Res 2009-110 Certifying Unpaid Weed Cutting ChargesCITY OF MENDOTA HEIGHTS Dakota County, Minnesota Resolution No. 09 -110 RESOLUTION CERTIFYING UNPAID WEED CUTTING CHARGES WHEREAS, Ordinance No. 1001, "AN ORDINANCE REGULATING AND CONTROLLING THE GROWTH OF WEEDS, AND OTHER RANK, POISONOUS OR HARMFUL VEGETATION IN THE CITY OF MENDOTA HEIGHTS" authorizes the City's Weed Inspector to cause weeds, grass and other vegetation to be cut and removed if the weeds, grass and other vegetation are not removed by the property owner upon written notice from the City; and WHEREAS, said Ordinance No. 1001 authorizes the City to certify to the County for collection with property taxes any unpaid costs for the cutting and removal of weeds, grass and other vegetation plus a five percent (5 %) charge for inspection and other additional costs in connection therewith; and WHEREAS, the City Cleric has advised the City Council that the weed cutting charges due to the City as of November 16, 2009, for properties hereinafter described have not paid; and WHEREAS, a written statement of charges was sent to the last known owner of said properties and more than thirty (30) days have elapsed since the mailing of said statements; and WHEREAS, the legal description of said properties, name and address of the last known owner thereof, and the total amount of weed cutting and removal charges due each of said parcels are as follows: Property Owner , Legal. Description Total Due NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights, Minnesota, as follows: 1. That the weed cutting and removal charges set forth above is hereby adopted and confirmed as the proper unpaid charges due for the above - described properties and the current charges against each such parcel shall be a lien concurrent with the general taxes upon such parcels; 2. That the total amount of said charges shall be payable with general taxes for the year 2009 collectable in 2010; That the City Clerk shall prepare and transmit to the County Auditor a certified copy of this Resolution with the request that each of said amounts shall be extended upon the property tax lists of the County to be thereafter collected in the manner provided by the law; and 4. That a $50.00 certification fee along with seven percent (7 %) interest has been added to each delinquent weed cutting account in accordance with Ordinance No. 1001.
