RESOLUTION 09 -73
A RESOLUTION APPROVING A 5' VARIANCE TO THE FRONT YARD SETBACK
FOR A COVERED FRONT ENTRY AND BAY WINDOW AT 804 PARK PLACE DRIVE
WHEREAS, Tom Ademite has applied for a 5' variance to the front yard setback for a
covered front entry and bay window at 804 Park Place Drive [Lot 1 Block 4 Park Place; PID 27-
56600- 010 -04] as proposed in Planning Case #09 -32; and
WHEREAS, The Planning Commission held a public hearing on this application at their
regular meeting on August 25, 2009; and
WHEREAS, The Planning Commission recommended that the Council approve the 5'
variance to the front yard setback for a covered front entry and bay window as presented to the
Planning Commission on the evening of August 25, 2009 and as shown in Planning Case #09 -32;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of
Mendota Heights that a 5' variance to the front yard setback for a covered front entry and bay
window as proposed in planning Case #09 -32 is hereby approved with the following findings of
fact:
1. Reasonable use of a home includes the avoidance of weather - related destruction to
features of a home, as well as the comfort and protection of guests waiting to enter the
home.
2. The current design of the home has resulted in significant damage over the years that
would be avoided if the variance is granted.
3. Without the setback variance, the property owner could not make reasonable use of his
property.
4. The applicant has indicated that the location of the home on the front yard setback
constitute a hardship.
5. The applicant has indicated that the western exposure of the home and exposure to the
elements constitute a hardship.
6. The remodeling of the front entrance would complement the architecture of the existing
home and would not alter the essential character and development of the neighborhood.
7. The project is consistent with the Comprehensive Plan.
