Mayor Krebsbach called the meeting to order at 7:08 p.m. The following members were present:

PULLED CONSENT AGENDA ITEM
C) APPROVE RESOLUTION 2013 -30, DESIGNATION OF NATIONAL POLICE WEEK
National Police Week is a time set aside for the nation to honor the service and sacrifice of law
enforcement officers killed in the line of duty. Chief of Police Michael Aschenbrener expressed his
appreciation to the City for taking this opportunity to recognize the sacrifices and hard work of
police officers. There are various celebrations scheduled throughout this next week.
Councilmember Duggan and Mayor Krebsbach read the resolution recognizing National Police
Week which is May 12 through May 18, 2013, and National Peace Officers' Memorial Day which is
May 15, 2013.
Councilmember Duggan moved to approve RESOLUTION 2013 -30 RECOGNIZING NATIONAL
POLICE WEEK AND PEACE OFFICERS' MEMORIAL DAY.

J) APPROVE RESOLUTION 2013 -33, CALLING FOR PUBLIC HEARING,
LEXINGTON HEIGHTS APARTMENTS REFINANCING
Finance Director Kristen Schabacker explained that Lexington Heights Apartments is requesting that
the Council set a public hearing for the refunding of their bonds. In 1983, the City issued conduit
debt for the Lexington Heights Apartments and they are requesting refinancing of that debt. Conduit
debt is not an obligation of the City as it is a pass - through. This is debt that has already been issued
and they are refunding that debt.

Councilmember Duggan questioned the $30,000 difference. Finance Director Schabacker explained
that the project consists of refinancing the outstanding principal amount of the City's $9,100,000
Multifamily Housing Revenue Refunding Bonds (Lexington Heights Apartments Project) Series
1991A and $1,870,000 Multifamily Housing Revenue Refunding Bonds (Lexington Heights
Apartments Project) Series 1991B; for a total of $10,970,000. However, the maximum aggregate
estimated principal amount of the bonds or other obligations to be issued, in one or more series, by
the City to refinance the project will be $11,000,000. The extra $30,000 allows them some room to
make adjustments, if necessary.
Councilmember Duggan moved to approve RESOLUTION 2013 -33, CALLING FOR A PUBLIC
HEARING ON THE ISSUANCE OF REVENUE REFUNDING BONDS AND AUTHORIZING
THE PUBLICATION OF A NOTICE OF HEARING (LEXINGTON HEIGHTS APARTMENTS).

K) APPROVE BUILDING PERMIT FOR CONVENT OF THE VISITATION SCHOOL
Dr. Dawn Nichols, Head of School, explained that Convent of the Visitation School has embarked
upon an ambitious building project of which phase one, the creation of the STEM Building and
dining room expansion was completed at the end of January. Phase two of the project is the new
Heart of the School, which would include an identifiable front door through which visitors would
enter to find new learning spaces, a legacy area in honor of the Sisters, additional areas for study,
and an enhanced library. Safety and security would be enhanced, and the floor plan would result in a
decongestion of the current footpaths through the school.
Images of the proposed completed building were shared.
Councilmember Duggan expressed his excitement for this project and requested that staff work with
the school to ensure that proper signage is in place indicating that it is a construction site and that the
construction entrances on Lake Drive are temporary.
Councilmember Duggan moved to approve the building permit for 2455 Visitation Drive, Heart
Commons addition.

0) RECEIPT OF APRIL 2013 BUILDING ACTIVITY REPORT
Councilmember Duggan stated that he was happy to report to the community that despite the
recession, Mendota Heights continues to grow in a remarkable way; a way that reflects the more
rural residential type of community which is being preserved. Mendota Heights has had over $6

million in new valuation of development since the beginning of the year, which is more than last
year and is almost three and a half times more than 2011.
Councilmember Duggan moved to acknowledge receipt of April 2013 Building Activity Report.

PRESENTATION
A) CONVENT OF THE VISITATION ROBOTICS TEAM
Mayor Krebsbach introduced Ms. Janelle Bute, co- captain of the Convent of the Visitation School's
robotics team, the Robettes. The Robettes is an all -girls robotics team. They are part of a program
called FIRST Robotics; For Inspiration and Recognition of Science and Technology.
This year, the Robettes won the Industrial Design Award and the Creativity Award for their robot,
and they are currently ranked 6th in the state. They will be competing in the state tournament on May
18 at Williams Arena at the University of Minnesota. They also have a fellow student who won the
Dean's List Award, which is based on their contribution to spreading the message of FIRST and
supporting the program.
Ms. Bute explained what the STEM building is at the Convent of the Visitation and how this new
facility is being utilized by all of the students. STEM is an acronym for Science, Technology,
Engineering, and Mathematics and the STEM building focuses on these subjects.

PUBLIC HEARING
A) 3.2% MALT LIQUOR LICENSE RENEWALS
City Clerk Lorri Smith explained this is a hearing on the renewal of the malt liquor licenses.
Currently, there are four on -sale licenses and two off -sale licenses.
On -Sale 3.2 percent malt liquor licenses include:
• Mendota Heights Par 3 located at 1695 Dodd Road
• Mendo Restaurant Group, Inc., dba Mendoberri located at 730 Main Street
• Windy City Pizza LLC dba Tommy Chicago's Pizzeria located at 730 Main Street
• CEC Food and Beverage LLC, dba LeCordon Bleu, 1315 Mendota Heights Road

Off -Sale 3.2 percent malt liquor licenses include:
• Northern Tier Retail LLC dba SuperAmerica located at 1080 Highway 110
• Northern Tier Retail LLC dba SuperAmerica located at 1200 Mendota Heights Road
All of the licensees have turned in the required documentation and the Police Department has
conducted an investigation of all of the applicants and found no negative findings. There have been
no liquor law violations within the past year.
Clerk Smith noted that on April 2, 2013, the City Council amended the City Code to change the
licensing period for 3.2 percent malt liquor to the period of July 1 through June 30 of each year.
Mayor Krebsbach opened the public hearing and invited the public to comment. There were no
comments received from the public.
Councilmember Duggan moved to close the public hearing.

AWARD OF BID
A) RESOLUTION 2013 -32, APPROVE CONTRACT FOR
HUNTER - ORCHARD STREET IMPROVEMENT PROJECT
City Engineer John Mazzitello explained that the Hunter Lane — Orchard Place Neighborhood
Improvement Project is identified in the City's Street Improvement Plan as a project scheduled for
2013. Staff advertised for bids and on Wednesday, May 1, 2013 held the bid opening. There were
four bids received. Northdale Construction Company Inc. was the apparent low bidder in the amount
of $1,537,313.21. If Council awards the bid at this time, staff would anticipate construction
beginning in mid to late June with a substantial completion date of September 27, 2013. An
assessment hearing would be held in October 2013 and the final wear course of asphalt would be
laid in the summer of 2014.
Councilmember Povolny commented that the four bids received were all very close. City Engineer
Mazzitello stated that this is a testament to the engineering staff. When bids are received that are
close, it is a sign of a very complete set of plans and a good set of specifications.

Mayor Krebsbach asked if staff is familiar with the contractor. City Engineer Mazzitello replied that
Northdale has completed work in the city of Mendota Heights in the past, and most recently, they
were the utility sub - contractor to Valley Paving on the Lemay Road Project.
Councilmember Duggan moved to adopt RESOLUTION 2013 -32 ACCEPTING BIDS AND
AWARDING CONTRACT FOR THE HUNTER AND ORCHARD NEIGHBORHOOD
IMPROVEMENTS (PROJECT #200902).

COMMUNITY ANNOUNCEMENTS
Assistant to the City Administrator Jake Sedlacek updated the Council on city events:
1. The annual spring clean -up day occurred on Saturday, May 4. It is estimated that 235 vehicles
dropped off items to be disposed of.
2. The annual Parks Celebration is scheduled for Saturday, June 1, 2013. There will be a band
playing at Market Square Park on Friday evening, May 31St
COUNCIL COMMENTS
Councilmember Povolny stated that he went to the Mendota Elementary School Carnival and had a
lot of fun. It was a strong indication to him just how much Mendota Heights has changed over the
years.
Councilmember Duggan commended Assistant to the City Administrator Jake Sedlacek for the
excellent job he did in organizing Spring Clean -up Day. He expressed his appreciation to all the staff
who volunteered to help out on that day.
Councilmember Norton commented that three great groups of people came in for interviews for the
City Attorney position and he recognized City Attorney Tami Diehm for her continued service to the
City during this time of transition.
City Engineer John Mazzitello reminded the Council and residents that the Crown Point and
Overlook neighborhood rehabilitation project will kick off on Monday, May 13, 2013. The schedule
the contractor has provided shows approximately five and a half weeks of construction and that will
also include the rehabilitation of the Lexington Avenue trail from Marie to Victoria.
Mayor Krebsbach suggested residents take a look at the City's new webpage as it has been enhanced
with more photographs and the addition of performance indicators. She also stated that she stopped
at the City's Par 3 golf course and visited with Recreation Coordinator Sloan Wallgren. She
encouraged the public to check out the Par 3.

INTERVIEW OF CITYATTORNEY CANDIDATES
The city council interviewed the following law firms for the city attorney position:

• Eckberg Lammers
Following the interviews the council adjourned at 7:00 pm to attend the regularly scheduled council
meeting. The council reconvened at 8:00 pm to further discuss the candidates. It was the consensus of the
council to proceed with contract negotiations with the Eckberg Lammers law firm.

CALL TO ORDER
Mayor Krebsbach called the meeting to order at 1:15 p.m. The following members were present:
Councilmembers Duggan, Norton, Petschel and Povolny. Also in attendance: City Administrator Justin
Miller
ECONOMIC DEVELOPMENT OPPORTUNITIES/HOUSING OPTIONS
Staff and the city council began by reviewing available parcels of land that could be developed or re-
developed. Parcels were reviewed individually and council discussed potential and preferred uses on each
site.
2014 BUDGET DIRECTION/DEBT LEVEL ANALYSIS
Staff reviewed packet materials which included levy and wage increase histories as well as projections on
future debt levels. The council discussed impacts on potential levies on residents based upon projected
property value increases. Council provided staff with direction on the 2014 budget and levy and asked to
see a proposed budget at a future city council workshop.
WATER SYSTEM OWNERSHIP
The council reviewed the current ownership status of the water system and the relationship with St. Paul
Regional Water Services. Past negotiations with SPRWS were discussed and ownership options were
reviewed in regards to costs and benefits. Staff indicated that SPRWS had already approached the city
about reviewing the contract, which expires in November 2015. Council directed staff to continue to
discuss options with SPRWS and to return to the council after the first of the year.
COMMUNITY VISIONING /CITIZEN SURVEY
Staff reviewed the materials included in the council packets and the council discussed the merits of a
citizen survey. After discussion, it was determined to not proceed with a survey at this time.

The March meeting of the Mendota Heights Parks and Recreation Commission was held on
Tuesday, May 14, 2013 at Mendota Heights City Hall, 1101 Victoria Curve.
Chair Levine called to order the parks and recreation commission meeting at 6:31 p.m. The
following commissioners were present: Chair Stephanie Levine, Commissioners Mary McGrory-
Ussett, Ira Kipp, Joel Paper, David Miller, Pat Hinderscheid and Michael Toth. Staff present:
Recreation Program Coordinator Sloan Wallgren and Assistant to the City Administrator Jake
Sedlacek.
Approval of Minutes of April 9, 2013
Commissioner Hinderscheid made a motion to approve minutes of the April 9, 2013 meeting;
commissioner Paper seconded the motion.

Recreation Programming Update
Recreation Program Coordinator Sloan Wallgren reviewed the recreation programming update.
Registration for field trips and the summer playground programs and tennis programs have been
filling quickly. The Heights Highlights will arrive in homes this week and is anticipated to drive
additional registrations.
Mr. Wallgren also recapped upcoming events for the summer, including the parks celebration,
puppet wagon and music in the parks. There has been great community support for the parks
celebration, if anyone is interested in volunteering, they should contact Mr. Wallgren at city hall.
Discussion on Victoria Highlands Ball Field
Assistant to the City Administrator Jake Sedlacek noted that representatives from MHAA were
not in attendance, but would be meeting with staff on Friday, May 17, 2013. Mr. Sedlacek asked
the commission if they had further feedback they would like shared with MHAA regarding the
project.
A brief outline of the project was provided for commissioners who we unable to attend the April
meeting.
Discussion took place on the role of the parks and recreation commission and how citizens may
bring requests to the commission for consideration. Staff will create a "request for parks
improvements" form based upon the conversation, and make it available to the general public.

Staff noted that the annual funding request from MHAA to the city has not yet been received, but
that the request would require the same reporting as was required in 2012.
Par 3 Update
Mr. Wallgren reviewed the Par 3 update. The course is open for business and playing conditions
are good. Program registrations year to date are on pace with 2012, the Heights Highlights and
an additional school flyer are anticipated to result in more registrations. Staff has seen
registrations from more Eagan families than in years past, which may be the result of Parkview
Golf Course closing.
The commission asked about financial reports, Mr. Sedlacek replied that due to the late start,
staff did not run an April financial report.
The commission suggested that staff consider reaching out to new housing projects in Mendota
Heights and Lilydale as potential new customers to the Par 3.
Capital Improvements Planning
Mr. Sedlacek introduced the topic discussing how the city council makes use of the capital
improvements plan in their budgeting process. Mr. Sedlacek also clarified that the city council
has not set a target for annual expenditure on capital projects. Staff's interpretation of city
council direction is that the parks and recreation commission is asked to create a prioritized list
of projects, for the city council to consider funding.
The commission discussed the criteria which would be used to evaluate projects for inclusion in
the capital improvements plan, establishing the following criteria:
1. Is there a safety need which drives the project
2. What is the anticipated use (user group) for the proposed project
3. Is there urgency to complete the project- safety, funding opportunity, etc.
4. Does the project add value to the community
5. Are there alternatives to the proposed project
The commission discussed a number of projects, and provided staff with feedback to draft a
capital improvements plan for consideration at the June 2013 commission meeting.
Commissioner McGrory - Ussett asked for a copy of a parks maintenance list which was
developed in 2012. Mr. Sedlacek responded that the list is not being maintained as a commission
item, and encouraged any citizen with a maintenance concerns should be emailed to John
Mazzitello, at johnrm @ mendota- heights.com. Staff will respond to inquiries individually.
The commission was asked to provide input on the trail improvements plan which was presented
by John Mazzitello at a previous meeting. The commission asked that a copy of the plan be
resent via email.

Chair Levine asked that the city request the anticipated date for paving on the north end of the
Valley Park Trail.
Commission Comments
Commissioner Toth asked for an updated on the schedule for street sweeping. Mr. Sedlacek
replied that he will ask engineering staff to include an update in The Pipeline to be sent with this
week's Friday News update.
Commissioners Miller and McGrory - Ussett encouraged citizens to share their ideas, and asked
staff to further develop the process to do so.
Commissioner Paper asked that hand sanitizer be added to the portable toilets in the parks, Mr.
Sedlacek reported that Commissioner Paper's request had been forwarded to staff on Monday,
and that hand sanitizer will be installed in all portable toilets.

SUBJECT: Recognition of National Public Works Week
BACKGROUND
Public Works staff provides vital and essential services to the City of Mendota Heights on a daily
basis, often with little or no recognition. Whether it is snow plowing, street repair, sanitary sewer
cleaning, water main and /or fire hydrant maintenance, parks maintenance, City owned landscape
management, or inspecting the inlets and outlets to our stormwater ponds, Public Works staff does
their absolute best to make the City of Mendota Heights safer, healthier, and a great place to work,
live, and play.
Each year the American Public Works Association (APWA) sponsors "National Public Works Week"
to help make and keep communities across the country aware of the important role public works play
in their everyday life. This public support is critical to the sustained efficient operation of public
works facilities and infrastructure assets throughout the City. This year, APWA has set the week of
May 19th through May 25th as "National Public Works Week" Throughout the country, cities and
counties are recognizing this week in honor of all their public works employees, and educating their
residents and civic organization about the importance of planning, designing, building, maintaining,
managing and operating the backbone of our communities and improving the quality of life for
everyone.
This year's theme is "Because of Public Works..." and is focused on the quality of life that Public

WHEREAS, public works services provided in Mendota Heights are an integral part of our
residents' everyday lives; and
WHEREAS, the support of an understanding and informed constituency is vital to the efficient
operation of public works facilities and services such as water service, sanitary sewers, storm sewers,
street maintenance, trails, park maintenance, and snow plowing; and
WHEREAS, the health, safety, comfort, and quality of life of Mendota Heights residents greatly
depends on these facilities and services; and
WHEREAS, the quality and effectiveness of these facilities and services, as well as their
planning, design, construction, and maintenance is vitally dependent upon the efforts and skill of public
works officials and staff; and
WHEREAS, the efficiency of the qualified and dedicated personnel who staff the public works
department is materially influenced by the residents' attitude and understanding of the importance of the
work they perform; and
WHEREAS, city streets, sanitary sewers, storm sewers, trails, and parks are considered the
backbone of the city ranked the 2nd best place to live in the entire Twin Cities Metropolitan Area; and

Fire Calls
The department responded to 15 calls for the month. The majority of calls were classified as
false alarms or as good intent calls. Four calls were residential in nature, four calls were
commercial alarms, two calls were grass fires, two calls were gas leaks and two of the calls were
injury accidents and they were EMS responses.
Monthly Department Training
The squad training for the month was dedicated to testing all of the department's fire supply
lines. Each of the major pieces of apparatus carries approximately 600' of supply line. In
accordance with NFPA guidelines, all the hoses must be pressure tested each year. The hose is
tested as part of a relay pumping drill where we supply a pumper with water from a hydrant that
is over 1000' away. Two 100' sections of supply line failed the test. This type of drill simulates
how we may have to supply a pumper in a non - hydrated area such as Sunfish Lake or parts of
Mendota.
Monthly Squad Training
The monthly department training was a ladder drill. The training focused on the proper use of
the ground ladder and the aerial device on L -10. Each of the department's apparatus carries at
least three different types of ladders ranging in length from 8' to 35'.

Item 1: 2013 Par 3 Seasonal Hire
At a recent meeting, City Council gave approval for staff to begin the hiring and recruitment
process for two Par 3 seasonal golf course maintenance workers. City staff recently completed
interviews for one of the seasonal golf course maintenance positions. Staff is recommending
Cody Gill for the golf course maintenance worker position. The background check was
completed. His hourly rate for the seasonal golf course maintenance position will be $10.00 per
hour.
Staff is recommending Cody Gill for employment effective May 9, 2013 for the 2013 golf
season.
BUDGET IMPACT
As noted above.
RECOMMENDATION
City staff recommends that city council appoint Cody Gill for seasonal golf course maintenance
position for the 2013 golf season effective May 9, 2013.
If council concurs in the recommendation, a motion should be made to approve the appointment

The 2013 International Fire Chiefs Conference is being held August 14, 2013 to August 18, 2013
in Chicago Illinois. I'm recommending that Assistant Chief Dreelan attend the conference. I
have attended the conference in the past and found it to be a very worthwhile event. The training
at this conference is specifically designed to help chief officers meet the challenges of managing
a fire department in today's ever changing environment.
BUDGET IMPACT
The Fire Department would pick -up the costs of the travel, hotel, meals, and registration, which
is in the budget. The conference registration is $615.00, air fare is $165.00, and the hotel is
$900.00 for a total of $1,680.00. Assistant Chief Dreelan would take time off from his regular
job to attend this conference.
RECOMMENDATION
I view this as a win -win for the department and the City. I recommend city council authorize the
out of state travel for Assistant Chief Dreelan to the International Fire Chiefs Conference.

In November 1999, the city issued Housing Facilities Revenue Bonds for Dakota Communities
as conduit debt. Dakota Communities provides group housing for people with severe
disabilities. They are now consolidating debt for its facilities in Dakota and Ramsey County. It
is refunding the bonds that the city originally issued and is now issuing the debt through the
Dakota County CDA. The city is required to consent to the refunding of the bonds that had been
previously issued.

A RESOLUTION CONSENTING TO THE ISSUANCE OF
REVENUE REFUNDING BONDS BY THE
DAKOTA COUNTY COMMUNITY DEVELOPMENT AGENCY

WHEREAS, the Dakota County Community Development Agency (the "CDA ") has received a
request that it issue approximately $3,500,000 of qualified 501(c)(3) revenue bonds (the "Bonds ") and to loan
the proceeds of the Bonds to Dakota Communities, Inc., a Minnesota 501(c)(3) corporation (the "Borrower ")
to refinance 17 scattered site properties owned by the Borrower and located in Dakota County and Ramsey
County, four of which are located in the City (the "Project "). Nine of the properties were originally financed
through commercial bank loans, and the remaining eight properties were financed with the proceeds of revenue
bonds issued by the City in 1999 (the "Prior Bonds "), approximately $935,000 of which remain outstanding.
The properties to be refinanced are comprised primarily of 4 -6 bedroom homes owned and operated by the
Borrower as residences to provide support and services for people with intellectual, developmental, and
physical disabilities; and
WHEREAS, Minnesota Statutes, Section 469.155, Subd. 12, authorizes the issuance of refunding
bonds by an entity other than the original issuer, with the consent of the original issuer. The CDA has
requested that the City consent to the issuance by the CDA of the approximately $935,000 of the Bonds that
will be used to refund the Prior Bonds.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Mendota Heights,
Minnesota:
1. The City hereby consents to the issuance of the Bonds by the CDA for the purpose of
refunding the Prior Bonds. The adoption of this resolution shall not be deemed, however, to establish a legal
obligation on the part of the City or the CDA to issue or to cause the issuance of the Bonds. The Bonds, if
issued by the CDA, will not constitute a charge, lien, or encumbrance, legal or equitable, upon any property of
the City or the CDA. The Bonds will be payable solely from said revenues and property of the Borrower
specifically pledged to the payment thereof, and will not constitute a debt or pecuniary liability of the City or
the CDA within the meaning of any constitutional or statutory limitation.
2. The appropriate officers of the City are hereby authorized and directed to execute documents
and certificates which are reasonably required by the CDA or its bond counsel to complete the transaction
described herein. The execution of any instrument by the appropriate officer or offices of the City shall be
conclusive evidence of the approval of such documents in accordance with the terms of this resolution.

SUBJECT: MSRS Post Employment Health Care Plan Policy for Non -Union
Employees
BACKGROUND
Earlier this year, several staff members expressed interest in participating the Minnesota State
Retirement System's (MSRS) Health Care Savings Plan. The MSRS Health Care Savings Plan
allows employees to set aside money to cover the ever - increasing costs of health insurance and
out -of- pocket expenses after termination of public service. While deferred compensation plans or
retirement accounts provide a tax - deferred benefit, amounts paid out are considered taxable
income. Under the Health Care Savings Plan, amounts contributed are tax -free and no taxes are
paid on amounts to pay health, dental and long -term care insurance premiums, as well as, out -of-
pocket medical expenses (source: MSRS website).
As part of their respective labor agreements, each of the city's three bargaining units currently
contributes to the MSRS Health Care Savings Plan. In order for employees not covered by a
bargaining unit, amounts to be put into a HCSP account must be agreed to by the employer and
included in a written personnel policy. Please note IRS rules require all employees to participate
in the HCSP adopted by the employer.
March 2013, a MSRS retirement counselor provided an overview of the Health Care Savings
Plan to all non -union employees. Following the presentation, non -union employees were
surveyed and the policy was drafted based on the survey results. The final draft policy was
reviewed by the twenty two non -union employees and a ballot vote was conducted. Eighty two
percent of the employees approved the draft policy. City Attorney Kevin Rupp has also reviewed
the draft MSRS Post Employment Health Care Plan Policy.
The policy includes the following:
Employee Contribution: employees in their first year of probation with the city of
Mendota Heights are not eligible to contribute.
Permanent non -union employees will contribute 1% of their total gross pay each pay
period.
Severance: page 23
Leaving city employment for another employer: Employee contributes 50% of accrued
hours of vacation, personal leave, and compensation time.
PERA Service retirement from city: Employee contributes 100% of accrued hours of
vacation, personal leave, and compensation time.
Based on personnel policies, the maximum payout for vacation is 200 hours and the maximum
payout for personal leave is 320 hours.

BUDGET IMPACT
There is no budget impact on the city. The city is not required to pay FICA (7.65 %) taxes on
amounts contributed to this plan and there are no employer participation fees.
RECOMMENDATION
Staff is recommending the city council approve the Post Employment Health Care Plan Policy.
If the city council agrees with the policy, a motion should be made to adopt the policy with an
effective date of July 1, 2013. Approval of this item requires a simple majority vote of the city
council.

Post Employment Health Care Plan Policy
Purpose
The City of Mendota Heights' permanent non -union employees are eligible to participate
in the Minnesota Post Employment Health Care Savings Plan (HCSP) established
under Minnesota Statutes, Section 352.98 and as outlined in the Minnesota State
Retirement System's Trust and Plan Documents. The purpose of this program is to
allow employees to save money on a tax -free basis to pay for health - related expenses
after separation from public employment. The provisions of this Policy are intended to
be in compliance and consistent with applicable state and federal law. Such law
controls if there is any conflict with a provision of this Policy.
Definitions
Health Care Savings Plan: The Health Care Savings Plan (HCSP) is an employer -
sponsored program that allows employees to save money, tax -free, to use upon
termination of public employment to pay for eligible health care expenses for you, your
spouse and legal tax dependents, and your children up to their 26th birthday regardless
of their marital status, status as a full -time student, or place of residence.
PERA Service Retirement: You will receive an unreduced benefit from PERA when
you reach full retirement age. You may retire prior to that date, but your pension will be
permanently reduced by doing so. These options are described below:
Full Retirement: You are eligible for a full (unreduced) retirement benefit from PERA if:
• You are age 65 or over and have at least one year of public service; or
• Your age plus years of public service total at least 90 (Rule of 90).
Early Retirement: If you retire before age 65, you may be eligible for a reduced pension
if:
• You are at least age 55 and have three or more years of service; or
• You have 30 or more years of service, regardless of age.

Permanent Non -union Employees: Permanent full -time employees are employees of
the City who have passed the initial probationary period and, at the time of separation
from employment, are working full -time in the service of the City, as defined and
determined by the City. Permanent part -time employees are employees who have

passed the initial probationary period and, at the time of separation from employment,
are working less than full -time and a minimum of twenty (20) hours per work week in a
position established by the City Council. "Permanent" employees are those whose
positions are not temporary (including substitutes) or seasonal in nature, as defined and
determined by the City.
Total Gross Pay: Gross pay includes regular pay, overtime pay, and other taxable
earnings.
Policy
All permanent full time and part time employees will participate in a Minnesota Post
Employment Health Care Savings Plan (HCSP). The terms for participation are as
follows:
1. Participation: All permanent non -union employees are required to participate in the
HCSP program.
2. Employee Contribution: Employees in their first year of probation with the City of
Mendota Heights are not eligible to contribute. Thereafter, permanent non -union
employees will contribute 1% of their total gross pay each pay period.
3. Severance:
Leaving city employment for another employer: Employee contributes the value
of 50% of the employee's accrued and unused hours of Vacation, Personal Leave
and compensation time.
PERA Service Retirement from City: Employee contributes the value of 100% of
the employee's accrued and unused hours of Vacation, Personal Leave, and
compensation time.
Waiving participation
You may opt out of the plan if you:
• are eligible for TRICARE retiree benefits or V.A. medical benefits due to a service -
connected disability;
• are a foreign national who plans to return to your country of origin upon termination
of employment.
• have comprehensive health care insurance through another documented source.
Please note: The insurance coverage must be provided by a source other than your
current employer who is sponsoring the HCSP. The insurance must be provided until
death and 70 percent of the cost is covered by the employer.

SUBJECT: Fire Department Donation of Lightning Protection Installation
BACKGROUND
The Lightning Protection Institute (LPI) is sponsoring a "Campaign to Help Build Lightning
Safe Communities" as a continuation of its recent initiative to provide lightning protection
resources to the public and the fire safety community. LPI- certified master installer firms are
participating in the campaign to provide complimentary lightning protection systems for
designated fire stations in several high risk lightning regions of the U.S. including: Chicago,
Minnesota, Dallas and Toledo. LPI organized the campaign donations when outreach with the
fire safety community revealed that many fire stations across the country were lacking lightning
protection systems to protect their personnel, structures and equipment. Lightning can cause
failures of internal building systems, damage equipment and ignite structural fires. Lightning
protection systems can provide critical security for structures.
Thompson Lightning Protection, Inc. of Lilydale sent a letter on behalf of the Lightning
Protection Institute (LPI) offering to install a complete lightning protection system to be installed
at the Mendota Heights Fire Station. This is part of LPI's public service awareness program for
Lightning Safety Awareness Week which is June 23rd through June 29th, 2013. All work would
be done in accordance with NFPA 780 and LPI's nationally recognized standards and the
finished system would carry the LPI -IP Inspection Certification.
The attached resolution formally recognizes Thompson Lightning Protection Inc. and LPI for
installing the complete lightning protection system at the fire station at no cost to the city.

RECOMMENDATION
Staff recommends that City Council accept the donation from Thompson Lightning Protection
Inc. of Lilydale and the Lightning Protection Institute for their generous donation of a complete
lightning protection system to be installed at the Mendota Heights Fire Station.
If the City Council wishes to implement the recommendation, they should pass a motion
adopting the attached Resolution No. 2013 -34 "Resolution Accepting Gifts for the Mendota

SUBJECT: Authorization to Provide Construction Services and Geotechnical Services
for 2013 Street Reconstruction and Rehabilitation Projects
BACKGROUND
The plans and specifications for the Hunter and Orchard Neighborhood Improvements were
approved by the Mendota Heights City Council at the March 19, 2013, city council meeting.
Northdale Construction Company, Inc. of Albertville, Minnesota submitted the low bid and was
awarded the project at the May 7, 2013, city council meeting.
The project includes reconstructing the rural sections of Culligan Lane, Hunter Lane and Orchard
Place. Street reconstruction includes construction of storm sewer, water main replacement,
concrete curb and gutter, aggregate base, and bituminous surfacing. This project also includes
rehabilitating the urban sections of Culligan Lane, Glenhill Road, and Veronica Lane including
the reclamation of the existing bituminous roadway and the placing of a 2.5" bituminous base
course and a 1.5" bituminous wear course over the reclaimed pavement material, curb and gutter
repair, and catch basin repair. This project also includes rehabilitating the urban street section of
Orchard Circle including milling of a 6 -foot wide strip adjacent to the existing curb and gutter
and placing a 1.5" bituminous overlay extending over the entire width of the roadway, curb and
gutter repair, and catch basin repair. The proposed project also includes rehabilitating the
Veronica Lane sanitary sewer lift station.
The plans and specifications for the Crown Point & Overlook Neighborhood Rehabilitation were
approved by the Mendota Heights City Council at the March 5, 2013, city council meeting.
Astech Corp. of Saint Joseph, Minnesota submitted the low bid and was awarded the project at
the April 16, 2013, city council meeting.
The Engineering Department is currently busy with the construction of Trunk Highway 110 &

Staff requested proposals from two surveying companies and received proposals from both of the
companies. Bolton and Menk, Inc. provided a proposal with an estimated cost of $12,190.00 to
complete the construction staking for Hunter and Orchard Neighborhood Improvements. The
other proposal received had a price of $14,010.00. Staff has worked with Bolton and Menk, Inc.
in the past and staff feels that they will complete the construction staking work to our
satisfaction.
Staff also requested proposals from four geotechnical companies and received proposals from all
four companies. Northern Technologies, Inc. provided a proposal with an estimated cost of
$10,675.00 to complete the geotechnical services for Hunter and Orchard Neighborhood
Improvements and the Crown Point & Overlook Neighborhood Rehabilitation which include
gradation of granular materials, compaction density tests, testing of bituminous and concrete
pavement, and inspecting the quarry source. The geotechnical analysis of the materials used in
the projects will assist in verifying that the projects meet all the required specifications. The
other proposals received had prices of $15,878.00, 21,911.00 and $22,725.00. Staff has worked
with Northern Technologies, Inc. on several projects in the past with excellent results.
BUDGET IMPACT
The total construction cost for the Hunter and Orchard Neighborhood Improvements is
$1,537,313.21.
The total construction cost for the Crown Point & Overlook Neighborhood Rehabilitation
improvements is $583,803.00. These costs do not include indirect costs for legal, engineering,
administration, and finance.
In the feasibility reports, construction services and geotechnical services are included as indirect
costs for the project. Staff anticipated these additional project costs and a summary is shown
below:

SUBJECT: City Attorney Contract
BACKGROUND
Earlier this year the City issued a Request for Proposals for city attorney services. Ten firms
responded to the RFP and three firms were selected for an interview. The City Council
interviewed firms on May 7th and directed staff to begin negotiations with the law firm of
Eckberg, Lammers, Briggs, Wolff & Vierling, P.L.L.P, more commonly known as Eckberg
Lammers.
The attached contract specifies the terms of the agreement and highlights include:
1. The contract is for three years, with either party being able to terminate with 90 days
written notice.
2. The hourly rates of $150 /hour for attorneys, $85 /hour for paralegal services, and $200 per
council meeting are locked for the term of the contract.
3. The contract recognizes that Eckberg Lammers also represents the neighboring
communities of Mendota and Lilydale and conflict of interest language is addressed.
4. Tom Lehmann is designated as the lead attorney and Andrew Pratt is the designated
assistant attorney.
Our current city attorney, Tami Diehm, has reviewed the contract and her suggestions have been
incorporated into the final draft.
BUDGET IMPACT
The city annually budgets for legal services and the rates proposed in this contract are in line
with amounts allocated in the 2013 budget.
RECOMMENDATION
Staff recommends that the Mendota Heights City Council approve the attached Contract for Civil
Legal Services with the law firm of Eckberg, Lammers, Briggs, Wolff & Vierling, P.L.L.P. This
action requires a majority vote of the city council.

CONTRACT FOR CIVIL LEGAL SERVICES
This CONTRACT FOR CIVIL LEGAL SERVICES (the "Agreement ") is entered into by
and between the City of Mendota Heights, Minnesota, with its principal office located at 1101
Victoria Curve, Mendota Heights, Minnesota, 55118 (the "City ") and the law firm of Eckberg,
Lammers, Briggs, Wolff & Vierling, P.L.L.P., with its principal office located at 1809
Northwestern Avenue, Stillwater, Minnesota, 55082 (the "Law Firm "), for the purpose of
utilizing the Law Firm to provide civil legal services to the City.
RECITALS
A. The City Council of the City has preliminarily selected the Law Firm to provide
civil legal services to the City. Upon the execution of this Agreement, the Law Firm will
provide civil legal services to the City, and will exclusively provide such services commencing
on or about June 1, 2013 (the "Commencement Date "), or at a different such date as agreed to by
the parties hereto.
B. The City and the Law Firm desire to enter into a contract for three (3) years with
hourly rates outlined as follows:
Year One (June 1, 2013 — May 31, 2014)
Year Two (June 1, 2014 — May 31, 2015)
Year Three (June 1, 2015 — May 31, 2016)

NOW THEREFORE, IN CONSIDERATION OF the mutual promises contained
herein and other good and sufficient consideration, the parties agree to the following:
TERMS
1.1 Scope and Nature of General Counsel Services: The parties agree to the
following description of the nature of the legal services to be provided by the Law Firm upon
request by the City:
a. Attendance at all regular City Council meetings. Attendance at special
City Council meetings /workshops, and City committee meetings
(including Planning Commission meetings) as requested. All Council
meetings shall be billed at a flat rate of $200.00. All other City committee
meetings attended shall be billed at the applicable hourly rate described
above.
b. Review of City Council, City committee, and Planning Commission
agenda items and minutes.

c. Teleconference and in- person meetings with the City Administrator, City
Officials, and City department heads to identify issues of short and long-
term importance.
d. Drafting of and revisions to City ordinances, resolutions and regulations.
e. Drafting of municipal contracts, joint powers agreements, and the like;
review of contractor /vendor bond and insurance documents.
f Research and preparation of legal opinions on municipal or other legal
matters, including open meeting law /data practices issues and general
municipal employment matters.
g.
Providing regular updates on significant developments in laws affecting
the City to the City Administrator, City Council and City staff.
h. Providing a yearly legislative update.
J.
Providing regular in- service presentations as requested to City staff and
City officers on topics selected by the Law Firm and the City with special
emphasis on new developments in the law (e.g. labor issues /data practices
issues /land use issues).
Providing economic development services including advice on tax
increment financing, tax abatement, business subsidy, and other
development matters, including the drafting of and revisions to
development agreements, assessment agreements, tax increment financing
proceedings, and the like. If such economic development representation is
proposed to be fully reimbursed by a private developer, the Law Firm may
adjust its billing rate accordingly in consultation with the City
Administrator.
1.2 Best Legal Practices Initiatives: In addition to the above - stated services,
throughout the period of its representation, the Law Firm shall furnish, upon request, regular
"Best Legal Practices Initiative Services." The services shall include on -site meetings with City
staff and department heads and, where appropriate, the City Administrator and City Council to
perform the specified initiatives. It is expected that the specified best practices initiatives may
change as required by the growth and change of the City. All practices shall be benchmarked
against those of other leading cities, not limited to cities in Minnesota. These services shall
include, but shall not be limited to:
A. Municipal Infrastructure Best Practices: The Law Firm shall regularly:
1. Update the City Administrator and City Council on current methods of
funding needed municipal infrastructure including alternate methods of
securing infrastructure improvements.

2. Review and advice shall make reference to existing and new legislation
but also City- initiated methods of sharing or eliminating costs.
3. Benchmark infrastructure cost recovery efforts against other leading cities.
B. Department Specific Best Practices: The Law Firm shall regularly review the
internal processes and procedures of City Departments to furnish
recommendations in order to:

Planning/Engineering Legal Best Practices: The Law Firm shall:
1. Perform an annual review of Planning/Engineering documents and related

2. Make regular recommendations for standardization of City documents,
development agreements and contracts and processes using templates and
checklists where advisable to improve efficiency and predictability.
3. Devise solutions for avoidance of liability and litigation, and assurance of
proper development close -out including recordation of all necessary
conveyances.
4. Regularly benchmark Planning/Engineering legal

Other Matters: The parties contemplate that the Law Firm may also provide
services outside the scope of services covered by the general and "best practices"
described in paragraphs 1.1 and 1.2 above. These services shall be handled as

1.3.1 Contested Case Matters: The Law Firm will provide, and the City shall
utilize the Law Firm for representation in, contested cases, provided the
City has the right to select counsel in the contested case, and provided the
City determines, in its reasonable discretion, that the Law Firm has the
skill and experience to represent the City in a fashion that the City deems
to be in its best interests given the expertise, costs, and litigation service
delivery available from other law firms in the Twin Cities Metro area.
These legal services will be billed to the City in accordance with a
separate agreement between the parties hereto.
1.3.2 Bond Attorney Matters: The Law Firm is a "nationally recognized bond
counsel" under the requirements of The Bond Buyer's Municipal
Marketplace (also known as the "Redbook "). If retained by the City for
bond counsel matters, the Law Firm will perform such services under a
separate fee structure.
1.3.3 Prosecuting Attorney Matters: The Law Firm recognizes that the City
is under contract with a different law firm for the provision of prosecution
legal services. The Law Firm will therefore not perform legal services as
a prosecuting attorney, except as otherwise directed by the City or as
required in a conflict situation with the City's prosecuting attorney (and as
agreed to by such prosecuting attorney). The Law Firm will work with the
prosecuting attorney in the transition of any matters from civil to criminal
representation, and vice - versa.
1.3.4 Labor Attorney Matters: The Law Firm recognizes that the City is
under contract with a different law firm for the provision of labor and
employment legal services. The Law Firm will therefore not perform such
services except as otherwise directed by the City or as required in a
conflict situation with the City's labor and employment law firm (and as
agreed to by such firm).
2. Reimbursable Costs and Expenses.
2.1 General Rule: The City will reimburse the Law Firm for actual,
necessary and reasonable costs and expenses incurred by the Law Firm in
the performance of the legal services contained in this Agreement.

3. Matters Covered by Insurance: The Law Firm will assist the City in
submitting claims for insurance coverage to various insurance carriers.
Whenever a claim is made with an insurance carrier, which arises out of a legal
issue within the scope of this Agreement, the City will recommend that the Law
Firm be utilized by the insurance carrier in the matter for which the claim is
made. The City may recommend the Law Firm to an insurance carrier for claims
arising out of matters which are outside the scope of this Agreement. At the
point in time when an insurance carrier admits coverage, and to the extent that
such carrier will provide retroactive payments for attorneys' fees, the Law Firm
will receive its payments for services rendered from the insurance carrier and not
from the City. To the extent that an insurance carrier does not pay for legal
services rendered by the Law Firm, including any deductibles, the City will pay
the Law Firm for services rendered at the rates charged to the insurance
company, subject to billing and payment provisions of paragraph 5.
4. Conflict of Interest and Attorney /Client Privilege Issues:
4.1 Conflict of Interest: The Law Firm will notify the City if the Law Firm
represents or has ever represented an opposing party in a legal matter.
4.2 Adjacent Municipalities: The parties to this Agreement understand and
acknowledge that the Law Firm currently provides civil and criminal
municipal representation to the City of Mendota and the City of Lilydale.
In the case of a conflict of interest between one or more of the above -
named cities and the City, such that the Law Firm is unable to provide
objective legal representation to the City, the parties hereto will
collaboratively work together to identify the scope of the conflict of
interest and engage alternate legal representation to represent the City on a
limited basis for such matter.
4.3 Attorney /Client Privilege: The Law Firm is authorized to utilize e -mail
without encryption to transmit and receive confidential client information.
The City specifically acknowledges that it understands the confidentiality
risks associated with inadvertent interception of such information.

5. Billing Format, Cycle, Payment Expectations and Interests.
5.1 Billing Format: The Law Finn will submit monthly statements to the
City itemizing legal services rendered for the prior month broken down
into easily understandable categories.
5.2 Billing Cycle: The Law Firm will bill monthly for legal services rendered
in the prior month. Generally, bills will go out approximately 10 days
after the end of the prior month.
5.3 Payment Expectations: The City will pay the bill of the Law Firm
routinely according to its internal payment procedures by forwarding a
check to the Law Firm paying for both legal services and expenses shown
on the Law Firm's bill.
5.4 Disputes: In the event that the City disputes any aspect of the Law Firm's
bill, the appropriate City representative will contact Thomas R. Lehmann
at the Law Firm stating the nature of the dispute.
5.5 Term: The term of this Agreement will be from June 1, 2013 through
May 31, 2016. The Law Firm recognizes that the firm currently providing
civil legal services to the City is expected to cease providing such services
on or about mid -June, 2013.
1. During the term of this Agreement, either party may terminate this
Agreement upon 90 calendar days' written notice to the other
party.
2. The parties agree to mutually evaluate the usage of legal services
at any time, and at a minimum annually during this Agreement to
evaluate usage and identify areas where modification(s) in the
parties' relationship may be mutually beneficial.
5.6 Authorized Contact Persons: Thomas R. Lehmann will act as lead
attorney for the City. Andrew J. Pratt will act as the assistant attorney.
However, the parties contemplate that other attorneys in the Law Firm will
also be providing services to the City subject always to advance approval
by the City.
5.7 City Approval: Subject to the timing provisions of this Agreement
described above, the Law Firm is authorized to commence providing civil
legal services to the City upon the execution of this Agreement by the
City.

Ordinance Permitting Electric Boat Motors on Rogers Lake
Representatives from the Roger's Lake Homeowner's Association made a request to the city council in
the fall of 2012 to allow boat motors on Roger's Lake, south of Wagon Wheel Trail. The request sought
approval for boat motors on a trial basis, with conditions. The city council did not support the request at
that time, and recommended that the association develop the idea further.
The association has followed council direction, and presented an updated request to the parks and
recreation commission at their April 2013 meeting. This request limits the type and size of motors
allowed, as well as boat size and hours the activity would be permitted. The commission supported the
request, and recommended that the city council consider allowing electric boat motors on Rogers Lake.
Attached you will find a draft ordinance, with the conditions created by the association, and considered by
the parks and recreation commission. The ordinance would allow the use of electric motors for the
remainder of the 2013 calendar year. The ordinance, as drafted would not change City Code, but would
serve as a stand -alone ordinance, which will expire. If city council chooses to allow motors on a
permanent basis, an ordinance amending City Code could be considered at a future date.
This approach provides an opportunity to monitor lake use and impacts to Rogers Lake Park on a trial
basis.
The Roger's Lake Homeowner's Association has committed to installing signs at Rogers Lake Park, at
their own expense, stating the restrictions for the use of boat motors.
BUDGET IMPACT
City staff does not anticipate any additional cost for allowing electric motors on Rogers Lake on
a temporary basis.
RECOMMENDATION
The Parks and Recreation Commission recommended allowing electric boat motors on Rogers
Lake, south of Wagon Wheel Trail. If city council wishes to implement this recommendation,
pass a motion adopting ORDINANCE 451, AN ORDINANCE ALLOWING ELECTRIC BOAT
MOTORS ON ROGERS LAKE. This action requires a simple majority vote.

WHEREAS the city seeks to allow certain motorized boats on Rogers Lake, south of Wagon

The City Council of the City of Mendota Heights, Minnesota ordains as follows:
Boats with electric motors shall be permitted on Rogers Lake, south of Wagon Wheel
Trail, under the following conditions:
1. The boat must be 14 feet or less in length.
2. The motor strength must be 48 pounds of thrust (or equivalent to five horsepower) or
less.
3. The boat must be operated at "slow no wake" speed.

This ordinance takes effect upon publication, and will remain in effect until December 31, 2013.

On March 27, 2013, members of the Rogers Lake Association passed a motion to allow boats to use
electric motors on the south side of Rogers Lake, subject to the following conditions:
• The boat must be 14 ft. or less in length
• The motor strength must be 48 lbs. of thrust /5 horsepower or less
• The boat must be operated at "slow no wake" speed
• Hours of operation for electric motors are sunrise to sunset
• The association will install signage at the park stating such restrictions
• One year trial period for 2013
On April 9, 2013, the Mendota Heights Parks Commission voted unanimously to approve and make a
recommendation to the City Council to approve this electric motors proposal.
On behalf of the Rogers Lake Association, please let this letter serve as our official request to the City
that ordinance 6 -6 -1: Watercraft be appropriately amended to reflect such stated conditions above.
On behalf of the Rogers Lake Association, I will attend the Mendota Heights City Council meeting on
Tuesday, May 21, to address any concerns, questions, or comments the mayor, council or staff may have

SUBJECT: Amendment to the 2013 -2017 Street Improvement Plan
BACKGROUND
For the past several years, the City of Mendota Heights has had a five year Street Improvement
Plan (SIP). This plan is available to the public and is published on our City web page. The
current edition of the SIP (2013 -2017) identifies a street rehabilitation (pavement replacement)
project for Walsh Lane, Stratford Road, Rolling Green Curve, Oxford Court, Windwood Court,
and Coventry Court in 2015.
Starting in February of 2013 staff began receiving calls from residents of this neighborhood
asking for the project to be advanced to 2014 due to the deteriorating pavement conditions on the
street. In response to these requests, and before we began work on the Feasibility Reports for the
2014 construction year, staff sent out a survey to the 67 property owners that would be affected
by the Walsh Lane Neighborhood Rehabilitation project soliciting their opinions as to which
construction year they preferred. Staff asked for responses from the residents by May 10th. The
results of our survey are:
- 67 surveys sent, 44 returned (66 %)
- Of 44 surveys returned, 26 (59 %) favor 2014 construction, 15 (34 %) favor 2015
construction, 2 (5 %) favor either year, and 1 (2 %) favors no project at all.
- Of 67 surveys sent, 26 (39 %) favor 2014 construction, 15 (22 %) favor 2015 construction, 2
(3 %) favor either year, and 1 (1 %) favors no project at all.
In reviewing the 2013 -2017 SIP, staff has determined that the Walsh Lane Neighborhood
Rehabilitation project could be moved forward, and the existing 2014 Centre Pointe &
Commerce Drive Rehabilitation project could be moved back to 2015; essentially trading one
project for the other, and staff proposes an amendment to the SIP to make this adjustment.
If this amendment were to be made, the normal legal and project processes would be still
followed, including neighborhood meetings, public hearings, feasibility studies, etc.

BUDGET IMPACT
If the amendment is approved, the 2014 estimated amount for street improvements would be reduced
by $555,000. Similarly, the 2015 estimated amount for street improvements would be increased by
$555,000. The total yearly amounts estimated for 2014 and 2015 would become $3,649,000 and
$3,742,500 respectively, bringing the two years closer together in potential City costs. The following
table denotes the financial adjustments to the SIP:

SUBJECT: Mendakota Park Playground Refurbishing
BACKGROUND
At the April 9, 2013 regular meeting of the parks and recreation commission, the commission passed a
motion recommending that the city council accept a quote to refurbish the playground equipment at
Mendakota Park. The commission also directed staff to obtain competitive quotes for replacing the
playground surfacing material with engineered wood fiber.
The cost to refurbish the playground, quoted at $70,400, is approximately half the cost of replacement.
The attached proposal includes complete repainting of the playground and decks, with a number of new
play elements. The proposal will repair damaged components and bring the structure up to date for
current safety standards. The attached site plan shows existing structure to be refurbished and proposed
new play elements. Play components for ages 3 -5 were replaced in 2010.
There is only one regional representative for each playground company, in this case, Landscape
Structures, Inc (LSI). While this limits the ability to procure competitive bids, our local LSI
representative, Flagship Recreation is certified under the State of Minnesota Cooperative Pricing
Venture (CPV). The CPV purchasing program is defined in State Statute and ensures that contracts are
awarded through an open procurement process and pricing will be consistently fair and competitive
(information from the State of Minnesota Materials Management Division website).
Staff did obtain competitive quotes for replacement of the playground surfacing, which is currently pea
gravel. The parks and recreation commission recommended replacement of the playground surfacing
material. Minnesota /Wisconsin Playground provided the lowest quoted price for removal of the pea
gravel and installation of engineered wood fiber, at a cost of $9,816.63.
BUDGET IMPACT
The 2013 City of Mendota Heights budget includes $70,000 as Special Parks Fund expenditure for
improvements to Mendakota Park playground equipment. The cost for replacing the playground
surfacing material is above the budgeted amount, and could be funded by the Special Parks Fund. The
Special Parks Fund currently has a balance of $221,000.
RECOMMENDATION
If the city council desires to implement the recommendation, pass a motion accepting the attached
quotes for refurbishing the playground and replacing the playground surfacing materials at Mendakota
Park. This action requires a simple majority vote.

SUBJECT: MHAA Request Regarding Victoria Highlands Park
BACKGROUND
The Mendota Heights Athletic Association (MHAA) travelling baseball program is seeking an additional
baseball -only field in the city for youth ages 10 -11. In meeting with city staff, MHAA has identified the
recreational ball field at Victoria Highlands as a suitable location for a dedicated use.
MHAA has developed plans for improvements to the park which would meet the needs of this group.
Work includes multiple phases. The first phase would upgrade the backstop, install an outfield fence and
a pitching mound. Potential future phases would include improved dugout areas, batting cages and
installing a turf infield with irrigation.
The parks and recreation commission received a presentation from Joe Juliette, a MHAA volunteer on the
proposed improvements. The commission supported the concept of converting the field to baseball -only
use and advised MHAA to further refine details of the plan, including funding.
Staff has placed this item on the city council agenda with the understanding that MHAA would like to
request permission to move forward with the project. MHAA also intends to request funding from the
city for the project. At the time of memo preparation, those details are not yet available.
BUDGET IMPACT
There is no budgeted funding for ballfield improvements in 2013. Staff will be prepared to
discuss possible sources if city council is interested in participating in funding the project.
RECOMMENDATION
This item is placed on the agenda as a placeholder. Staff has not been provided any detailed
request to review or recommend. If city council supports the concept of changing the multi-
purpose field at Victoria Highlands Park to baseball use only, pass a motion directing staff to
work with MHAA on park improvements. If city council would like to support the project
financially, the motion should include direction to staff on the amount and source of those funds.
