1998-01-06 Council minutesPage No. 1 January 6, 1998 CITY OF MENDOTA HEIGHTS DAKOTA COUNTY STATE OF MINNESOTA Minutes of the Regular Meeting Held Tuesday, January 6, 1998 Pursuant to due call and notice thereof, the regular meeting of the City Council, City of Mendota Heights, Minnesota was held at 7:30 o'clock p.m. at City Hall, 1101 Victoria Curve, Mendota Heights, Minnesota. Mayor Mertensotto called the meeting to order at 7:30 o'clock P.M. The following members were present: Mayor Mertensotto, Councilmembers Huber, Koch, Krebsbach and Smith. Mayor Mertensotto and the City Council members presented awards to the following city employees in recognition of their years of service to the city: Leonard Kanitz, Kathleen Swanson, Jim Kilburg, George Lowe, Nancy Bauer, Dick Gill, Aaron Coates, Jim Perron and Kevin Perron. AGENDA ADOPTION Councilmember Koch moved adoption of the revised agenda for the meeting. Councilmember Krebsbach seconded the motion. Ayes: 5 Nays: 0 APPROVAL OF MINUTES Councilmember Koch moved approval of the minutes of the December 16, 1997 regular meeting. Councilmember Smith seconded the motion. Ayes: 5 Nays: 0 CONSENT CALENDAR Councilmember Smith moved approval of the consent calendar for the meeting, revised to move item i, accountant appointment, to the regulate agenda, along with authorization for execution of any necessary documents contained therein. a. Acknowledgement of the building activity report for December. b. Adoption of Resolution No. 98 -01, "RESOLUTION ESTABLISHING 1998 CITY DEPOSITORIES OF FUNDS." c. Adoption of Resolution No. 98 -02, "RESOLUTION ACCEPTING PLEDGED SECURITIES FOR 1998." d. Adoption of Resolution No. 98 -03, "A RESOLUTION DESIGNATING THE CIYT' S OFFICIAL Page No. 2 January 6, 1998 REPRESENTATIVES AND ALTERNATES ON THE METROPOLITAN AIRCRAFT SOUND ABATEMENT COUNCIL," appointing Councilmember Smith and Administrator Batchelder as MASAC representatives and Mayor Mertensotto and Scott Beatty as alternates. e. Authorization for the Mayor and City Clerk to execute an agreement with the City of St. Paul Water Utility regarding the Northland Land Company private water main. f. Approval to schedule the annual Board of Review meeting for 7:00 p.m. on April 21, 1998. g. Adoption of Resolution No. 98 -04, "A RESOLUTION GOVERNING THE APPROVAL OF ALL OUT OF STATE CONFERENCES AND OUT OF STATE TRAVEL." h. Acknowledgement of the minutes of the December 17 NDC -4 Commission meeting and the minutes of the December 29 Executive Committee meeting. i. Approval of the list of contractor licensed dated January 6, 1998. j. Approval of the List of Claims dated January 6, 1998 and totaling $ 145,143.26 Councilmember Koch seconded the motion. Ayes: 5 Nays: 0 ACTING MAYOR On the recommendation of Mayor Mertensotto, Councilmember Koch moved to appoint Councilmember Smith to serve as Acting Mayor during any absences of the Mayor in 1998. Councilmember Huber seconded the motion. Ayes: 4 Nays: 0 Abstain: 1 Smith OFFICIAL NEWSPAPER Council acknowledged a memo from the City Clerk regarding appointment of an official newspaper for 1998 along with letters from Lillie Suburban Newspapers and Minnesota Sun Publications. Mayor Mertensotto stated that there is no reason Council should not again appoint the Southwest Review as the official newspaper, particularly since they submitted the lowest initial rate. He Page No. 3 January 6, 1998 recommended that after action is taken on the appointment, Council consider giving the City Clerk the discretion to also use the Sun Current as an additional source of legal publication for notices of community interest and importance, such as notices regarding the comprehensive plan. Councilmember Smith moved to appoint the Southwest Review as the city's official newspaper for 1998. Councilmember Koch seconded the motion. Ayes: 5 Nays: 0 Counci]member Koch moved to grant the City Clerk discretionary authority to also use the Sun Current for legal notice publication on issues of community interest and importance, based on the rates quoted in the letter from the Sun Current publisher dated January 5, 1998. Councilmember Smith seconded the motion. Ayes: 5 Nays: 0 j AIR NOISE POLICY ZONES Council acknowledged a memo from Administrator Batchelder regarding the Metropolitan Council's response to the city's resolution which requested instructions and informational guidelines regarding a possible comprehensive plan amendment for proposed development at Resurrection Cemetery by Hoffman Homes. Administrator Batchelder reviewed the memo and the Metropolitan Council response. He informed Council that the Metropolitan Council stated in the letter that this type of development would be an incompatible land use in Noise Zone 3. Mayor Mertensotto stated that what the Metropolitan Council is saying is that it expects the city to follow the Aviation Development Guide when the city goes through its comprehensive plan update and must make sure that land uses in Zones 3 and 4 are consistent with the Guide. He felt that it would be appropriate to adopt a motion to designate the City Administrator to forward the Metropolitan Council response (from the Director of Community Development) to the legal counsel for Hoffman Homes since Council has authorized Hoffinan Homes to meet directly with Metropolitan Council representatives so that the Metropolitan Council would know exactly what the development proposal is. He further stated that Administrator Batchelder should inform Hoffman Homes that it appears that the Metropolitan Council is going to require that the city follow the guide plans that have been adopted for the continuing Page No. 4 January 6, 1998 development around the airport, which is in direct contrast to the proposal, and that he should ask for Hoffinan Homes comments on what they want to do. Councilmember Krebsbach stated that the Metropolitan Council arbitrarily extended Zone 3 even though there are already residences in the extended area. Administrator Batchelder explained that in 1993 the Metropolitan Council changed the contours but they did not provide the city with a map on where the zone lines would be until after they were adopted. Councilmember Krebsbach asked Administrator Batchelder if the change adversely affected residential properties that now exist in Zone 3. Administrator Batchelder responded that this is a very important issue which Mayor Mertensotto, Councilmember Smith and he have discussed with the Metropolitan Council. He stated that the LDN 65 contour has been moved east of Dodd Road and that even properties which were developed in the last five years are now incompatible. Councilmember Krebsbach stated that the affect on existing homes that are now in Zone 3 is a larger concern and secondarily there is concern on the impact it has on vacant land that could be developed. She stated that she does not know how the Metropolitan Council can take such an action without compensation to the property owners. Administrator Batchelder stated that the city needs to address that issue with the Metropolitan Council. Councilmember Smith stated that she finds a number of things disturbing with the letter. She felt that the Metropolitan Council intends to implement the noise zones whether or not the cities do. She further stated that she feels the noise zones are arbitrary and capricious and put noise were it should not be, and that the Metropolitan Council is completely constraining the city and giving the airport license to bring even more traffic over Mendota Heights. She stated that Council has a great deal of work to do and must do it quickly. She recommended forming a committee to deal with the issue and come up with a strategy so that the needs of the community are met. Mayor Mertensotto agreed, but stated that Council can deal with the issue when the comprehensive plan schedule is prepared. He Page No. 5 January 6, 1998 recommended that the immediate next step is forwarding the Metropolitan Council response to Hoffman Homes. Councilmember Huber moved to direct the City Administrator to forward the Metropolitan Council letter to Hoffman Homes and ask for its response and comments. Ayes: 5 Councilmember Smith seconded the motion. Nays: 0 RUNWAY SEPARATION Council acknowledged a memo from Administrator Batchelder regarding an initiative from the Northern Dakota County Airport Relations Coalition to request a variance form FAA procedures for the 15 degree parallel runway separation requirement. After discussion, it was the consensus not to support the effort at this time because there is no definitive information on what is being proposed or what affect the variance would have. WORKSHOP Council acknowledged a memo from Administrator Batchelder recommending a workshop on the police chief selection process. Councihnember Smith moved to schedule a Council workshop for 7:00 p.m. on January 13 for discussion of the police chief selection process. Ayes: 5 Councilmember Koch seconded the motion. Nays: 0 COUNCIL COMMENTS Mayor Mertensotto asked staff to look into the possibility of clearing areas on ponds for ice skating. ADJOURN Councilmember Smith moved to adjourn the meeting to closed session for discussion on labor negotiations. Councilmember Koch seconded the motion.
