Res 2009- 58 Critical Area Permit @ 1220 Knolwwod Lni I 11 :1 [avowal 1• i i 11 1 RESOLUTION 09 -58 A RESOLUTION APPROVING A CRITICAL AREA PERMIT FOR A FENCE AT 1220 KNOLLWOOD LANE WHEREAS, Dave Campbell on behalf of Jim Taurinskas has applied for a critical area permit for a six foot high and sixteen foot long fence at 1220 Knollwood Lane [L 13 B 1 Ivy Falls W 2n Addition; PID 27- 37676 - 130 -01] as proposed in Planning Case #09 -24; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on June 23, 2009; and WHEREAS, The Planning Commission recommended that the Council approve the critical area permit for a six foot high and sixteen foot long fence as presented to the Planning Commission on the evening of June 23, 2009 and as shown in Planning Case #09 -24; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a critical area permit for a six foot high and sixteen foot long fence as proposed in planning Case #09 -24 is hereby approved with the following conditions: 1. The applicant shall receive a fence permit prior to installation of the fence. 2. The fence shall meet regulations established in Section 12 -1D -6. BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights that a critical area permit for a six foot high and sixteen foot long fence as proposed in planning Case #09 -24 is hereby approved with the following findings of fact: 1. The fence is necessary to screen the view from the applicant's home to the neighbor's home. 2. The proposed fence will have little or no visual impact on the critical area or surrounding property. 3. The fence will create no issues for grading or erosion. 4. The fence is proposed to have minimal impact on the land as it does not involve landscaping, paving, grade changes, soil loss, or altering of slopes.
