/4 ex Hwy; PID 27-02600-021-30] as proposed in Planning Case #09-23; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on June 23, 2009; and WHEREAS, The Planning Commission recommended that the Council approve the conditional use permit for a 988 square foot accessory structure as presented to the Planning Commission on the evening of June 23, 2009 and as shown in Planning Case #09-23; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a conditional use permit for a 988 square foot accessory structure as proposed in planning Case #09-23 is hereby approved with the following conditions: 1. Landscaping shall be added to the north, east and south of the accessory structure, in order to serve as a buffer between the structure and the adjacent property and right-of-way of Victoria Road. 2. Previously fenced areas will be established and maintained as turf. BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights that a conditional use permit for a 988 square foot accessory structure as proposed in planning Case #09-23 is hereby approved with the following findings of fact: 1. The proposed use will not have a detrimental effect on the health, safety, and welfare of the surrounding lands and community. 2. The accessory structure will not influence traffic conditions or parking facilities on adjacent streets. 3. The proposed use is consistent with the general purpose and intent of the Comprehensive Plan and Zoning Ordinance.
