1987-06-23 Planning Comm MinutesPage 1 June 23, 198� CITY OF MENDOTA HEIGHTS PLANNING COMMISSION MINUTES The regular meeting of the Mendota Heights Planning Commission was held on Tuesday, June 23, 1987, in the City Council Chambers. Chairman Morson called the meeting to order at '7:32 o'clock P.M. Th.e following members were present: Morson, Anderson, Burke, Duggan, Krebsbach and McMonigal. Commissioner Henning had advised the Commission that he would be unable to attend. CASE NO. 87-13, Chairman Morson called the meeting to MASTEL, CUP for order for the purpose of a public hearing FENCE, HEARING to consider an application from Charles Mastel, 1341 Cherry Hill Road, to allow installation of a six foot red cedar fence 34 feet west of the center line of Wachtler Road, and six inches within his property line. Mr. Mastel noted that he has a double frontage lot and most of the other property owners in the area have a 33 foot easement from the center of the roadway, but that the rear of his property has a 50 foot easement from the center of Wachtler. fie also noted that the lot is eight feet below Wachtler and the fence would be installed around the newly constructed swimming pool in the rear yard. Mrs. Mastel noted that the existing bushes will be located inside the proposed fence, in the same location as the previously existing fence and that the new fence would extend around the entire perimeter of their back yard. Chairman Morson asked for questions or comments from the audience. There being no questions or comments, Commissioner Duggan moved to close the public hearing at 7:43 P.M. Commissioner Duggan moved to recommend approval of the conditional use permit as requested with the following requirements: 1. That there be a written agreement with Dakota County in relationship to the County and their required right-of-way for Wachtler. 2. That the fence be a six foot red cedar fence. 3. That a more accurate drawing be submitted ta the City Council for their consideration prior to the next meeting an July 7, indicating the location of the fence as close as possible to where it will be placed. Commissioner Krebsbach seconded the motion. Ayes: 6 Nays: 0 CASE NO. 87-14, Mr. Paul Joyce, 1625 Delaware Avenue, was JOYCE, SUBDIV- present to explain his proposal for a ISION simple lot division of Lot 1, Wallner-Joyce Estates, which exceeds the minimum requirements for lots in the R-1A district. Mr. and Mrs. Chadima, purchasers of the newly created lot and their builder, were present for the discussion. A question was raised regarding utilities to the new lot and Public Works Director Danielson noted that there is no Mendota Heights sewer in the area, and West St. Paul's sewer is 800+ feet south of Wentworth along Delaware. A tank and drainfield would be ins�alled to serve the new home. It was noted that the proposed new home would be 18 feet from the north and south side lot lines and would require a 2.1' variance on each side as well as a 20% variance for the lot depth. Planner Dahlgren suggested that the Commission could act on the variances at Page 3 June 23, 1987 this meeting, since there is no hearing requirement for a variance. Mrs. Alice Bradford, 1673 Delaware, neighbor to the south of Mr. Joyce, expressed her concern over placement of the telephone lines, but noted that she had no problems with granting approval of the variances as requested. Mr. Chadima noted that he would have no problem with either Mr. Joyce or Mrs. Bradford's telephone lines being buried on his property and that he would give them a written agreement granting an easement for such placement if needed. Commissioner Krebsbach moved to recommend approval of the subdivision on the condition that the appropriate variances be applied for, those being a 2.1' sideyard variance, a 26.7 foot rearyard variance, and that appropriate arrangements be made for installation of all utilities. Commissioner Duggan seconded the motion. Ayes: 6 Nays: 0 CASE NO. 87-15, Mr. Richard Edinger was present to request EDINGER, VARIANCE a four foot front yard variance for a garage at 594 Pond View Drive, Lot 8, Block 5, Copperfield II. He presented letters of approval from two of his neighbors. The reason for the variance request is because the garage parking spaces were made too shallow for adequate parking of vehicles. Commissioner Duggan moved to recommend approval of a 4 foot front yard variance as requested to allow the garage to be 26'from the front property line of Lot 8, Block 5, Copperfield II. Commissioner McMonigal seconded the motion. Ayes: 6 Nays: 0 CASE NO. 87-16, Mr. Carl Thompson, builder representing THOMPSON, Jim Loving, owner of Lot 6, Block 3, Delaware Crossing, was present ta request a 20 foot variance for 672 Cheyenne Lane, which is a corner lot. Planner Dahlgren noted that the front of l the lot is considered the dimension on a corner lot, for the 20 foot variance. Page 4 June 23, 1987 narrowest thus the need Mr. Thompson submitted signatures of adjacent neighbors in favor of the proposed variance. Commissioner McMonigal moved to recommend approval of a 20 foot variance for the address as requested, to allow placement of the house 10 feet at the opposite end of the technical lot front. Commissioner Burke offered a friendly amendment to the motion by recommending that a more accurate drawing be submitted to the City Council showing the location of the northwest corner. Commissioner Burke seconded the original motion. Ayes: 6 Nays: 0 VERBAL REVIEW Public Works Director Danielson gave a verbal review of the Anderson subdivision, Olsen CAO variance, Stalder lot division, and Nonnemacher wetlands permit that had been before the City Council. MISCELLANEOUS Planner Dahlgren advised the Commission on various projects proposed for Mendota Heights. ADJOURN There being no further business to come before the Commission, Commissioner Duggan moved that the meeting be adjourned. Commissioner Anderson seconded the motion.
