Res 2009- 63 Setting A Public Hearing Re: MH Bus. ParkRESOLUTION 09 -63 A RESOLUTION SETTING A PUBLIC HEARING ON AN EASEMENT VACATION AT LOT 2, BLOCK 1, MENDOTA HEIGHTS BUSINESS PARK, 4th ADDITION WHEREAS, a Conditional Use Permit for outdoor storage at Lot 2, Block 1, Mendota Heights Business Park, 4th Addition - located at the comer of Lemay Avenue and Commerce Drive -- was approved by City Council at their June 16th, 2009 meeting; and WHEREAS, the original plat of the Mendota Heights Business Park established roadway and utility easements in locations where future roads and utilities would someday be constructed; and WHEREAS, Commerce Drive was ultimately constructed with a different alignment than originally proposed; and WHEREAS, all utilities installed within the originally platted roadway and utility easement have been relocated with the old utility lines abandoned in place; and WHEREAS, the City of Mendota Heights sees no foreseeable use for either roadway or utility of the portion of the original easement area as recorded at Dakota County under Easement Document Number 623116 described as follows: That part of the 80.00 foot wide easement for utility purposes per Document No. 623116 lying within Lot 2, Block 1, MENDOTA HEIGHTS BUSINESS PARK 4THADDITION, according to the recorded plat thereof, Dakota County, Minnesota. Together with that part of the easement for highway and utility purposes per said Document No. 623116 lying within said Lot 2. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights: 1. The Council will consider the vacation of such easement and a public hearing shall be held on such proposed vacation on the 1" day of September, 2009, before the City Council in the City Hall located at 1101 Victoria Curve at 7 pm. 2. The City Clerk is hereby directed to give published, posted and mailed notice of such hearing as required by law.
