Res 2013- 49 CAP 1831 Hunter Ln Patio Installfor recording CITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 2013-49 A RESOLUTION APPROVING A CRITICAL AREA PERMIT FOR A DECK REMOVAL AND PATIO INSTALLATION AT 1831 HUNTER LANE WHEREAS, Mary Magnuson has applied for a Critical Area Permit to remove an existing deck and install a patio at 1831 Hunter Lane [PIN: 27-57200-10-10, Lot 1, Block 1, Phillips Hill Addition] as proposed in Planning Case 2013-11; and WHEREAS, the Mendota Heights City Code Title 12, Chapter 3 allows minor developments for single-family dwellings to be forwarded to city council without planning commission review; and WHEREAS, the city staff recognizes the planning application to be a minor development and/or change to a single family dwelling; and WHEREAS, staff recommends approval of the critical area permit as outlined in the planning application. NOW THEREFORE BE IT RESOLVED, by the Mendota Heights City Council that a critical area permit as proposed in planning case 2013-11 is hereby approved with the following findings of fact: 1. The proposed alteration will be compliant with city code. 2. The proposed project creates no new visual impact to those viewing from the river. 3. The project includes no changes to existing slopes or site grading. 4. The project is compliant with all setback requirements. 5. The project does not expand the enclosed area of the principal structure. 6. The project does not increase the height of the principal structure. Adopted by the City Council of the City of Mendota Heights this sixteenth day of July, 2013.
