RESOLUTION 09 -100 RESOLUTION , 1, 1 G A WETLANDS PERMIT FOR RETAINING .N, AT 2517 CONCORD WHEREAS, Stonewall, Inc. has applied for a wetlands permit for a retaining wall at 2517 Concord Way [Kensington PUD Kensington Manor Homes Condo File #104 Unit #128 1.1716% int being pt of Lots 5, 6, 7, 9, 10 & 11 B -2 Lots 1, 2, 3, 4, & 5 B -3 & outlots C &D and pt of outlot B, Kensington PUD & outlot F Kensinton PUD 2nd Add.; PID 27- 41600 - 128 -04] as proposed in Planning Case #09 -38; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on October 27, 2009; and WHEREAS, The Planning Commission recommended that the Council approve the wetlands permit for a retaining wall as presented to the Planning Commission on the evening of October 27, 2009 and as shown in Planning Case #09 -38; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of j Mendota Heights that a wetlands permit for a retaining wall as proposed in planning Case #09- 38 is hereby approved with the following conditions: 1. The retaining wall shall be rebuilt in the same location as the existing wall. 2. The existing nature landscape will be retained or restored between the wall and the wetland edge. BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights that a wetlands permit for a retaining wall as proposed in planning Case #09 -38 is hereby approved with the following findings of fact: 1. The project will provide bank stabilization on the grade adjacent to the wetland. 2. The project will protect water quality. 3. The project will not result in negative impacts to the wetland. 4. The project is consistent with the intent of the Wetlands Ordinance. 5. The project has been reviewed and approved by the City Engineer.
