2004-10-26 Planning Comm MinutesPlanning Commission Meeting October 26, 2004 CITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA PLANNING COMMISSION MINUTES October 26, 2004 The regular meeting of the Mendota Heights Planning Commission was held on Tuesday, October 26, 2004 in the Council Chambers at City Hall, 1101 Victoria Curve at 7:30 pm. The following Commissioners were present: Chair Lorberbaum, Commissioners B. McManus, Miller, Betlej, Dolan, and M. McManus. Those excused: Commissioner Hesse. City Staff present were City Engineer Sue McDermott and Administrative Assistant Patrick C. Hollister. Also present was Planner Steve Grittman. Minutes were recorded by Becki Shaffer. Approval of September 28, 2004 Minutes COMMISSIONER B. MCMANUS, SECONDED BY COMMISSIONER DOLAN, TO APPROVE THE MINUTES OF SEPTEMBER 28, 2004 AS PRESENTED. AYES NAYS ABSTENTION (Commissioners M. McManus) MOTION CARRIED Further Discussion Commission Betlej made the following minor corrections: Page 4, 6th paragraph should read: "Commissioner Betlej asked if the Planning Commission could make a finding that a wetlands permit is not necessary at this time? Commissioner Betlej said the Planning Commission could make the suggestion to the applicant to be wary of any encroachment to the buffer of the wetland during construction. Chair Lorberbaum said it would also be recommended that the City refund any permit fees to the applicant. Mr. Grittman expressed his concern that the applicant may still inadvertently go into the wetland buffer and may still need to keep the permit." Page 5, 6th paragraph should read: "Commissioner Betlej suggested that the applicant could simply stake out the buffer area and that the applicant, during the process of construction of the home would not go beyond that line, and it would result in no need for a wetland permit. Commissioner Betlej said that the applicant will probably have to come back to the Planning Commission with the grading plans after all the final drawings are completed." McManus) MOTION CARRIED Planning Commission Meeting October 26, 2004 HEARINGS PLANNING CASE #04 -41 McDonalds Restaurant 2020 Dodd Road Conditional Use Permit Amendment Mr. Grittman introduced the case requesting an amendment for a conditional use permit for McDonalds Restaurant, located at the corner of Highway 110 and Dodd Road. Mr. Grittman reviewed the plans for construction of an attached cash booth to the restaurant. Construction of the new cash booth would result in the elimination of the current remote cash booth. Mr. Grittman said the rest of the site will remain unchanged. Mr. Grittman said the applicant will be providing a revised site plan for the Planning Commission's review at this time. Ms. Jane McKay, owner and operator of McDonalds Restaurant provided pictures of the building and explained how the building will look after the construction. Ms. McKay said the menu sign would remain and there would be an addition of a new speaker box. The speaker box would be approximately 53" in height and 26" in width and will be located in front of the existing menu sign. Ms. McKay said the circulation pattern (for the cars) will remain the same. Chair Lorberbaum asked Mr. Grittman if there were any concerns about additional signage. Mr. Grittman said the order board is not technically considered a sign, but is needed as a menu for operational use. Commissioner Betlej asked the applicant to explain how the speaker box will be located in relation to the order board. Commissioner B. McManus asked the applicant why she is proposing to make these changes. Ms. McKay said it was a security issue for the employees. Chair Lorberbaum opened the public hearing. Mr. Tim McMayas, a resident who lives across the highway from the McDonalds, expressed his concerns for trees that were removed from the site and asked if they would be replaced. Staff determined that it was unknown if the original conditional use permit required any replantings of trees. Ms. McKay said the trees were on her property, and they were removed due to disease. Staff will look into this issue and have an answer for the next City Council meeting. Seeing no one else come forward wishing to speak, Chair Lorberbaum asked for a motion to close the public hearing. COMMISSIONER BETLEJ MOVED, SECONDED BY COMMISSIONER MILLER, TO CLOSE THE PUBLIC HEARING. 6 AYES 0 NAYS MOTION CARRIED Chair Lorberbaum closed the public hearing. COMMISSIONER M. MCMANUS MOVED, SECONDED BY COMMISSIONER B. MCMANUS, TO RECOMMEND APPROVAL OF THE CONDITIONAL USE PERMIT AMENDMENT AS PRESENTED SUBJECT TO THE FOLLOWING CONDITIONS: 1) The colors of the cash booth addition are consistent with those of the existing building. 2) The submitted site plan be modified to illustrate the proposed customer order display sign location. 3) The site plan be modified to illustrate the location of the existing cash booth and specify any restoration of the site following removal. Planning Commission Meeting October 26, 2004 4) Information be provided to the City Council regarding the original conditional use permit requirements as it relates to tree removal / tree replacement, and that the applicant provide appropriate landscaping to screen the restaurant from residents. AYES NAYS MOTION CARRIED VERBAL REVIEW— Sue McDermott PLANNING CASE #04 -38 Jeff Closemore, 1527 Vandall St. Conditional Use Permit and Wetlands Permit Approved as recommended by the Planning Commission PLANNING CASE #04 -39 Paul Wild, 813 Hazel Court Wetland Permit Approved as recommended by the Planning Commission PLANNING CASE #04 -40 R. H. Shaw, 999 Wagon Wheel Trail Wetland Permit City Council determined that a wetland permit was not needed. PLANNING CASE #04-41 Somerset Country Club, 1416 Dodd Road Conditional Use Permit, Wetland City Council approved as recommended; and Permit, Variances approved the height variance that the Planning Commission recommended denial for. PLANNING CASE #04 -31 Paul Haggerty, 645 Sibley Memorial Highway Critical Area Permit, Variance Request Denied by City Council Chair Lorberbaum asked Mr.Hollister if there will be any cases scheduled for a December meeting. Mr. Hollister said there are none scheduled at this time. Chair Lorberbaum said that at this point, the Planning Commission will not be holding a meeting in December.
