RESOLUTION 09 -85
A RESOLUTION APPROVING A VARIANCE TO THE FRONT YARD SETBACK AND TO
THE SIDE YARD SETBACK FOR A GARAGE ADDITION AT 24 SOMERSET ROAD
WHEREAS, Thomas Costello has applied for a 11' variance to the "string rule" front yard
setback and an 8' variance to the side yard setback for a garage addition at 24 Somerset Road [Lot 8
Block 11 Somerset View; PID 27.71150.080.11] as proposed in Planning Case #09 -35; and
WHEREAS, The Planning Commission held a public hearing on this application at their regular
meeting on September 22, 2009; and
WHEREAS, The Planning Commission recommended that the Council approve the 11' variance
to the "string rule" front yard setback and an 8' variance to the side yard setback for a garage addition as
presented to the Planning Commission on the evening of September 22, 2009 and as shown in Planning
Case #09 -35;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of
Mendota Heights that a 11' variance to the "string rule" front yard setback and an 8' variance to the side
yard setback for a garage addition as proposed in planning Case #09 -35 is hereby approved with the
j following findings of fact:
1. The placement of the home and narrow property width create a hardship in putting the property
to a reasonable use if the strict standards of the Ordinance are applied.
2. The expanded garage is needed to meet the minimum square footage for attached garages, as well
as to provide access for two vehicles and to fulfill storage needs, both being reasonable uses of a
property.
3. There is no practical way to access the kitchen without a variance.
4. The existing home, location on the lot and setback from the street are unique conditions to the
property.
5. The unique circumstance of the property is not caused by the property owner.
6. The application of the string rule creates a hardship.
7. The hardship is not solely economic in nature.
8. This appears to be the most reasonable alternative for garage /storage expansion.
9. The construction project is in harmony with the essential character of the neighborhood.
10. The application is consistent with the comprehensive plan.
