RESOLUTION NO. 09 -81
RESOLUTION ACCEPTING FEASIBILITY REPORT AND CALLING FOR A PUBLIC HEARING
ON THE 2010 IMPROVEMENT PROJECT
WHEREAS, pursuant to Resolution 09 -52, the City Council, on July 7, 2009, ordered a feasibility
report to be prepared by the City Engineer with reference to the improvement of Butler Avenue, Diego Lane,
Esther Lane, Fremont Avenue, Garden Lane, Hiawatha Avenue, John Street, Junction Lane, Kirchner Avenue,
Miriam Street, Simard Street, Spring Street, Valley Lane & View Lane; and
WHEREAS, the City Engineer has submitted a report to the City Council with respect to the Butler
Avenue, Diego Lane, Esther Lane, Fremont Avenue, Garden Lane, Hiawatha Avenue, John Street, Junction
Lane, Kirchner Avenue, Miriam Street, Simard Street, Spring Street, Valley Lane & View Lane improvements
which include storm sewer, water main replacement, aggregate base, concrete curb and gutter, bituminous
surfacing and appurtenant work; and
WHEREAS, in said report the City Engineer reported that the proposed improvements and
construction thereof are desirable and necessary, technically and economically feasible, cost effective, and
further reported on the estimated cost of the proposed improvements; and
NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota
Heights, Minnesota as follows:

1. The City Council hereby accepts the Feasibility Report as submitted.
2. The Council will consider the improvement of such streets and areas in accordance with the
report and the assessment of property as described in the report for all or a portion of the cost
of the improvements pursuant to Minnesota Statutes Chapter 429 at an estimated total cost of
the improvements of $1,934,340.
3. A Public Hearing shall be held on such proposed improvements on the 3rd day of November,
2009 at City Hall, 1101 Victoria Curve, City of Mendota Heights, Minnesota at 7:30 p.m.
Statutory notice and publication requirements shall be followed.
Adopted by the City Council of the City of Mendota Heights this 60' day of October, 2009.
