1992-09-29 Planning Comm MinutesCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA Minutes of the Joint City Council/Planning Commission Workshop Held Tuesday, September 29, 1992 Pursuant to due call and notice thereof, the Joint City Council/Planning Commission Workshop, City of Mendota Heights, was held at 7:30 o'clock P.M. at City Hall, 1101 Victoria Curve, Mendota Heights, Minnesota. Mayor Mertensotto called the meeting to order at 7:35 o'clock P.M. The following members were present: Mayor Mertensotto, Councilmembers Smith, Blesener and Koch. The following Planning Commissioners were present: Dwyer, Koll, Duggan, Tilsen and Krebsbach. Councilmember Cummins was excused. Planning Commissioners Dreelan and Friel were excused. The following City staff members were present: Tom Lawell, City Administrator, Jim Danielson Public Works Director, Kevin Batchelder, Administrative Assistant and John Uban, Planning Consultant. Mr. Tim Cutting of 2141 Aztec Lane was also present. INTRODUCTION City Administrator Lawell highlighted the agenda to members of the workshop. Administrator Lawell stated the City has conducted on going teambuilding sessions between the City Council and each Commission, however this year the City Council desired a more issued oriented workshop with each individual Commission. Mr. Lawell stated the purpose of the workshop was to discuss issues and to provide background information to both the City Council and Planning Commission. He stated any policy decisions would have to be scheduled for official City Council meetings on a future agenda. DISCUSSION ON PRESERVATION OF LARGE LAND TRACTS/UPDATE ON REMAINING VACANT LAND IN MENDOTA HEIGHTS Administrative Assistant Batchelder provided an overview of the vacant land inventory in Mendota Heights. Batchelder reviewed a color coded map showing all vacant and open space lands in Mendota Heights. Batchelder reported on 22 undeveloped parcels in Mendota Heights that are privately owned lands. Included in the discussion of undeveloped parcels was a discussion on the Superblock area. Planning Commission Chair Dwyer inquired about the current application on a ten acre parcel for Planned Unit Development for three homes in the Superblock area on Wentworth Avenue. Consensus was September 29, 1992 Page 3 A survey of City residents was discussed by the Council and Commission. The Council and Commission directed staff to bring a proposal for a survey on the downtown issue at their second meeting in October. Mr. Cutting of 2141 Aztec Lane stated he feels the intersection works fine and the City should preserve the land in the right -of -way behind the homes in Friendly Hills. Mr. Cutting stated that he doesn't see that safety is an issue and that any new roadways are not needed at this time. COMPREHENSIVE PLAN REVIEW The Council and Commission reviewed the Comprehensive Plan for the portion of the Southeast area that includes the Tousignant and Visitation properties. DEVELOPMENT OPTIONS FOR HIGHWAY 55 AND HIGHWAY 110 The Council and Commission briefly reviewed the Highway 55 plan and possible land uses on the Highway 55 and Highway 110 corridor. Due to the upcoming State roadway improvement project in the area, development interest will likely increase in the near future. HOUSEKEEPING VARIANCES The Council and Commission briefly discussed housekeeping variances and the need to process each and every example where owners of nonconforming residential structures are requesting building permits. The participants generally agreed that the existing ordinance language related to this topic is adequate as written. Respectfully submitted, Kevin Batchelder Administrative Assistant CITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA PLANNING COMMISSION SEPTEMBER 22, 1992 The regular meeting of the Mendota Heights Planning Commission was held on Tuesday, September 22, 1992, in the City Hall Council Chambers, 1101 Victoria Curve. The meeting was called to order at 7:30 o'clock P.M. The following members were present: Koll, Dreelan, Dwyer, Krebsbach, Duggan and Tilsen. Commissioner Friel was excused. Also present were Public Works Director Jim Danielson, Planning Consultant John Uban, Administrative Assistant Kevin Batchelder and Senior Secretary Kim Blaeser. APPROVAL OF MINUTES Commissioner Duggan moved approval of the August 25, 1992, Minutes. Commissioner Koll seconded the motion. AYES: 6 NAYS: 0 CONTINUED HEARING CASE NO. 92-23: THARALDSON DEVELOPMENT CUP, SUBDIVISION AND VARIANCES Chair Dwyer explained that Tharaldson Development Company is proposing to construct a hotel within the Industrial Park immediately east of the Marriott Courtyard. He explained the hotel will be used exclusively by Northwest Airlines employees under a ten year private contract with Agorthwest Airlines. Mr. Ken Scheel, representing Tharaldson Development Company, stated he had received the Planner's Report and based on that report, the plans for the hotel have been revised. Mr. Scheel presented the Planning Commission and staff Plan A and Plan B. Mr. Scheel explained Plan A depicts a 120 unit motel and that it addresses the concerns as stated in the Planner's report of September 22, 1992. He explained, as noted in the Planner's report, that they have been able to accommodate the required 10 foot setback for both the driveway and turn-around. He stated the need for a variance has been eliminated. Mr. Scheel stated that four parking spots have been eliminated. Mr. Scheel explained that Tharaldson Development will work with the City's Engineering Department in preparing plans for a controlled outflow storm ponding site. Mr. Scheel explained that the proposed turn - around by the front entrance has a thirty foot (30') radius to accommodate turn - arounds and the type of traffic anticipated at the motel. He stated the thirty foot (30 °) radius would be sufficient. He stated they could change the turn - around radius to thirty -five feet (35') but then a five foot (5') variance to the rear property line would be needed. Mr. Scheel stated that both Plan A and B include a sidewalk bordering the parking lot as suggested by the Planning Consultant. Mr. Scheel explained the north and south building entrances and that they would be secured by utilizing an electronic card system. He stated each guest would be given an electronic card and that the hotel industry utilizes this type of system to help secure their buildings. Mr. Scheel stated a landscape plan will be submitted noting landscaping, lighting and storm water ponding. He further stated a site plan will be submitted, as required by the Subdivision Ordinance, showing all buildings within 350 feet of the proposed motel. In response to a question from Commissioner Krebsbach, Mr. Scheel introduced Mr. George Burkards, of United Properties. In response to a question from Commissioner Krebsbach, Mr. Burkards stated they are satisfied with the placement of the proposed hotel as it will sit parallel to the Marriott Courtyard. He stated the Marriott representatives are comfortable with the proposal as submitted by Tharaldson Development. Mr. Scheel stated if the motel becomes open to the public, the motel will be known as the Marriott Fairfield which is the largest franchise within the Marriott Corporation. Mr. Scheel explained that Plan B shows the motel to consist of 114 units, which was reduced from Plan A, and that the Plan accommodates a turnaround. Commissioner Tilsen noted the comments as submitted by the City's Fire Marshal. Commissioner Tilsen stated the Fire Marshal noted a concern for turnaround capacity. Chair Dwyer questioned why additional land could not be added to the proposal. Mr. Scheel responded the owners do not want to sell the land. He stated there is more square footage per unit than a typical hotel. In response to a question from Chair Dwyer, Planner Uban stated with the plans submitted the perimeter setbacks have been redesigned. He further stated drainage calculations need to be submitted. Mr. Scheel stated the site can retain water on site and that they would do underground piping with control outflow if necessary. He stated they would prepare the appropriate calculations and submit the information to the City Council. Chair Dwyer commented that it seems the Planning Commission is being pressed into making a recommendation based on Plans just submitted at the meeting tonight. Mr. Scheel responded that they would like to begin construction by the end of October. Mr. Scheel stated that the only questions that need to be answered are regarding the proposed lighting and storm water ponding. Chair Dwyer stated questions need to be answered regarding the Fire Marshal's concerns related to a turnaround road and compliance with State Fire Codes, Mr. Scheel stated if a turnaround is needed, they will need to intrude on setback. Commissioner Duggan stated he is inclined to recommend approval based on the facts that Tharaldson Development is willing to abide by City and State Building and Fire Codes and they have dropped the number of units within the motel based on staff and planner suggestions. In response to a question from Commissioner Duggan regarding parking, Mr. Scheel stated the motel would run at roughly 92 percent occupancy. He stated that the initial parking will be for mainly mini vans and once open to the public, the parking will be expanded. In response to a question from Commissioner Duggan regarding drainage, Public Works Director Danielson explained the runoff flows to the north and that City staff will work with Tharaldson Development in preparing an accurate storm water ponding. He stated storm water ponding is a critical issue within the Mendota Heights Business Park. Commissioner Duggan noted his concerns for such a long building and the amount of exits. He further questioned if there is proper egress in fire emergencies. Public Works Director Danielson stated Tharaldson will have to meet the very strict fire code - Appendix E - which the City has adopted. Commissioner Duggan questioned if there will be proper sound insulation. Mr. Scheel stated that Tharaldson Development excels in sound attenuation. He stated their normal sound attenuation construction exceeds most requirements. Commissioner Duggan questioned if provisions will be made for small cooking units. Mr. Scheel responded no, but that they cannot stop people bringing small hot plates. He stated there will be no kitchen facilities available. He stated small microwave ovens and refrigerators will be available in the rooms and that cold breakfasts will be brought in for each guest. Commissioner Duggan questioned if financing had been AYES: 6 NAYS: 0 arranged for the project. Mr. Scheel responded that Mr. Tharaldson has never been turned down for financing. In response to a question from Commissioner Duggan, Mr. Scheel stated they are not pursueing Tax Increment Financing. Commissioner Krebsbach noted the Fairfield Inn in Kansas City had decks. Mr. Scheel responded by submitting a picture of the proposed Heritage Inn. He stated that interior corridors are preferred. He stated that this particular motel would be considered a "top end" budget motel. He stated the Residence, Courtyard and Fairfields Inns are all Marriott products. In response to a question from Commissioner Dreelan, Mr.. Scheel stated the exterior will be stucco similar to the Marriott's exterior. Mr. Scheel explained the color of the motel will be peach -tan with white accents. He stated the roof will be blue shingled with raised accent bands. Commissioner Dreelan further stated her concerns of one way in and one way out accesses. Chair Dwyer opened the meeting to the public. There was no one present to discuss this matter. Mr. Burkhards stated the Mendota Heights Business Park is controlled by United Properties's review and approval. Commissioner Krebsbach moved to close the public hearing. Commissioner Duggan seconded the motion. Chair Dwyer noted his concern for recommending approval based on the lack of time the Commission has had in reviewing the revised plans as submitted tonight. Commissioner Tilsen concurred with Chair Dwyer stating he is not in favor of cursory approval on such a constrained site. Commissioner Krebsbach moved to continue the public hearing to October 27, 1992. Chair Dwyer seconded the motion. AYES: 3 NAYS: 3, KOLL, DUGGAN, DREELAN MOTION FAILS The Planning Commission discussed the fact that no variances will be needed should they recommend approval to the City Council on Plan B. Planner Uban stated a 1 sign setback variance will be needed and a variance to parking. Mr. Scheel stated the motel will remain a Marriott Fairfield should the Northwest Airlines contract dissolve. Mr. Burkhards stated they have selected the Marriott franchise because it is the best hotel that is in business today. Commissioner Dreelan moved to recommend that City Council approve a 114 unit hotel as shown on Plan B dated July 1992 and revised September 22, 1992, with the following conditions: 1. That a storm water pond be designed to accommodate the City's storm water needs in the area as approved by the City's Engineering Department. 2. That a landscape plan be submitted that is adjusted for the revised site plan known as Plan B. 3. That the site development plan address Section 5.6(2)b2 of the Zoning Ordinance locating all buildings within 350 feet. 4. That a lighting plan be submitted. 5. That all fire codes are satisfied and that an emergency vehicle turnaround be provided at the south end of the parking lot. 6. That Plan B be revised so that no variances are necessary (with the exception of a 20 foot setback variance for the sign in accordance with the Mendota Heights Business Park Sign Policy). 7. That a sign plan be submitted. Commissioner Duggan seconded the motion. AYES: 4 NAYS: 2, KREBSBACH, TILSEN HEARING: CASE NO. MILAVETZ WETLANDS Commissioner Krebsbach stated she would like to see a larger lot created and Commissioner Tilsen stated not all questions had been answered from the original Planner's Report. 92-28: PERMIT Ms. Bonnie Resnick and Mr. Alan Milavetz, of 2251 Copperfield Drive, were present to discuss their request for a Wetlands Permit to allow the construction of a four foot (4') high fence within 100 feet of a wetland. Ms. Resnick explained they have two sons who will be using their backyard to play in. She explained that for safety reasons, while their children are young, they would like to construct a fence. She stated they have spent a lot of time in trying to comply with the City's Ordinance. Ms. Resnick explained that their plan retains approximately thirty-five fee of wetlands area. Ms. Resnick stated they are proposing to construct a fence that will complement and blend in with the wetlands area and their new home. She explained that they are planning to construct a semi-transparent design using cedar pickets. Ms. Resnick stated there are other structures sitting near the wetlands in the area. She further stated that they are not trying to prevent access across their yard, but only trying to create a safe environment for their children. She stated neighbors are welcome. Chair Dwyer stated he lives at 558 Stone Road which is located within the Copperfield neighborhood. He stated that he does not like fences, but the City has granted several permits for fences. He stated he is inclined to vote positively. He reviewed the precedent set by Mr. Ultan Duggan in constructing his wrought iron fence along the pond a year ago. He stated that Mr. Duggan's fence is tucked into his grade. He questioned if the proposed fence would be obtrusive. Ms. Resnick responded the fence will be lower to the ground and it will slope. Ms. Resnick explained they would like to construct the fence now while their home is being constructed because they want to be comfortable and feel a sense of safety for their children when they move into the home. Ms. Resnick stated she and her children spend a great deal of time at home. She stated that parents can only educate their children so much in water safety. She stated parents have only so much control. She explained that they are very cautious parents and there should be no reason why they should wait for an accident to happen. Commissioner Tilsen stated the spindle fence is designed dangerously in that there are 2" gaps in fences. He stated children could get their heads stuck, etc. Ms. Resnick responded that if there are codes they need to comply with in spacing of the spindles they will do so. She stated the design of the fence is not critical. Ms. Resnick showed the Planning Commission a picture of the proposed fence. She stated they felt the natural effect of the fence would blend in well with the brush. Commissioner Duggan inquired if public hearing notices had been sent to all property owners within 350 feet. Chair Dwyer stated yes they had and that he had received one. Commissioner Duggan stated children can climb fences. He further stated he does not want to see the pond completely surrounded with fences. He stated he is against the idea for using fences as a means of safety for children. Commissioner Duggan inquired as to the placement of the fence. Commissioner Duggan stated he does not have a problem with this fence request. Commissioner Krebsbach inquired if there is an easement around the pond. She stated there seems to be a neighborhood concern. Public Works Director Danielson stated there is a scenic easement around the pond, but no access easement. Commissioner Krebsbach questioned with the construction of the fence, would it create a problem for the neighborhood to walk around the pond. Mr. Milavetz responded there would be room to walk between the fence and pond. He stated they intend to leave that area natural. Commissioner Krebsbach questioned if neighboring families would be able to see through the fence should their children be behind it. Ms. Resnick responded they chose this type of fence because it presents a more open environment. Commissioner Krebsbach stated she has concerns with fences and that she prefers to see more of an open space environment. She further commented on the Ultan Duggan precedent which was set in the Copperfield neighborhood. Chair Dwyer further commented on the fences constructed along ponds in adjoining neighborhoods of Copperfield. Ms. Resnick pointed out that they are allowed to construct a fence on their property but because they chose to construct a fence within 100 feet of the designated wetlands, they need to request a Wetlands Permit. She explained there are other structures constructed within 100 feet of the wetlands. Commissioner Koll stated the proposed fence is opaque but not transparent. Ms. Resnick stated they would be happy to discuss different types of fencing. Chair Dwyer opened the meeting to the public. Ms. Susan Siegfried, 575 Pond View Drive, stated she was present representing some Copperfield neighbors. She explained it is nice to see their children be able to move through neighboring yards. She stated there is natural vegetation due to the scenic easement and fences serve as a real hinderance. She stated she enjoys unobstructive open spaces. She presented the Planning Commission with 22 signatures of residents around the Copperfield Drive and Field Stone Road area who are asking the Milavetz's to withdraw their request for a Wetlands Permit. Chair Dwyer accepted the petition as presented. Dr. Flynn, 2261 Copperfield Drive, stated he enjoys the scenic nature of the pond and that he is opposed to any structures near the pond. A resident of Copperfield stated he was under the impression when he moved into the area that absolutely no fences were allowed. Mr. Milavetz responded that the Copperfield Architectural Control Committee reviewed their proposed fence and approved it based on the covenants of Copperfield. Chair Dwyer stated the Planning Commission's charge is to abide by City Ordinances. Mr. Paul Dorn, Stone Road, stated that the Milavetz's concern for the safety of their children should be respected. He stated that this issue has been an emotional one for the Milavetz's. Commissioner Krebsbach inquired if the Milavetz's would move the fence further onto their property so the children in the neighborhood would have more room to walk. Mr. Milavetz stated they had taken into consideration the walkway area and that is why they did not place the fence closer to the wetlands. He stated there would be no problem in moving the fence further in. Commissioner Duggan stated the proposed placement of the fence is already at 40 feet and 33 feet at each corner respectively from the high water mark. Ms. Resnick stated she is looking forward to having good relations with her neighbors. She stated that she has a right to build a fence. Commissioner Krebsbach moved to close the public hearing. Commissioner Dreelan seconded the motion. AYES: 6 NAYS: 0 Commissioner Duggan moved to recommend that the City Council grant a Wetlands Permit to allow the construction of a fence within 40 and 33 feet of the wetlands. Commissioner Dreelan seconded the motion. AYES: 3 NAYS: 3 KOLL, KREBSBACH, TILSEN MOTION FAILS Commissioner Duggan stated that the proposed fence is not anymore obtrusive than his wetlands permit request for a fence. He stated he has some concerns with the Commission's stance on this issue. Commissioner Krebsbach stated there is not enough access through the backyards and she would like to address the neighborhood's concerns. She stated she would like to review this issue more. She stated she would vote in support of the Wetlands Permit if the fence were moved in further on the property. Mr. Milavetz stated that this type of requirement is not within the Ordinance and inquired what standing the City had in requiring this condition. Commissioner Duggan inquired if Commissioner Krebsbach had visited the site, Commissioner Krebsbach responded she had not. Mr. Milavetz stated he would be willing, in order to build the fence, to reduce the length of the fence four feet (4') . He stated he does not want to cut his yard in half. Commissioner Duggan moved to recommend that City Council grant a Wetlands Permit with a condition that a four foot (4') walkway between the fence and scenic easement be provided and maintained by the Milavetz's. Commissioner Koll seconded the motion. AYES: 6 NAYS: 0 CASE NO. 92 -29: R AND R CONSTRUCTION - WETLANDS PERMIT Mr. Roger Riley of R and R Construction was present representing the homeowners of 669 Laura Court to request a Wetlands Permit to allow the construction of a deck. Mr. Riley explained the property on Laura Court is along Ivy Falls Creek. He stated the original deck was constructed in 1976 and the homeowners are proposing to replace the existing deck. He explained the deck is proposed to be built with the same design as the deck built 15 years ago. Chair Dwyer stated the applicant has received signatures of consent from the surrounding property owners. Chair Dwyer moved to waive the public hearing. Commissioner Duggan seconded the motion. AYES: 6 NAYS: 0 Commissioner Koll moved to recommend that the City Council grant the requested Wetlands Permit. Commissioner Duggan seconded the motion. AYES: 6 NAYS: 0 CASE NO. 92 -30: ROYAL REDEEMER LUTHERAN CHURCH - VARIANCE AYES: 6 NAYS: 0 Mr. Tom Andrews, property commissioner representing Royal Redeemer Lutheran Church, was present to discuss their request for a variance for a front yard setback to allow the construction of a 48 inch high fence. Mr. Andrews explained the Pastor of Royal Redeemer is interested in securing the front yard area as a safe environment for children. He stated the fence had recently been donated to the Church. Mr. Andrews stated he had read the Planner's Report and that they would be willing to comply with the Planner's suggestions regarding landscaping, placement of the fence and painting of the fence. Chair Dwyer stated that Mr. Andrews had received signatures of consent from property owners within 100 feet of Royal Redeemer Lutheran Church. Chair Dwyer moved to exempt the applicant from the requirement of the public hearing. Commissioner Koll seconded the motion. Commissioner Duggan moved to recommend that the City Council grant the requested variance with the following conditions: 1. Landscaping of fence perimeter 2. Moving the fence to a diagonal paralleling Victoria Road to remove the corner of the fence that penetrates into the setback area. 3. As the donated fence has been previously used and shows signs of rust, the fence should be painted black to improve its appearance. Commissioner Koll seconded the motion. AYES: 6 NAYS: 0 PRE-APPLICATION DISCUSSION CASE NO. 92-31: MAZARRA - SOMERSET PLACE PUD Mr. Gerald Mazarra representing the owners and buyers of a 10 acre parcel located within what is known as the Superbiock Area in Mendota Heights was present for a pre- application discussion regarding the possibility of subdividing this parcel of land into three single family lots of approximately 1-2/3 to 2-1/4 acres in size with a common outlot encompassing the wetland areas. Mr. Mazarra stated this parcel of land is located across Wentworth Avenue from the Somerset Country Club Golf Course. He stated it is a unique parcel of land in that there is much vegetation and wetlands located on the property. He stated both the owners and buyers are very concerned in developing this parcel of land with great sensitivity and that is why they are pursuing this development as a Planned Unit Development. He explained they would like to pursue a development with three building sites. Mr. Mazarra presented the Planning Commission with a concept plan and explained the building sites may change. He stated only the buildings sites will be disturbed and the balance of the lots will be undisturbed other than the area where septic will be installed. He further stated that restrictive convenants will be enforced for this area. Mr. Mazarra explained several ways of access to the properties. He stated there could be a cul-de-sac or a large loop which would meet City Ordinance requirements. Commissioner Tilsen commended Mr. Mazarra on the idea of constructing three lots. He stated this idea will blend in well with the existing terrain. Commissioner Tilsen stated with the wetlands located on the property, it may not be a good idea for septic systems and drainfields to be constructed. He inquired as to where the sewer and water are located in that area. Public Works Director Danielson stated the utilities would be through Ridgewood Drive which is some distance south of this site. He stated it would be well into the future before the utilities are brought into this area. Mr. Mazarra stated Dakota County requires 3,000 to 10,000 square feet for septic drainfields per lot. Commissioner Duggan commended Mr. Mazarra on his proposed plan. He inquired as to the length of private roads and cul -de -sacs. He further stated the turn- around proposed is 420' in length. He inquired as to the wetlands outlots if they would be owned in common. He further stated his concerns for the wetlands and proposed septic systems. He stated he would like to see water brought to this area. He stated he is concerned with moving a substantial amount of large trees. Mr. Mazarra stated he has removed trees with a 90 percent success rate. In response to a question from Commissioner Duggan, Mr. Mazarra stated he has three buyers interested in the proposed sites. Commissioner Krebsbach questioned if the Fire Marshal has seen the plans. She stated her concerns for fire access. She further stated the surrounding neighbors should be given an opportunity to review the plans and discuss their ideas for developing their own land in conjunction with Mr. Mazarra's proposal. Mr. Mazarra stated there is an urgency in moving this proposal through. Commissioner Dreelan noted her concern for people developing the outer edge of the Superblock Area and thereby enclosing the inner portion of the Superblock Area. She stated she is not comfortable in landlocking the lots to the south. She stated this would be a good time for Superblock planning. Commissioner Koll concurred with Commissioner Dreelan. She further stated she had talked to the Strub family and they like septic and well in the area. She stated they would be absolutely opposed to City sewer and water. She further stated Somerset Country Club would be opposed due the to City sewer and water expense of installing sewer and water. Commissioner Tilsen stated they may not be able to install septic on this property due to the wetlands. He stated Mr. Mazarra could look into developing two lots instead of three. Chair Dwyer stated the consensus of the Planning Commission is the proposed development is a good plan and the Planned Unit Development will work well. Commissioner Duggan suggested that Mr. Mazarra discuss his proposal with surrounding homeowners. Commissioner Koll moved that the Planning Commission looks favorably on the proposed development and that Mr. Mazarra should arrange a meeting with property owners prior to the Planned Unit Development public hearing before the Planning Commission. Commissioner Duggan seconded the motion. AYES: 6 NAYS: 0 VERBAL REVIEW Public Works Director Danielson provided a verbal review for the planning items at the previous City Council meeting. ADJOURNMENT There being no further business, the Planning Commission adjourned its meeting to September 29, 1992 Joint City Council/Planning Commission Workshop beginning at 7:30 o'clock P.M., at 10:35 o'clock P.M.
