1998-11-17 Council minutesMinutes of the Regular Meeting Held Tuesday, November 17, 1998 Pursuant to due call and notice thereof, the regular meeting of the City Council, City of Mendota Heights, Minnesota was held at 7:30 o'clock p.m. at City Hall, 1101 Victoria Curve, Mendota Heights, Minnesota. Mayor Mertensotto called the meeting to order at 7:30 o'clock p.m. The following members were present: Mayor Mertensotto, Councilmembers Dwyer, Huber, Krebsbach and Smith. AGENDA ADOPTION Councilmember Krebsbach moved adoption of the revised agenda for the meeting. Councilmember Smith seconded the motion. Ayes: 5 Nays: 0 CONSENT CALENDAR Councilmember Dwyer moved approval of the consent calendar for the meeting along with authorization for execution of any necessary documents contained herein. a. Approval of the List of Claims Councilmember Krebsbach seconded the motion. Ayes: 5 Nays: 0 PUBLIC COMMENT Mayor Mertensotto announced the Dakota County Board has identified a site in West St. Paul for the location of the Northern Service Center. Mayor Mertensotto expressed 1 appreciation to Commissioner Bataglia and the County Board for their efforts in making a decision based on significant locational criteria. He expressed his belief the site in West St. Paul will make it possible to serve not only the northern half of the City of Eagan, but 35E and access to Highway 110 will make it possible to also serve the entire City of Eagan. DEVELOPMENT OF THE Council acknowledged the memo from Public Works SHEILY SITE - MR. MIKE Director Jim Danielson relative to the development of the RANCONE Sheily Site. Mr. Mike Rancone was in attendance to present his proposal for the redevelopment of the Sheily site which is located within the City of Lilydale. Mr. Rancone is proposing a village type development consisting of 27 acres which will include townhome condominiums, commercial, and retail, as well as a garden park with water features which will be open to the public. Page No. 3 November 17, 1998 Mr. Rancone will be progressing through the Planned Unit Development process with the City of Lilydale within the next month or two and he intends to become involved with the City of Mendota Heights relative to the services which are provided to the City of Lilydale. Mayor Mertensotto noted the City of Mendota Heights does provide police and fire services to the City of Lilydale and he suggested Mr. Rancone stay in contact with City staff to ensure his plans are consistent with the requirements of the fire and police departments. Mr. Rancone anticipates 68 to 70 townhomes, 30 to 35 row house townhomes, approximately- 25,000 square feet of office and 25,000 to 30,000 square feet of retail space, as well as 15 to 30 apartment units. Mayor Mertensotto asked where this development will obtain its source of water. Mr. Rancone explained there are several springs on the property. In addition, water from Mendota Heights comes down the river bluff and will be captured and realized for use in the park system. The storm water management for the site will be incorporated into this water system. Councihmember Krebsbach inquired whether public streets will be serving this development. Mr. Rancone explained the development is completely self- contained. Mayor Mertensotto asked how many housing units are anticipated with the exception of any apartment building which may be constructed. Mr. Rancone expects there to be approximately 200 housing units which would be individually owned. Councilmember Krebsbach inquired relative to the average price of the units. Mr. Rancone estimated the average price will be in the $350,000 to $450,000 range. Councihmember Smith asked what type of retail is anticipated. Mr. Rancone stated as far as retail is concerned, he would like to see a bank, clinic, grocery, dry Page No. 4 November 17, 1998 cleaner and deli, as well as various offices. Drive -thru type services would not be included. Mayor Mertensotto inquired relative to the average daily traffic count which is anticipated once the site is fully developed. Mr. Rancone explained an average daily traffic count study was recently completed and once the site is fully developed he would expect a flux in the traffic coming and going from the site since a large number of the residents spend the winter months in warmer climates. Councilmember Dwyer asked whether the development will be connected to the trail system. Mr. Rancone stated this idea is worth exploring, however, the development is located approximately 60 feet above the trail and this may be a difficult walk down. Councilmember Krebsbach pointed out it may be an amenity for the residents of this development to have access to the trail. Councilmember Dwyer inquired whether the site will be developed in phases. Mr. Rancone stated given the market at this time, phases are not anticipated for this site. Mayor Mertensotto urged anyone with questions or comments relative to this development contact Gene or Mike Rancone at Rancone Development Company, 1069 William Court, Mendota Heights, MN 55120. Councilmember Huber pointed out there appears to be a fair amount of hard surface and significantly less greenery. Mr. Rancone stated there will be substantial green and open space as well as water. In addition, he noted any exterior parking which is anticipated is required by code. 0'I V.3 R INE CHERRY HILL ADDITION Council acknowledged the memo from Civil Engineer Marc STREET R E C O N - Mogan regarding the Cherry Hill Addition Street STRUCTION (JOB NO. Reconstruction Public Hearing. 9714, IWROVEMENT NO. 99, PROJECT NO. 1) Mr. Mogan explained earlier this summer the City Council Page No. 5 November 17, 1998 identified potential neighborhoods for the 1999 street reconstruction project in Mendota Heights. Property owners in the Cherry Hill Addition were polled to determine the level of interest to be chosen as the City's reconstruction project for 1999. Of 65 affected property owners who were polled, a total of 41 responded. The poll revealed that 27 of the 41 responding property owners supported the initiation of a 1999 total street reconstruction project which would include storm sewer as well as concrete curb and gutter in the Cherry Hill Addition. Fourteen property owners did not support such a proposal. The results of the poll combined with the condition of the streets in this area prompted Council to initiate consideration of a City public improvement project to reconstruct the approximately 0.8 miles of streets in the Cherry Hill Addition neighborhood. This reconstruction project would upgrade Cherry Hill Road, Farmdale Road, Lower Colonial Drive and Upper Colonial Drive to meet the current structural and drainage provisions of city standard streets. City standard streets have a 3.5 -inch thick bituminous pavement surface constructed over a 6 -inch gravel base with concrete curb and gutter and storm sewer where appropriate. The total width of this street section will measure 34.33 feet between the outside edges of concrete curb and gutter. The proposed improvements would include the construction of a small turn around or cul -de -sac in the vicinity of the tennis courts on the east end of Upper Colonial Drive. All properties with driveways which abut the improved streets would be assessed up to 50 percent of the project cost on a per lot basis. The property owner's 50 percent share of the preliminary estimated project cost is approximately $3,700 per lot. Councilmember Huber questioned whether the water run off from Cherry Hill Road and Upper Colonial Drive will ultimately flow down Wachtler Avenue. Mr. Mogan stated at this point the assumption has been made the storm sewer system on Wachtler is adequate to accommodate the flow. Page No. 6 November 17, 1998 He did not feel the volume would increase, however, the rate will increase. Mayor Mertensotto noted a letter was received from the Sulllivans, 762 Lower Colonial Drive, who are opposed to the urban street design. Mayor Mertensotto inquired whether an overlay project had been considered. Mr. Mogan stated he would not recommend an overlay project given the wear which would be apparent within a couple of years. Councilmember Huber pointed out an overlay project would be assessed over a shorter period of time than a reconstruction project, therefore, the cost would be fairly comparable. Councilmember Smith asked whether consideration was given to reconstruction without curb and gutter. Mr. Mogan explained a number of options have been considered. An overlay may cost approximately $1,500 per lot, however, he did not feel this would be the best solution. Councilmember Dwyer asked whether there are any other costs associated with this project. Mr. Mogan stated there are not. He estimated the project could be completed by the 1st of August. Joan Brandes, 1465 Cherry Hill Road, stated the survey did not mention the street was going to be widened by five feet. She felt the addition of curb and gutter would destroy the country charm of the roadway. She also expressed concern she will not be able to maneuver up her driveway in the wintertime when there is snow present. Ms. Brandes stated she is opposed to the street being widened and requested the Council not approve the widening of the roadway. Ken Boehmer, 1447 Cherry Hill Road, inquired whether property values will increase with the addition of curb and gutter. Mayor Mertensotto stated the values will increase. Councilmember Dwyer pointed out in the Friendly Hills neighborhood, the increase in property values was j Page No. 7 November 17, 1998 approximately 20 percent. Stan Linnell, Cherry Hill Road, requested the streets not be widened. He felt a narrower street would reduce the speed of traffic in the area and would be less expensive as well. Mr. Linnell agrees the project needs to be done, however, he would like it to occur in several years rather than now. Mr. Linnell suggested a 27 -foot roadway with curb and gutter which will provide drainage for the neighborhood. Mayor Mertensotto did not feel the width of the street would affect the speed of the traffic in the area. He expressed concern it was suggested had the neighbors known the roadway would be widened, there would have been more opposition to this project. Councilmember Krebsbach inquired relative to the width of the streets in the Friendly Hills neighborhood. Mr. Mogan explained the streets were constructed the standard width throughout the neighborhood. Mr. Mogan explained the property owners will lose two feet and two inches of width to accommodate the curb and gutter. Councilmember Krebsbach stated the streets in the neighborhood appear wide and she would be willing to go along with a 28 -foot roadway. Councilmember Huber stated he would be in agreement with Councilmember Krebsbach's suggestion. Councilmember Smith stated she could support a narrower right -of -way. Councilmember Krebsbach suggested 28 feet of bituminous with two feet, two inches of curb and gutter. Councilmember Smith pointed out some flexibility relative to parking is lost with curb and gutter. Bill Frank, 774 Lower Colonial Drive, stated he is opposed to the curb and gutter. He related his belief the roadways have a very sound face. In addition, Mr. Frank stated he has not witnessed any standing water on the roadway and Ayes: 5 Nays: 0 Page No. 8 November 17, 1998 did not feel there is a need for curb and gutter. He felt the areas which have been patched should be overlaid because the patching work has caused problems. Mayor Mertensotto felt there should be a period of time in which to allow people to comment further on the issue of the wider street. Ed Stammler, 792 Upper Colonial Drive, stated he did not feel holding a further hearing would result in additional input from the residents. Councilmember Huber stated he would not want to cut off anyone's input, however, he felt given the current situation, the Council could make a decision on this issue. Mr. Mogan stated without a ditch or curb and gutter system, standing water will result on the roadway. Councilmember Krebsbach suggested adopting the resolution providing for 28 feet of blacktop with the additional 4.33 feet to accommodate the curb and gutter. Councilmember Huber moved closing the public hearing at 9:23 p.m. Councilmember Dwyer seconded the motion. Councilmember Krebsbach moved adopting RESOLUTION NO. 98 -86, "A RESOLUTION ACCEPTING ENGINEER'S REPORT, ORDERING OF IMPROVEMENT PROJECT, AND PREPARATION OF PLANS AND SPECIFICATIONS FOR STREET RECONSTRUCTION AND REHABILITATION IMPROVEMENTS TO SERVE THE AREA REFERRED TO AS CHERRY HILL ADDITION AND SURROUNDING AREAS (JOB NO. 9714, IMPROVEMENT NO. 99, PROJECT NO. 1) ", amended to provide for 28 feet of blacktop with and additional 4.33 feet to accommodate the curb and gutter resulting in a street width of 32.33 feet rather than a standard street. Page No. 9 November 17, 1998 Councilmember Dwyer seconded the motion. Councilmember Smith commented she is comfortable with taking this action since input has been received from the residents and the Council has attempted to accommodate the concerns of the neighborhood. She asked that residents who are experiencing problems relative to this issue contact staff and they will, through design, attempt to accommodate individual problems the homeowners are having. Ayes: 5 Nays: 0 Councilmember Dwyer expressed concern relative to the safety problems in this area and stated these problems can be addressed through the police department, however, they must be resolved through education as well. CASE NO. 98 -33: AM[B Council acknowledged the memo from Administrative PROPERTIES - REAR Assistant Patrick Hollister regarding the request of AMB for YARD SETBACK a 10 -foot rear yard setback variance for parking to allow the VARIANCE addition of truck docks to the rear of the "Rollerblade" building and shared access between that building and the newly constructed Mendota Heights Gateway Commons Building. Attorney Jeff Johnson, Barna, Guzy, Steffen, was in attendance on behalf of AMB, along with Robert Granville, AMB Property Corporation, Boston, Massachusetts. Robert Cote, CB Richard Ellis, Todd Mohagan, Mohagan Architects, Ltd, and Tom Cesare, Planning Engineer, were in attendance as well. Mr. Johnson stated the applicants have addressed the five issues which were raised at the October 6, 1998, meeting of the City Council. Those issues included the impact of the development on the green space, submission of a landscape plan, proof of parking, submission of an elevation sketch, and the impact of commingling of car and truck traffic as a result of the docks. Page No. 10 November 17, 1998 Mr. Mohagan explained in 1994, the variance presented reflected green space to be 16.8 percent. The proposal before the Council reflects 19.5 percent green space which results in a decrease in hardcover. A landscape plan has been submitted which Mr. Mohagan reviewed for the Council. He suggested islands of river rock and ash trees to block the view from the street and screen the truck portions of the parking area from the street. There is an existing security fence which will be removed since it is no longer needed. With respect to the issue of parking, the existing stalls plus the proof of parking results in 276 parking stalls which is the number contained in the variance which was obtained in 1994. Councilmember Smith noted trucks are currently parking on the frontage road along Pilot Knob Road. Mr. Cote explained he has discussed this with Rollerblade and he has been informed their policy is to eliminate parking or storage of trucks in this area on a permanent basis and the current situation will be corrected. Mr. Cote suggested moving the truck storage from the south side of the pond to the north side of the building with the creation of screenage through additional landscaping. Mayor Mertensotto asked how many docks are anticipated. Mr. Mohagan stated an additional 27 docks are being proposed. Councilmember Smith stated there is a significant area which is designated as landscaped which actually is not landscaped. She felt a more extensive landscape plan would be more acceptable along with the inclusion of some screening of the truck storage area. With respect to the landscape plan, Councilmember Krebsbach noted homeowners generally create significantly more screen for pools and she suggested doubling the trees which are proposed in the plan. Mr. Mohagan stated he Page No. 11 November 17, 1998 which are proposed in the plan. Mr. Mohagan stated he would be willing to submit a proposal. Mayor Mertensotto suggested additional landscaping along Pilot Knot Road as well as the elimination of truck parking in this area as well. Councilmember Smith commented another area which is highly visible and of major impact is Highway 55 and she would like more landscaping to break up the expanse of this area. Councilmember Dwyer pointed out the issue before the Council is a request for a 10 -foot rear yard setback variance. He inquired whether the Council is also approving a building permit at this time. Administrator Batchelder explained this action will also require Council approval of the building permit since all exterior work in this zone requires Council approval. Mayor Mertensotto suggested the applicants work with Administrative Assistant Patrick Hollister on the landscaping plan and return to Council for approval. Mr. Cote addressed the issue of truck traffic, explaining he surveyed all tenants to determine the average weekly truck traffic and found the Rollerblade space averages approximately 28 truck trips per week while the Mendota Gateway Commons, which consists of nine tenants, averages approximately 40 truck trips per week. Mr. Cote noted this translates into approximately one truck every 45 minutes which he did not feel to be excessive for a warehouse type property. Mayor Mertensotto recessed the meeting at 10:05 p.m. and reconvened at 10:12 p.m. (Councilmember Smith was excused from the meeting at 10:10 p.m.) CASE NO. 98 -39: APT - Council acknowledged the memo from Public Works CUP AND APPROVAL OF Director Jim Danielson regarding a request from APT for a LEASE AGREEMENT Conditional Use Permit and Lease Agreement. Page No. 12 November 17, 1998 Mayor Mertensotto requested any deviation or changes to the lease agreement be reviewed with City Attorney Hart. Mayor Mertensotto noted Councilmember Smith had inquired at the previous meeting relative to a capacity study to determine the maximum capacity for antennas on the water tower. She had also raised the issue of a landscape plan. Mr. Katkov was in attendance and noted staff recommends the northeast quadrant of the water tower is a better location and this is acceptable to APT. Mayor Mertensotto noted Councihnember Smith also had pointed out there should be a provision in the lease agreement which states the Lessee will notify the City and surrounding property owners of any changes in operation on the water tower. Mr. Katkov stated he would be in agreement with this provision. Mayor Mertensotto asked that Mr. Katkov work with City Attorney Hart to finalize a lease agreement. He commented he would also like information relative to the capacity for antenna placement on the water tower. Mr. Danielson felt the ground equipment will become the limiting factor. DISCUSS CITY Council acknowledged the memo from Public Works ENTRANCE SIGN DESIGN Director Jim Danielson relative to the design of the City entrance sign. Frank Hickey, design consultant, was in attendance along with Cliff Swenson, landscape architect, to address this matter. Mr. Hickey presented two design concepts for the Council's consideration. He stated he has reviewed the use of materials, primarily limestone or natural stone, issues relative to snowfall, the height of the sign and the seasonal color or texture of the sign. Concept I consists of an illuminated sign cabinet on a limestone base with matching retaining wall. Concept II consists of an illuminated sign cabinet on a decorative limestone base with a natural landscape. Both designs will Page No. 13 November 17, 1998 have a similar mix of plantings of flowering shrubs. Mayor Mertensotto stated he favors Concept I. He pointed out there is sandstone available to the City at Acacia Cemetery, however, this substance is not as durable as limestone. Councilmember Huber was in favor of Concept I, however, he questioned whether this is the same view most people would have of the sign. Mayor Mertensotto asked for an estimate of cost for this project. Mr. Hickey explained Concept I would cost approximately $50,000 to $55,000. Concept R would cost approximately $40,000 to $45,000. Councilmember Krebsbach stated she would favor Concept I. Stan Linnell stated he is a landscape architect for the DNR. He explained limestone is a very appropriate material for this project. Mr. Linnell suggested the lower wall could possibly be sandstone and this would reduce the cost. Councilmember Krebsbach expressed concern relative to the cost of this sign. Mayor Mertensotto explained a daycare operation was proposed for this corner property and the City purchased the property. Councilmember Dwyer also expressed concern with the cost of the sign in addition to the funds which were expended for the purchase of this property. Councilmember Huber questioned whether limestone would be less likely destroyed by vandalism. Mr. Swenson did not feel this to be an issue. He explained there is a graffiti control material which can be used on the stone so that graffiti could be removed. It was noted if dry laid stone were to be utilized, the costs would be reduced significantly. Page No. 14 November 17, 1998 Councilmember Krebsbach suggested the removal of the back wall in Concept I, which would also greatly reduce the costs involved. Mayor Mertensotto asked that final numbers be submitted for further consideration. DISCUSS NATIONAL CAR Council acknowledged the memo from Administrative RENTAL. CONCEPT PLAN Assistant Patrick Hollister relative to a Concept Plan for the National Car Rental Service Facility. Mr. Al Amiot, National Car Rental, was in attendance. National Car Rental proposes a rental car wash and maintenance facility on a vacant parcel on Medallion Drive next to the ISD 197 bus facility. Mayor Mertensotto expressed concern with utilizing five acres of commercial area for storage. Mr. Amiot stated this is a maintenance area and not a storage site. The maximum number of cars to be parked in this area at one time would be 400 to 500. Mayor Mertensotto expressed concern relative to the tax capacity of this site, noting there are only 120 acres of industrial space available in the city. It was noted this site is zoned industrial, and the proposed use is not included within the permitted or conditional uses for the district. The proposed use would require a zoning ordinance amendment. Mr. Hollister addressed this matter and stated this use is not listed in the I zone and, therefore, would not be permitted. Mr. Amiot asked that the Council consider the adjacent uses when determining whether or not this would be considered a permitted use. Councilmember Dwyer asked how cars would be moved between the airport to the proposed site. Mr. Amiot explained the cars are shuttled individually, however, there will be truck transports to and from the site when new vehicles are brought in or removed from the site. He further Page No. 15 November 17, 1998 explained seniors are primarily employed for the shuttling operation. The operation of this site would be from 6:00 a.m. to 6:00 p.m. Councilmember Krebsbach felt these service areas are being off loaded into surrounding communities making them an annex to the airport because the airport site is not sufficient to accommodate them. She did not feel this use to be appropriate for the Mendota Heights industrial area. There will be a significant increase in traffic and there are two schools nearby. Councilmember Krebsbach asked for the percentage of employees made up by seniors. Mr. Amiot stated he will provide that information. He also stated National Car Rental would be willing to work with the City if this use is unacceptable. Mr. Amiot explained the area would be fenced and secured. Councilmember Dwyer inquired relative to the use of barbed wire on this site. Mr. Amiot explained barbed wire would not be utilized unless problems arose. Mayor Mertensotto asked whether there would be security personnel on the site. Mr. Amiot stated there will not be security personnel on the site 24 hours a day unless this proves necessary. Councilmember Krebsbach inquired where National's other sites are located. Mr. Amiot stated they are in most major cities, and approximately 50 percent of the locations are on the airport grounds depending upon the site. Councilmember Dwyer asked how long a particular vehicle would be located at this lot. Mr. Amiot explained cars are utilized for 12 months or 30,000 miles and then are removed from the lot and replaced. Councilmember Dwyer further inquired approximately how many times the transport truck would be on the site. Mr. Amiot stated this varies by season, however, this is not a Page No. 16 November 17, 1998 disruptive operation. Councilmember Krebsbach noted this would create significantly more traffic activity in this area. Mr. Amiot stated he will work to address the concerns raised by the Council. DISCUSS "BISANZ" Council acknowledged the memo from Administrative PARCEL. (35E AND 494) Assistant Patrick Hollister relative to the Concept Plan for CONCEPT PLAN (RESOP the "Bisanz" Parcel located at the corner of 494 and 35E. REALTY) Jim Resop was in attendance and explained he is proposing a two -story 35,200 square foot office building with 176 parking spaces. Mr. Resop stated there would not be a warehouse component. Mr. Leuer, Moen Leuer Construction, Inc., was in attendance along with Mr. Resop. Mayor Mertensotto expressed his belief the request needs to be in conformity with the type of use St. Thomas would want to have for this area. Mayor Mertensotto stated he is uncertain whether this is appropriate for this site or not, however, he acknowledged this may be the best which can be done on this site. Councilmember Krebsbach felt an office building would be an appropriate use for this site. Councilmember Dwyer stated it would be nice if this could be coordinated with St. Thomas. Councilmember Huber stated he is not opposed to the idea either. Councilmember Huber asked how many tenants would be anticipated for this site. Mr. Resop noted it would be most desirable to have one tenant, however, it will be whatever the market will generate. He commented Mr. Dan Gleason of United Properties has several tenants who would like larger spaces, so this may be a possibility. Mayor Mertensotto did not feel an office building in this area should be more than two stories tall and should be Page No. 17 November 17, 1998 somewhat consistent with the 3M building. Conceptually the Council was not opposed to a two story office building. Councihnember Huber noted this matter will be reviewed by the Planning Commission, however, he would like the Planning Commission instructed not to deny this proposal based on the fact the parcel is less than five acres and would require a variance for a Planned Unit Development. Mr. Resop will work with staff on this matter and it will then be presented to the Planning Commission for their review prior to seeking Council approval. REVIEW OF OCTOBER 9, Council acknowledged the memo from City Administrator 1 9 9 8 M A S A C Batchelder relative to the October 9, 1998 MASAC OPERATIONS Operations Committee Minutes. COMMITTEE MINUTES Mr. Batchelder noted two items of particular interest to the City were discussed at that meeting. The items discussed were close -in departures and crossing in the corridor. Councihmember Krebsbach felt if residents are interested in more information, they should be provided with these documents. Councilmember Krebsbach asked whether general aviation could use the flight pattern stating she would like them to not fly over the neighborhoods in the early morning or late evening hours. Mayor Mertensotto noted they are not required to comply with the plan. COUNCIL COMMENTS Councilmember Krebsbach stated it is unfortunate Snyders is closing the cafes at all of their locations. Mayor Mertensotto asked Police Chief Johnson whether the issue of high speed traffic on the Warrior Drive frontage road has been addressed. Chief Johnson explained the squad cars have been out there every afternoon patrolling this area and this monitoring will continue. Page No. 18 November 17, 1998 Councilmember Dwyer expressed his appreciation to Mr. Danielson and Pastor Enterprises for barriers which were placed on the sidewalk leading to the dock area.
