A RESOLUTION APPROVING A CRITICAL AREA PERMIT FOR LANDSCAPING AT 979
CAREN ROAD
WHEREAS, Thomas Fahey has applied for a Critical Area Permit for Landscaping at 979 Caren
Road [See Attached; PID 27- 76402 - 362 -03] as proposed in Planning Case #09 -27; and
WHEREAS, The Planning Commission held a public hearing on this application at their regular
meeting on July 28, 2009; and
WHEREAS, The Planning Commission recommended that the Council approve the Critical
Area Permit for landscaping as presented to the Planning Commission on the evening of July 28, 2009
and as shown in Planning Case #09 -27;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of
Mendota Heights that a Critical Area Permit for Landscaping at 979 Caren Road as proposed in
Planning Case #09 -27 is hereby approved with the following Findings of Fact:
1. The rock wall and landscaping will have little or no visual impact on the Critical Area or
surrounding property.
2. The project has not and will not create issues for grading or erosion.
3. The rock wall and landscaping have had minimal impact on the land as the project did
not involve paving, significant grade changes, soil loss, or altering of steep slopes
4. The project improves the runoff and water drainage on the lot.
5. The rock wall and landscaping have not and will not jeopardize the aesthetic integrity
and natural environment of the Mississippi River Critical Area due to the use of natural
materials.
Adopted by the City Council of the City of Mendota Heights this 4th day of August, 2009.
